- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation A12PS00662 is being issued as an RFQ. The solicitation document and incorporated provisions and clauses are those that are in effect through Federal Acquisition Circular (FAC) 05-56. Description of the requirements: Line Item #1: Propane for cooking, heating, etc. ? Quantity: approx. 42,180 gallons Other information: Propane for BIE facilities located in Tuba City, AZ. The agency will require approx 42,180 gallons of propane during the period of performance. Delivery will be made on an ?as needed? basis from 04/01/2012 to 03/31/2013. Orders will be requested by the business manager when a tank reading indicates a delivery is needed. Deliveries shall be made within 7 calendar days and shall be made between the hours of 8 A.M. and 5 P.M. weekdays. Delivery tickets shall be signed by both the vendor and the authorized personnel accepting a delivery at the site. The contract will be a firm fixed price and the vendor shall not deliver any more propane than is listed on this contract or any modification (if applicable). If the vendor does, then the vendor proceeds at own risk and will not be compensated for additional deliveries. Scope: Beyond the stated amounts this purchase is subject to modification to add additional gallons (20,000 gallons maximum) beyond the stated limit in the line item (for this POP) and shall be by bilateral agreement. Market pricing will be utilized for any gallons added and a modification will only occur if it?s in the best interest of the government. Any modification(s) will be subject to all applicable provisions, clauses, and (if not otherwise stated) any other laws that are applicable under US jurisdiction. The modification will be subject to all appropriation laws and availability of funds. Location/Place of performance (POP): Tuba City Boarding School: Tank farm one ? 6 tanks (2,000 gallons each), Farm tanks two and five ? 4 tanks (1,000 gallons each), tank farm three ? 2 tanks (one thousand gallon each), tank farm four ? 1 tank ( 5,000 gallons). Other terms and conditions: N/A Date(s) and place(s) of delivery and acceptance and FOB point: As needed, FOB destination, location stated above. The following provisions apply to this solicitation: 52.212-1, Instructions to Offerors ? Commercial;; 52.212-3, Offeror Representations and Certifications -- Commercial Items. The following contract clauses will apply to this solicitation and the contract that follows: 52.212-4, Contract Terms and Conditions -- Commercial Items; 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items.The following provisions or clauses also apply to this combined synopsis/solicitation: 52.232-19 -- Availability of Funds for the Next Fiscal Year; 52.232-18 -- Availability of Funds;. If N/A is indicated then no additional provisions or clauses are applicable, unless otherwise prescribed by the FAR, a regulation, or statute.Conflict of Interest (COI): All quoters must disclose any conflict of interest with any known person(s) working for the program office (requesting agency) or contracting office that is connected with this procurement, has authority to influence contracting decision, or has any appearance of a potential COI.
