Description
National Aeronautics and Space Administration (NASA) Langley Research Center (LaRC)is seeking Capability Statements from all interested parties, including Small, SmallDisadvantaged (SDB), 8(a), Woman-owned (WOSB), Veteran Owned (VOSB), Service DisabledVeteran Owned (SD-VOSB), Historically Underutilized Business Zone (HUBZone) businesses, and Historically Black Colleges and Universities (HBCU)/Minority Institutions (MI) forthe purposes of determining the appropriate level of competition and/or small businesssubcontracting goals for Environmental Support Services. The Government reserves theright to consider a Small, 8(a), Woman-owned (WOSB), Service Disabled Veteran (SD-VOSB),or HUBZone business set-aside based on responses hereto.The Environmental Management Branch (EMB) is responsible for LaRC's environmental andenergy compliance, management, conservation, and sustainability programs. Theseresponsibilities include coordination and integration of all environmental programs,interpreting environmental regulations as they apply to LaRC's activities, providingguidance on regulatory requirements, acting as the formal point of contact with allenvironmental regulation agencies, development assistance and review of environmentalpermits, implementing cost effective energy efficiency and water conservation practices,remediation of contaminated sites, cease and desist authority for all pollutingactivities, and compliance monitoring and surveillance. The individual environmental andenergy media and program areas are overseen and managed by the LaRC civil servant staff. Interested offerors/vendors having the required specialized capabilities should submit aCapability Statement of 7 pages or less (including attachments) with a minimum font sizeof 12 indicating the ability to perform the aspects of the effort described herein. Thecapability statement should specifically respond to the areas detailed below to include(1) General Information, (2) Personnel Capabilities, and (3) Technical Capabilities toinclude general information and technical background describing your firms experience incontracts that are relevant to the work described below, requiring similar efforts, andof similar magnitude with a focus on experience at Federal Facilities.Potentialofferors shall specifically comment, within the page limitation, on its capabilities andqualifications to meet the following: (1) General Information (Maximum of 2 pages):Interested offerors shall submit generalinformation to include: (a) name and address of firm; (b) Point of Contact informationto include name, title, phone number and email; (c) whether you intend to submit anoffer, and if so, would you submit as a prime or subcontractor; (d) average annualrevenue for past 3 years and number of employees; (e) size of business concern (large,small, 8(a), veteran-owned small business, service-disabled veteran-owned small business,HUBZone, small disadvantaged, woman-owned small business, Historically Black Colleges andUniversities (HBCUs), and Minority Institutions (MIs); (f) number of years in business;(g) affiliate information to include parent company, joint venture partners, potentialteaming partners, prime contractor (if potential sub) or subcontractors (if potentialprime); and (h) 2 or 3 customer contacts covering the past three years (highlightrelevant work performed, contract numbers, contract type, dollar value of each contract,number of employees and customer point of contact address, phone number and emailaddress). (2) Personnel Capabilities: The contractor shall provide management and staffing thatpossess the requisite education, experience, and other qualifications to meet therequirements detailed herein. This includes, but is not limited to, formal education,experience, training and a detailed knowledge of applicable Federal statutes andregulations including the Clean Water Act (CWA), Clean Air Act (CAA), ResourcesConservation and Recovery Act (RCRA), Emergency Planning and Community Right-to-Know Act(EPCRA), National Environmental Policy Act (NEPA) of 1969, Endangered Species Act (ESA),National Historical Preservation Act (NHPA), Comprehensive Environmental ResponseCompensation and Liability Act (CERCLA) of 1980, and the Superfund Amendments andReauthorization Act (SARA) of 1986 as well as a similar understanding of the Commonwealthof Virginia and local statutes and regulations, NASA Environmental policy, and LangleyPolicy Directive (LAPD) 8500.1, and Langley Procedural Requirements (LPR) 8500.1 titledEnvironmental and Energy Program Manual.(3) Technical Capabilities: The contractor shall be required to support the followingtechnical areas, at a minimum:National Environmental Policy Act (NEPA) and Project Review Support compliant withapplicable requirements and policies defined in the NEPA and EO 13423 and 13514.Remediation Services compliant with applicable requirements and policies defined inCERCLA, as amended by SARA. The contractor shall provide remediation support to EMB incompliance with the existing Construction Debris Landfill (CDL) site which requiresannual sampling of 22 monitoring wells. Additionally, NASA LaRC is currently listed onthe National Priorities List. NASA LaRC anticipates beginning the de-listing processduring the next few years. The contractor will need to be able to support this effortand show experience in dealing with state and federal level regulators on negotiatingissues related to the CERCLA process from site investigations through de-listing, with afocus on experience at Federal Facilities.Waste Management complaint with applicable requirements and policies defined in the RCRA,the Occupational Safety and Health Administration (OSHA), the Virginia DEQ, and the LaRCEnvironmental and Energy Program Manual. LaRC operates as a Large Quantity Generator inaccordance with applicable Federal, State and local environmental laws, and hazardouswaste regulations. The Contractor shall transport and dispose of hazardous wastegenerated at LaRC using Government approved Treatment, Storage and Disposal Facilities(TSDF) in accordance with RCRA, Toxic Substance Control Act (TSCA), and Department ofTransportation (DOT) regulations. Waste generated at LaRC includes but not limited tohazardous, non-hazardous and universal waste, oils, metals, polychlorinated biphenyl, andasbestos related waste and regulated non-hazardous waste. The Contractor shall maintainthe Centers Waste Disposal Tracking System (WDTS) which is accessible through the LaRCInternet Website. The Contractor shall provide