Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval Under Simplified Acquisition Procedures (SAP) For Restricting Competition under FAR 13.106-1(b)(1) "Single Source" 1.Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 20, for Portland VA Medical Center (PVAMC) 2.Nature and/or Description of the Action Being Processed: This action requested to be reviewed and approved is to seek other than full and open competition for the annual preventive maintenance service for the Biomerieux Bact/Alert 3D automated microbial detection system that belongs to microbiology. The purchase request is 648-11-4-5095-0867, posted under solicitation VA-260-11-RI-1333, and proposed purchase order is VA648-C11983. The purchase order is valued at $4,908.00. In accordance with FAR 6.001(a), acquisitions conducted under FAR 13 for SAP are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2, IAW the VHA SOP for Other Than Full And Open Competition dated 3-22-2011. 3.Description of Supplies or Services Required to Meet the Agency's Needs: The Biomerieux Bact/Alert 3D automated microbial detection system is an instrument that is used for sepsis risk stratification and monitoring for the presence or absence of microorganisms in blood, sterile body fluids, and mycobacteria. This instrument helps to identify a wide range of organisms in a very accurate and efficient manner improving patient care. This one-time annual service is quoted at $5,000. 4.Statutory Authority Permitting Restriction in Competition: The statutory authority for restricting competition under SAP, or Single Sourcing, for acquisitions under $150,000 or Simplified Acquisition Threshold (SAT) is 41 U.S.C. 253(c), as implemented by FAR 13.106-1(b)(1). The specific reason for restricting competition is the contracting officer has determined that only one source is reasonably available due to the fact that the selected vendor has gained sole proprietary rights to perform the required service. At this time, no other vendor has the capability of fulfilling the requirement. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Biomerieux is the only vendor authorized to service this instrument because the parts and tools required to complete the job are manufacturer specific. Market research supports the fact that the vendor is the only qualified and available source to provide the distinct and thorough service necessary for this device. 6.Description of Efforts Made to Ensure that Offers are Solicited from As Many Potential Sources as Deemed Practicable IAW FAR 13.104: The contract specialist posted a special notice on FBO to publicize the VA's intent to solicit from a single source. The notice was available on December 8th. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable - IAW FAR 13.106-3: In accordance with FAR 13.106-3(a)(2), the anticipated cost of $5,000.00 will be determined fair and reasonable based upon previous one-time maintenance and repairs of similar acquisitions.. 8.Description of the Market Research Conducted and the Results, or Statement of Reasons Market Research was not Conducted (FAR 10): Based on FDA regulations, the manufacturer's equipment must be maintained to specifications only trained and certified individuals are authorized to perform. Per conversation with the manufacturer, no third party contractors have been trained or certified to perform any services on this equipment. No vendor expressed interest after the intent to go with a single source notice was posted to the Federal Business Opportunities website (FBO). 9.Any Other Facts Supporting the Restriction of Competition: No other facts beyond what has been described above are available to support restricting competition. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No vendors expressed interest in writing at this time. 11.Statement of Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making Subsequent Acquisitions for the Supplies or Services Required: The contract specialist will continue to seek competition to the fullest extent possible.
