- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. IDENTIFICATION OF THE AGENCY AND CONTRACTING AGENCY: Department of Labor OASAM/OPS 200 Constitution Ave. NW S-4306 Washington, DC 20210 2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED: This justification for exception to the fair opportunity process authorizes and approves award of a task order to Carlson Wagonlit Government Travel (CWGT) 4300 Wilson Blvd., Ste. 500, Arlington, VA 22203, to provide and maintain travel services for the U.S. Department of Labor (DOL), Office of the Chief Financial Officer (OCFO). 3. 3. A DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEED: The services of the selected vendor are required to provide and maintain travel services for DOL. The Department is currently receiving a full suite of travel services from CWGT under subject task order. This effort includes the maintenance and provision of all travel services for DOL. 4. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: The statutory authority permitting acquisition of this requirement by exception to the fair opportunity process is FAR 16.505(b)(2)(ii)(C) - Only one awardee is capable of providing the supplies of services required at the level of quality required because the supplies or services ordered are unique or highly specialized and no other supplies or services will satisfy the agency's requirements. The order must be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, where all awardees were given a fair opportunity to be considered for the original order. 5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUSITION REQUIRES USE OF THE AUTHORITY CITED: This effort is a continuation of the efforts undertaken by CWGT under the current task order. Under that task order an interface has been developed for CWGT's E2 system to connect with the U.S. Department of Labor's New Core Financial Management System (NCFMS). This interface processes all travel vouchers and other transactions, allowing vendors to be paid and Federal Staff to receive reimbursements for travel expenses. The NCFMS interface also handles the repayment of the thousands of travel purchase card transactions made on behalf of the Federal Government in the performance of its duty. A task order/contract award to a vendor other than CWGT would require the utilization of another system besides E2 to meet the Department's travel needs as E2 is a proprietary system wholly owned and controlled by CWGT. This would subsequently require the development and deployment of a new interface to connect NCFMS to the new/alternative travel system. Global Computer Enterprises, Inc. (GCE) the current provider of the NCFMS system estimates the cost of new interface development and deployment at $1.6 million with an estimated timeframe of 4 months from project inception to completion. GCE is the only contractor that can perform the required task in a reasonable timeframe within the funds provided and the confines of the current NCFMS contract. The earliest date at which work could tentatively begin on said interface within the confines of the current project schedule would be 11/27/2012. When considered cumulatively the current NCFMS schedule and interface project estimated timeframes translate into an estimated interface deployment of March or April 2013. The entire ETS 1 contract is currently slated to expire in November of 2013. After this date the new contract services provider for ETS 2 will assume responsibility for the Department's travel services. The Government 6. A DESCRIPTION OF EFFORTS TO OBTAIN COMPETITION TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE, INCLUDING WHETER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES: The Department of Labor is currently using a task order under GSA contract number GS33FN001 GSAETS1. The aforementioned task order was competed amongst all awardees and award made to CWGT. These vendors include CWGT, Northrop Grumman, and EDS. DOL has reached out to all three contractors through its technical staff and under the current conditions only CWGT, the current contractor, has expressed any interest in the proposed task order. Any other contractor would be subject to the same time limitations already noted in section 5 due to the interface issues surrounding the operation of the travel system. 7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNEMENT WILL BE FAIR AND REASONABLE: The rates on the current CWGT GSA contract for ETS GS33FN0017 have already been competed by GSA and are subsequently determined to be fair and reasonable. 8. A DESCRIPTION OF MARKET CONDUCTED (PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: Our market research did not yield any other vendors currently capable of performing this effort within the required timeframe. As stated in section six (6) there are only 3 entities that are offering travel services under the current ETS 1 contract. All three of these entities were contacted by technical staff and only CWGT expressed interest in the proposed action. 9. ANY OTHER SUPPORTING FACTS SUPPOSRTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION SUCH AS: Duplicative costs to the government to replace the current NCFMS/E2 interface would exceed $3.1M. 10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION: There are no interested sources that can meet the Government's requirement at this time. 11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED: The ETS 1 contract expires in November 2013. DOL will conduct a full competition prior to this for a new contract.
