Description
The Department of Veterans Affairs, VA Boston Healthcare System, had an urgent requirement for upgrades to an already purchased Skytron Skyvision system. Construction is ongoing and upgrades were necessary to allow the system to function in the designed space. This acquisition was conducted under the authority of FAR 6.302-2, Unusual and Compelling Urgency. The Justification and Approval is attached. Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 01, 523 - Boston Healthcare System Purchase Request Transaction Number: 523-12-2-7821-0038 2.Nature and/or Description of the Action Being Processed: This for the procurement of the add-ons for the Skytron Skyvision system from the vendor REOS Medical. This is will be a new contract provided to the vendor. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The commodities being procured are add-ons for the Skytron Skyvision system which include a 200FT cabling kit and all required components, keyboards for the Skytron Booms (already purchased) and a touch panel controller for the Skytron Skyvision system. These are needed to meet the needs for the booms being installed in the Gastrointestinal Clinic, currently under construction. The estimated cost for each unit varies, however the total estimate value of the acquisition is $55,506.38, including all fees. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Skytron products being purchased through REOS Medical (approved Skytron Distributor) can only be purchased through them because the Skytron equipment that the add-ons are going to be used has already been procured and therefore only the original equipment manufacturer (OEM) can provide the required add-ons for the Skytron system. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The add-on products being procured are for the Skytron system that has been purchased already. Therefore no efforts were made to solicit alternate sources, since the main system is already purchased. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Pricing is fair and reasonable from REOS Medical based on a 6.4% discount & credit offered to the Government over pricing offered to their other commercial customers. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No market research was conducted due to the fact the main components of the add-on equipment being procured is already been purchased from the OEM's distributor, and only the OEM's add-ons will work with the Skytron system already purchased. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: All facts provided in previous sections. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: The only source expressing interest in the acquisition is REOS Medical, a distributor of Skytron. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: At this time no additional actions are planned because the equipment is add-ons to the main equipment already procured. For future requirements, market research will be conducted to see if other companies in the industry have developed like products.
