- PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Interested parties are responsible for monitoring this site to ensure they have the most up to date information about this acquisition. The Request for Quote number is RFQE014724-A and is unrestricted. The North American Classification System Code is 334220; the size standard is 750 employees. This RFQ incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2005-56. This requirement will be awarded on an all or none basis as a commercial item, fixed price purchase order under the procedures at FAR Parts 12 and 13. This RFQ is for Brand Name only in accordance with 6.302-1 (c). The Federal Bureau of Investigation (FBI) has a requirement for a one time fixed price purchase of the following products manufactured by Motorola: Item : Motorola Astro Tac 3000 Comparators Quantity : 10 Motorola no longer manufactures this generation of equipment; however, it is still employed by the FBI and replacements are required. The FBI's existing land mobile radio (LMR) system was built by Motorola and consists of Motorola Quantar repeaters and AstroTAC receivers operating in P25 mode. The Motorola Astro TAC 3000 comparator is the only voting comparator which is compatible with the aforementioned LMR equipment for system expansion. The Motorola system also employs a unique encoding design and feature sets which are proprietary to Motorola, as Motorola is the original equipment manufacturer and copyright owner, and are representative of "Intellectual Property" and covered under multiple copyright restrictions. Consequently, only Motorola equipment can replace the required comparators. Delivery of items shall be within 30 days After Receipt of Order (ARO). Destination: FOB: FBI Engineering Research Facility, Quantico, VA 22135. The contractor shall extend to the Government full coverage of any standard commercial warranty normally offered in a similar commercial sale. Acceptance of the warranty does not waive the Governments rights with regard to the other terms and conditions of this contract. In the event of a conflict of the terms and conditions of the Governments contract, the contract shall take precedence over the warranty. The warranty period shall begin upon final acceptance of all items provided to the government by the Contractor. The following clauses and provisions are incorporated by reference and apply to this acquisition: FAR 52.212-1, Instructions to Offerors-Commercial Items (February 2012); 52.212-2 Evaluation-Commercial Items (January 1999); 52.212-3 Offeror Representations and Certifications - Commercial Items (February 2012) (Please note: all offerors and prospective contractors must be registered with the Online Representations and Certifications Applications (ORCA) website at http.//orca.bpn.gov or must provide a completed copy of 52.212-3 with their quotation); 52.212-4 Contract Terms and Conditions - Commercial Items (February 2012); 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (March 2012), applicable clauses under 52.212-5 include: (a); (b); (1), (4); (6); (8); (12); (26); (28); (29); (31); (38); (48); (d); (e). Addendum to 52.212-1, Modify (b) Submission of Offers to read as follows: Quotes shall be submitted by email to Mrs. Margaret D. Einspahr, Contracting Officer, margaret.einspahr@ic.fbi.gov, no later than Friday, March 23, 2012, 10:00 am EST. Add the following to 52.212-2 Evaluation (a): The following factors shall be used to evaluate offers: Low Price Technically Acceptable. Quotes shall be clearly marked RFQE014724-A. Offerors are hereby notified that if their quotes are not received by the date, time and location specified in this announcement, it will not be considered. All responsible sources may submit a quotation which shall be considered by the agency. The awardee shall be registered in the Central Contractor Registration databases as required under FAR 52.204-7 (Feb 2012) prior to receiving an award.
