Description

This will meet the requierment to for posting LSJ and is not a request for qoutes. This Justification based upon the authority of the Multiple Award Schedule program is derived from Title III of the Administrative Services Act of 1949 (41 U.S.C. 251, et seq.) and Title 40 U.S.C. 501, Services for Executive Agencies, and implemented in Federal Acquisition Regulation 8.405-6. In accordance with PGI 216.505-70 (Orders under multiple award contracts), (1) Exception to the fair opportunity process at FAR 16.505(b) (2), the contract office has made a determination that this action applies under FAR l6.505 (b)(2)(i)(B) on the basis only IBM (brand name) maintenance will meet the unique or highly specialized requirements of this action because the requirement is for maintenance of HW and SW that is proprietary to IBM.
