- Justification for Exception from Fair Opportunity to be Considered A task order was issued in October 2007 to ARD-Tetra Tech to provide technical assistance in the implementation of the Strengthening Property Rights in Timor-Leste (SPRTL) project, locally known as Ita Nia Rai (Our Land). The project provides technical assistance to the GoTL's Ministry of Justice (MOJ). A final evaluation of the project was conducted in October of 2011 to inform the Mission on the degree to which the SPRTL project had accomplished its goals, identify strengths and weaknesses of the project, and make recommendations for future activities. The evaluation team concluded that the SPRTL project has largely been a success. The most notable, and valuable, of these successes has been the collection and recording of land claims data from across the country. This data should provide the core of a national cadaster and/or registry that identifies and tracks ownership of parcels of land over time. The MOJ plans to carry on the registration and validation of property claims, a process initiated by the project. To date over 53,000 property claims have been registered through the Ita Nia Rai process. While the Ministry of Justice's desire to take over the project is encouraging, the transfer of responsibility also presents many challenges. The Ministry lacks experience managing this type of function and does not have the needed structures in place for taking on such an activity. An extension to the SPRTL project will keep the project's management team in place so that the transition of responsibility can take place in a controlled manner, with the USAID funded management team available to serve as advisors, guiding a smooth handover while building the needed structures within the MOJ. Therefore, the purpose of this modification is to extend the period of performance of the task order for an additional six months, thru September 30, 2012 and allow the contractor to continue to provide advisory services to the MOJ in order to assist with the transition of project activities and protect the US Government's long-term land sector investment. This extension will result to an increase of the current ceiling price by $500,000 from $9,875,734.00 to $10,375,734.00.