database and application management, andidentify technology to optimize system functionality. The Contractor shall ensure allemployees providing support to the waste management program maintains the followinglicenses/training: 40 hour OSHA HAZWOPER in accordance with 29 CFR 1910.120(e), Class CVirginia Commercial Driver License with a Hazardous Endorsement, DOT Hazmat EmployeesTraining in accordance with 49 CFR 172.700; 173.1(b), RCRA Hazardous Waste ManagementTraining in accordance with 40 CFR 262.34(a) (4), 246.16 and 265.16.Laboratory Support for laboratory services and analyses required by the Centersenvironmental permits and other environmental sampling requirements. The contractorshall conduct field sampling and analyses (temperature, pH), and laboratory analyses inaccordance with Virginia Department of Environmental Quality (VDEQ), Hampton RoadsSanitation District (HRSD), and Environmental Protection Agency (EPA) approved methods,procedures and certification. Laboratories utilized shall be certified as appropriate,by the applicable regulatory agency. Air Quality Program compliant with applicable requirements and policies defined in theCAA. The EPA has granted the VDEQ authority for oversight and enforcement of CAAprovisions. The contractor shall prepare air program regulatory correspondence, permitamendment requests, permit applications and required reports as necessary to be submittedto EMB.Water Quality Program compliant with applicable requirements and policies to review LaRCfacility operations, sample and analyze wastewater, as required by permits or directed byEMB. The contractor shall review the data to evaluate compliance with HRSD, VDEQ,Virginia Department of Conservation Recreation (VDCR) and EPA water pollution controlregulations, evaluate potential risks of noncompliance, and provide writtenrecommendations to EMB to maintain compliance, as appropriate.The contractor shallprepare permit regulatory correspondence, modifications and applications and requiredreports as necessary for the Virginia Pollutant Discharge Elimination System (VPDES)permit, Municipal Separate Storm Sewer System (MS4) plan and HRSD permits. Thecontractor shall assist in implementing best management practices approved by DCR in theMS4 Program Plan. The contractor shall assist with erosion and sediment control (ESC)management for land-disturbing activities at LaRC. This includes assistance indetermining construction site stormwater permitting applicability, reviewing andcommenting on Stormwater Pollution Prevention Plans (SWPPPs), site inspection for permitcompliance, and record keeping for stormwater compliance. At least one employee musthave Combined Administrator certification from DCR. Additionally, the Chesapeake BayTotal Maximum Daily Loads (TMDLs) will begin to be implemented by the state and EPA. Thecontractor will need experience negotiating with regulators regarding changingregulations focusing on innovative solutions and limit impact to operations at theCenter.Tank Program Support compliant with applicable requirements and policies defined in EPAregulations regarding to underground storage tanks in 40 CFR 280 (Technical Standards andCorrective Action Requirements for Owners and Operators of Underground Storage Tanks(UST)). The EPA regulations regarding aboveground storage tanks ASTs are contained in 40CFR 112 (Oil Pollution Prevention) and 40 CFR 122 (The National Pollutant DischargeElimination System). The Centers Hazardous Materials Spill Contingency Plan, OilDischarge Contingency Plan, and Oil Spill Prevention Control and Countermeasure (SPCC)Plan have been combined into one document called the NASA LaRC Integrated SpillContingency Plan (ISCP). The Plan is available in the LaRC Langley Management System asLPR 8715.12 and is also available by contacting EMB. The contractor shall oversee theCenters UST and AST regulatory compliance program. The Center currently has 6 USTsranging in capacity from 6,000 gallons to 50,000 gallons and 16 ASTs ranging in capacityfrom 500 gallons to 8,000 gallons. The contractor shall be certified as Class A andClass B Operator in accordance with UST regulations. The Contractor shall update theCenters ISCP by a licensed Professional Engineer to reflect changes in Center operationsand environmental regulations. Cultural Resource Management Support compliant with National Historic Preservation Act(NHPA). The contractor shall ensure that the employee providing recommendations for NHPAcompliance have completed acceptable training in Sections 106, 110 and 111 or havedemonstrated work experience directly related to NHPA compliance. The contractor shallprepare regulatory correspondence and reports to EMB to ensure compliance with theProgrammatic Agreement (PA) among NASA, the Virginia State Historic Preservation Office,and the Advisory Council on Historic Preservation for Management of Facilities,Infrastructure and Sites at NASA LaRC (dated 2010). Energy and Water Conservation Support compliant with applicable requirements and policiesthat shall provide energy and water conservation support to EMB to ensure compliance withapplicable laws, policies, and EO to facilitate meeting the Centers energy and watergoals.Potential offerors are referred to the attached Draft Requirements Document for adetailed listing of the required services. Industry is encouraged to provide comments,suggestions, and recommendations regarding the Draft Requirements Document. In addition,LaRC is also interested in contractor feedback related to suggestions for contract type,subcontracting opportunities, and possible contract incentives (positive and negative). The North American Industry Classification System (NAICS) code for this procurement is541620, Environmental Consulting Services, with a size standard of $7,000,000 annually.Estimated award date for this contract is September 1, 2012. This is a sources sought synopsis to be used for information purposes only forpreliminary planning purposes to assist NASA LaRC in its procurement strategy, to assesscapabilities and qualifications of potential offerors, gain knowledge of interest, and tosupport any potential set-asides.No solicitation exists; therefore, do not request a copy of the solicitation. If asolicitation is released it will be synopsized in FedBizOpps and on the NASA AcquisitionInternet Service. It is the potential offerors responsibility to monitor these sitesfor the release of any solicitation or synopsis.Please advise if this requirement is considered a commercial or commercial-type service.
