Description
A determinaiton not to compete this proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) 13.106-1(b)(1), Soliciting from a Single Source. For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract deem only one source reasonably available. "NCS Pearson, Inc. is the sole source for SCL 90 and MMPI 2RF and the Q-Local Scoring Software". The Q-Local software is used to run the 16PF, SCL 90 and MMPI 2RF administrations. The FBI will purchase the 16PF Basic Score Q Administration, MMPI-RF and SCL-90 from NCS Pearson, Inc. "Although the 16PF is available from other distributors their administrations would not be compatible with the current Q-Local software system at the FBI". Re-purchase of the 16PF would result in the "substantial duplication of cost to the government not expected to be recovered through competition". (FAR 6.302-1 (ii)(A)). This procurement is being conducted under Simplified Acquisition Procedures, only one source is reasonably available. The government intends to use FAR Part 12 to purchase the above listed items. The North American Industry Classification System (NAICS) code for these item is 511210 Software Publishers. This notice of intent is not a formal solicitation or request for competitive proposals. No solicitation document is available and telephone requests will not be accepted. No award will be made on the basis of quotations or offers received in response to this notice. Interested parties may submit their interest and capabilities no later than Tuesday, March 6, 2012 9:00 a.m. EST. E-mail statements will be accepted but senders are responsible for ensuring the complete transmission and timely receipt. All inquiries shall be sent via e-mail to: deborah.chin@ic.fbi.gov. Any party responding to this notice shall send clear, factual documentation demonstrating their capabilities to meet and resell these items to the government. This documentation shall include a letter from NCS Pearson, Inc. confirming that SCL90, MMPI 2RF and 16PF Basic Score Q Administration is available to them as authorized resellers. The government contemplates an award of a contract with one base year and 3 option years. The intent of this synopsis is for informational purposes only. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement for future requirements. A determination by the government not to compete this action is based on this notice and solely within the discretion of the government.
