Contracting Activity: Department of Veterans Affairs, PCO-East Contracting Division, St. Louis, Missouri Requiring Agency: Department of Veterans Affairs, Employee Education System, Cleveland EERC. Purchase Request Number: 777-12-2-8092-0039 TRACE Code: 12.AR.MEMBERSHIPS.A 2. Nature and/or Description of the Action Being Processed: VA EES Executive Board requests approval under other than full and open competition for the annual renewal of membership in the American Society for Training and Development (ASTD) Benchmarking Forum. Period of membership performance is Feb 1, 2012 - Oct 31, 2012. 3. Description of Supplies/Services Required to Meet the Agency's Needs: This contract is to purchase membership in the ASTD Forum for the VA EES through October, 2012. VA EES has been a subscribing member of the ASTD forum for the past seven (7) years, and the VA DCLOPO has advocated for continued support. The ASTD Forum is the only Benchmarking organization with a sole focus on Training and Development. It is a non-profit organization that consists of more than 40 member organizations designed to share best practices in Education, Training and Development. Membership in the ASTD Benchmarking Forum continues to benefit the mission of the VA EES. The cost of this membership for the designated time frame for 2012 is $7,000.00. This is an annual membership contract. Statutory Authority Permitting Other than Full and Open Competition: ( ? ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a. Only One Responsible Source (FAR 6.302-1) - American Society for Training and Development (ASTD) is the only organization capable of providing the services for Membership in the ASTD Benchmarking Forum. ASTD owns the sole data rights, and the member organizations that are part of ASTD sign a formal agreement not to share proprietary information outside of the member organizations. Performed Google search and did not find any other companies that were able to provide a membership to the Benchmarking Forum. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: At the present time, there is no other entity that owns or could obtain access to this content provided by the American Society for Training and Development (ASTD) 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Reference FAR 15.404-1(b)(2)(iv), the price has been determined fair and reasonable since comparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangements has been used. The current Market price for the membership is $9500.00, however, the government is receiving it for $7000.00. 8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted searching GSA and Google and this is the only vendor offering required unlimited access to peers within the Education, Training and Development business environment. 9. Any Other Facts Supporting the Use of Other than Full and Open Competition At this time, there is only one provider of this service. 10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section 6 above. 11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: This justification for other than full and open competition is for services that are not currently available from another qualified source.
