Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval Under Simplified Acquisition Procedures (SAP) For Restricting Competition under FAR 13.106-1(b)(1) "Single Source" 1.Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 20, Portland VA Medical Center (PVAMC), 3710 SW U.S. Veterans Hospital Road, Portland, OR, 97239. 2.Nature and/or Description of the Action Being Processed: This procurement under PR # 648-12-1-6999-0001, Contract # VA260-12-P-0135 is for assisted parking services, where in accordance with FAR 6.001(a), acquisitions conducted under FAR 13 for SAP are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2, in accordance with (IAW) the VHA SOP for Other Than Full And Open Competition dated 3-22-2011. This will be a new firm-fixed-price contract action. 3.Description of Supplies or Services Required to Meet the Agency's Needs: PVAMC has a requirement to park an additional 100 employee vehicles at the Portland campus. This is due to the closure of surface parking Lot #13 (77 parking spaces) which is undergoing construction to become a parking structure. In addition to the existing striped parking stalls at the campus, the contractor shall direct employees to park an additional 100 vehicles at the PVAMC main campus. Assisted parking is intended for VA employees only. The contractor will not park patient, visitors, and volunteers. The total estimated value of this acquisition is $108,000.00. This is for a two month base and eight months option. The period of performance is 14 November 2011 - 31 December 2012. 4.Statutory Authority Permitting Restriction in Competition: The statutory authority for restricting competition under SAP, or Single Sourcing, for acquisitions under $150,000 or Simplified Acquisition Threshold (SAT) is 41 U.S.C. 253(c), as implemented by FAR 13.106-1(b)(1). The specific reason for restricting competition is urgency. The requirement was not synopsized IAW FAR 5.101 due to urgency. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The contractor that was currently performing the work, Daja International, is citing bankruptcy and is going out of business. The period of performance was awarded for 1 May 2011 - June 2012. Daja International provided notice, to the contracting office and service line, that they would no longer provide services the same day (Nov. 4, 2011) that services were discontinued. The new procurement request (transaction number 648-12-1-6999-000) was received in contracting on 4 November 2011, with a new contract required to be in place by 13 November. Due to a short week and Veteran's Day holiday weekend, a three day window was the only time allowed for to secure a new contractor. 6.Description of Efforts Made to Ensure that Offers are Solicited from As Many Potential Sources as Deemed Practicable IAW FAR 13.104: The requirement was not synopsized IAW FAR 5.101 due to urgency. Though formal competition was not sought by means of posting to FedBizOpps, the service line and contract specialist conducted brief market research in an effort to obtain quotes. Market research showed two other potential vendors, in addition to the known vendor, that may be capable of providing the required services. One of the vendors was not found in CCR, and therefore, was not pursued for a quote. Star Park, LLC was found to be in CCR and was contacted with a request to provide a quote. A walk through was quickly planned for Tuesday, November 8th, at 9:00am. Star Park, LLC and Ameritac, Inc. were notified of the date/time/location of the walk through. Star Park, LLC was the only attendee at the walk through. Quotes were received from Star Park, LLC and Ameritac, Inc. A verbal order was given on 9 November to Star Park, LLC. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - IAW FAR 13.106-3: The anticipated total dollar amount of the proposed acquisition is $108,000.00 (quote from Star Park, LLC). This is based on a two-month base period of $20,000.00 and an additional eight month option of $11,000.00 for each month. The IGE is $121,310.00. The quote received form Ameritac, Inc. was for $114,344. Based on this data, the price is found to be fair and reasonable. 8.Description of the Market Research Conducted and the Results, or Statement of Reasons Market Research was not Conducted (FAR 10): The service line point of contact and the contract specialist conducted brief market research in an effort to obtain quotes. Market research showed two other potential vendors, in addition to the known vendor, that may be capable of providing the required services. One of the vendors was not found in CCR, and therefore, was not pursued for a quote. Star Park, LLC was found to be in CCR and was contacted with a request to provide a quote. It is anticipated that this service will not be necessary after August 2012. 12.
