- On March 13, 2012, the Department of Energy entered into a barter contract with United States Enrichment Corporation (USEC). In accordance with Federal Acquisition Regulation (FAR) 6.305, this notice provides the previously approved justification for other than full and open competition. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Agency and Contracting Activity: The U.S. Department of Energy (DOE) intends to contract through other than full and open competition with the United States Enrichment Corporation (USEC). This document provides the justification and approval for the use of non-competitive procedures pursuant to 41 U.S.C. ? 3304(a)(1) and in accordance with Federal Acquisition Regulation (FAR) ? 6.302-1. 2. Nature and/or Description of the Action Being Approved: This is a sole-source acquisition of separative work units (SWU), which is the measure of enrichment services, to enrich natural uranium to low-enriched uranium (LEU) to be used for DOE?s tritium program. 3. Goods to be Acquired: The action is to acquire SWU in exchange for DOE?s accepting title to, and eventual disposal responsibility for, a quantity of depleted uranium tails (DUF6). DOE will also provide feedstock in the form of Russian-origin natural uranium from its inventory; USEC will provide an amount of U.S-origin LEU equivalent to the amount of LEU that would result from the application of the SWU to the Russian-origin natural uranium in the enrichment process. DOE needs LEU unencumbered by peaceful use assurances to produce tritium that can be used for defense purposes, e.g., for use in nuclear weapons. Generally speaking, uranium and enrichment technology that have a foreign origin are encumbered with peaceful use assurances. These assurances restrict the use of LEU derived from the foreign uranium and/or the foreign technology exclusively for peaceful purposes. At this time, USEC is the only provider of SWU based on U.S.-origin technology. 4. Identification of the Statutory Authority Permitting Other Than Full and Open Competition: The applicable authority is 41 U.S.C. ? 3304(a)(1), as implemented by FAR 6.302-1, ?Only one responsible source and no other supplies or services will satisfy agency requirements.? 5. Demonstration of Unique Contractor Qualifications: USEC is uniquely qualified to provide DOE with these enrichment goods in the form of SWU because it is the only provider of SWU that uses U.S.-origin technology. For national security and DOE programmatic purposes, DOE needs LEU that is unencumbered by peaceful use assurances and thus can be used for defense purposes. At this time, USEC is the only company that can provide enrichment services that are free of peaceful use assurances. 6. Efforts to Solicit Offers From As Many Sources As Practicable: USEC is the only source that can currently provide the services, thus no other sources were solicited. 7. Determination of Fair and Reasonably Anticipated Cost: The anticipated value of the proposed acquisition is approximately $45,000,000. A price analysis will be performed by the Contracting Officer to ensure a fair and reasonable price. 8. Description of Market Research Conducted: No market research was conducted as the potential sources for SWU are well known to DOE. USEC is the only provider of SWU that is produced using domestic-origin technology. On January 20, 2012, a Notice of Intent was published on the Federal Business Opportunities (FedBizOpps) website to provide information regarding DOE?s intention to award a sole source contract to USEC. The notice provided vendors the opportunity to submit questions and capability statements to DOE. The deadline for submission of capability statements of February 6, 2012 at 2:00 pm local prevailing time passed without receiving any capability statements from interested vendors. During the process, one vendor expressed interest in the notice on the FedBizOpps website and contacted the Contract Specialist with questions. The Contract Specialist provided responses to the vendor and resolved this matter. No further interest in this notice was received. 9. Other Facts Supporting the Use of Other Than Full and Open Competition: See item 3. 10. List of Interested Sources: None. 11. Actions to Remove or Overcome Barriers to Competition: There are no barriers to competition that the DOE may remove. USEC as the only operator of U.S. origin enrichment technology is a function of the marketplace.
