- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY: 23d Contracting Squadron 4380B Alabama Road Moody AFB, GA II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED: This action will be awarded as a firm-fixed-price federal supply schedule task order to acquire technical support services for the Building Automation System (BAS) and peripheral components currently in operation at the 23rd Medical Group, (23 MDG). III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS: The 23rd MDG requires medical facilities environmental control building automation services which monitors and controls pharmaceuticals and vaccine refrigerated storage, facility heating, ventilation, air conditioning digital controls, and automated access control. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: 10 USC 2304(c) (1), as implemented by FAR 6.302-1 (FAR 6.303-2(b)(4)). The justification for restricting competition as a sole source requirement is in accordance with Federal Acquisition Regulation FAR 6.302-1 (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements). V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY): Siemens Building Technology is the only provider in possession of the necessary software and digital control components to ensure compatibility with the BAS already installed at Moody AFB. To replace existing propriety software and its corresponding equipment would result in a substantial duplication of cost to the government that would not be expected to be recovered through competition. In addition, Siemens Building Technologies has proprietary software installed in the BAS. Software updates that will be required are only available through Siemens and any alteration to the system by a non-authorized party will void all warranties. Therefore, this acquisition is for continued performance of a highly specialized service. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE: Sources sought notice FA4830-12-Q-Z004 was posted on FBO November 8, 2011. The notice was posted to determine if any other source had capabilities to perform the requirement. The notice yielded ten (10) interested vendors. After contacting two (2) of the vendors it was determined that, although their capabilities could maintain the current Siemens BAS, they were not able to install new Siemens BAS software. Siemens confirmed that new BAS software is proprietary to Siemens and not available to any other vendor and so none of the other interested vendors would be able to support our requirements. Awarding to any other vendor would result in substantial cost duplication, and void existing warranties currently in place at 23 MDG for the BAS. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: The purposed annual cost for the afore mentioned HVAC services was quoted by Siemens Industry, Inc. Price was deemed fair and reasonable at time of award by GSA contract number GS-07F-8728D. Siemens GSA prices are best discount off list price based on Siemens standard commercial discount practices. BPA FA4830-08-A-0020 provided 23 MDG HVAC maintenance at a comparable cost to the new Siemens quote. Similar Siemens HVAC maintenance at Valdosta State University and Shriever AFB's is also in a comparable range to the 23 MDG quote. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED: As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by a sources sought notice of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. According to GSA Advantage, 56 vendors are listed on under category 811 005 (Refrigeration, Heating, Ventilation and Air Condition HVAC Maintenance). All 56 could arguably provide some facet of the services required; however, all parts and software currently installed and in use are proprietary to Siemens Building Technologies and not available to those vendors. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: The installation of a new HVAC control system would cost the Government in excess of one million dollars and would be detrimental to the MDG mission. Any alteration to the system by a non-authorized party will void all warranties, whether expressed or implied. X. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED: As long as the software required to run the equipment is proprietary to Siemens we will continue to be in a sole source situation. We will continue to post special notices to determine if there are any changes in the commercial market and consider any responses. XII. CONTRACTING OFFICER'S CERTIFICATION: "I certify to the best of my knowledge and belief that the information contained in this justification is accurate and complete." The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12)). XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION: As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(b)).
