- This is a Notice of Intent to award a sole source contract under statutory authority, 10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. The government intends to award a sole source (See approved sole source justification below) Blanket Purchase Agreement to Civil Air Patrol, Corporation. If any interested parties can fulfill this requirement, please provide statement of capabilities to this office NLT 12:00 Noon CST on 9 January 2012. Electronic submissions are acceptable. ATTACHMENT: SUBJECT: Sole Source Justification, CAP Aircraft Rental. 1. Description of supplies/services to be acquired: a. An acquisition under less than full and open competition is contemplated to rent aircraft, solo flying hours, instruction per hour, and owner manuals from the Civil Air Patrol Corporation (CAP Corporation), as private, non-profit organization chartered to operate the Civil Air Patrol (CAP) the United States Air Force Auxiliary. A Blanket Purchase Agreement with a Period of Performance of 1 Oct 12 - 30 Sep 17 is contemplated. b. The mission of the Civil Air Patrol-United States Air Force (CAP-USAF) is to provide Air Force advice and oversight to CAP units on a nationwide basis. The oversight mission performed by the Air Force includes Staff Assistance Visits, Inspector General inspections, participation and evaluation of flight activities funded by the USAF and other government agencies and performed by the CAP. Most CAP owned aircraft are uniquely equipped to perform Air Force assigned missions. To provide the required functional area expertise, the Air Force assigned pilots must maintain currency in the aircraft and familiarity with the capabilities of the unique equipment. Additionally, USAF assigned pilots are required to conduct annual flight evaluations of all (52) CAP Wing Standards and Evaluation Pilots, conduct cadet familiarization flights in light aircraft as directed throughout the United States and Puerto Rico. May conduct observation flights at search and rescue exercises (SAREX) or counterdrug (CD) operations exercises and CAP cadet familiarization flights. Monitors CAP Aircraft Maintenance Program for compliance with Federal Aviation Regulations (FAR) and other applicable directives. USAF Liaison Officers in each state are required to fully participate in wing activities. They are required to pilot general aviation aircraft, on a recurring and regular basis, in support of the USAF mission and CAP missions. Based on an agreement between CAP and CAP-USAF, use of CAP aircraft by CAP-USAF personnel will be on a per-hour rental basis. c. Rental of similar type aircraft from any other source will not satisfy the CAP-USAF requirement because those aircraft would not be the specific one flown by the CAP. 2. Statutory authority Permitting Other Than Full and Open Competition: This requirement is issued pursuant to 10 U.S.C. 2304 (c)(1), as set forth in FAR Part 13.106-1(b), "For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization)". Only one responsible source and no other supplies or services will satisfy agency requirement. The CAP Corporation is the only agency that can provide the required services nationwide. 3. Required delivery date for supplies or the period of performance for services: 1 October, 2012 - 30 September 2017
