Description
The Department of Commerce, National Institute of Standards and Technology (NIST), Center for Nanoscale Science and Technology (CNST) intends to negotiate a Firm Fixed Price Contract, on a sole source basis, under Authority FAR 13.103-1(b)(1), with Bruker Biospin Corporation of Billerica, MA for the purchase of an X- Band Dual Mode Resonator, Optical Window and X-Band Split Ring Resonator, Optical Window, under other than full and open competition. The NIST Center for Nanoscale Science and Technology (CNST) supports the U.S. nanotechnology enterprise from discovery to production by providing industry, academia, NIST, and other government agencies with access to world-class nanoscale measurement and fabrication methods and technology. The CNST is the only national nanocenter with a focus on commerce. The Bruker Biospin X-Band Dual Mode Resonator, Optical Window, and X-Band Split Ring Resonator, Optical Window components are required as part of a Bruker Biospin Pulsed EPR Spectrometer that was recently procured by NIST. The X- Band Split Ring Resonator, Optical Window, and X-Band Dual Mode Resonator, Optical Window are critical components to NIST's CNST mission, the Resonators must be 100 percent compatible with the Pulsed EPR Spectrometer. The proprietary technology and patent protected instruments of Bruker Biospin are the only instruments capable of the compatibility requirements and ensure a fully operational system. No other manufacturers or distributors are authorized to provide the Bruker instruments, in addition, no other manufacturers products are compatible. If other manufacturer instruments were utilized, the system would not function properly, in addition, the Bruker Biospin warranty of the Pulsed EPR Spectrometer would be voided. The North American Industry Classification System (NAICS) code for this acquisition 334156, with a size standard of 500 employees. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by Thursday March 22, 2012 will be considered by the Government.
