- Notice Type: Combined Synopsis/Solicitation P12PS22425Title: Supply and Deliver Off-Road Diesel #2 with 2% bio to Alpine Visitor Center (1) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; price quotes are being requested and a written solicitation will not be issued. (2) This solicitation is issued as a Request for Quote (RFQ). (3) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-57. (4) This solicitation is being issued as open market, small business set aside. The associated NAICS code is 324110. (5) This combined synopsis/solicitation is for the following commercial item: Supply and deliver off-road, diesel #2 fuel for purposes of running the fixed generator at the Alpine Visitor Center, Rocky Mountain National Park. (6) Description of requirement is as follows: GENERAL WORK DESCRIPTION: Fuel Type98 percent #2 certified off road diesel fuel with 2 percent certified 100 percent virgin rape seed bio fuel splash mixed in truck prior to each delivery. Provide documentation of purity and grade of fuel. GeneralThis fuel will be used to run fixed generators at the Alpine Visitor Center in Rocky Mountain National Park for the 2012 season June through September. The tank is a single, 4000 gallon, underground, double wall, FRP tank. Fill ports are located at finished road grade directly over tank. The hauler/supplier must provide a delivery ticket from a calibrated dispenser on the truck for each fuel drop. The hauler/supplier must also record a stick measurement in inches before and after each fuel drop on each ticket. The tickets shall be dropped off at the Building Operations office. RegulatoryThe hauler/supplier assumes all responsibility as owner of the product until it is delivered into the NPS tank and is solely responsible for any spill during the loading, transport and delivery of the product, this includes but is not limited to immediate notification of the NPS as well as all required regulatory authorities should a spill occur. The hauler/supplier assumes total responsibility for all cleanup costs, fines or damages that are a result of delivery of the fuel. The hauler/supplier must report any vehicle accident associated with the transportation of the product to the NPS and all applicable authorities. The hauler/supplier is responsible for any and all federal and state licensing, permits and or placards that may be required to accomplish the SOW. Operators of vehicles shall be properly licensed for the vehicle. SafetyThe hauler/supplier is responsible for the overall safety of this job. It is the hauler/supplier's responsibility to know and comply with all applicable OSHA regulations, as well as accepted industry safety standards, for this project. The NPS is not exempt from OSHA requirements. The hauler/supplier will provide proper safety equipment and training for workers on site, and ensure that employees are physically capable to perform their assigned duties in a safe manner.1.Local emergency and medical services are 911 or The Estes Park Medical Center, 555 Prospect Ave #A, Estes Park, CO 80517, Phone (970) 586-2317. Cell phone service is very poor inside the park.2. Do not allow employees to work if their ability or alertness is impaired because of drugs, fatigue, illness, intoxication, or other conditions that may expose themselves or others to injury. 3.Reportable Accidents: A reportable accident is defined as death, occupational disease, traumatic injury to employees or the public, property damage by accident in excess of $100, and fires. Notify the NPS immediately in the event of a reportable accident. Within 7 days of a reportable accident, fill out and forward to the NPS a written notice of the accident. (7) Delivery Schedule and Location of Delivery Delivery is expected to occur within the week listed in the schedule. Any deviation from this schedule must be approved in advance by the NPS. The product will be delivered at scheduled intervals in 900 gallon loads and shall be adjusted in the case a full load cannot be delivered into the tank because it is too full. Payment will be made for actual gallons delivered. Delivery time frame is Monday through Friday from 6 AM to 6 PM unless approved in advance by the NPS. Week of 6-18Week of 7-9Week of 7-30Week of 8-13Week of 8-27Week of 9-10Week of 9-17Week of 9-23 Location and Environmental ConditionsThe Alpine Visitor Center is located 28 miles west of Estes Park, Colorado on U.S. Hwy 34. This is the preferred access route. This road is narrow, steep, winding and above 11,500 feet above sea level. The road when open is frequently heavily congested with poor driving conditions including rain, snow, ice, sleet, hail, fog and other hazardous road conditions. Expect delays up to.5 hour each way due to road construction and other traffic delays. The road may be closed due to unsafe road conditions so the hauler/supplier must call ahead for current road conditions. The NPS is not responsible for any charges if the road upon arrival is closed and the hauler/supplier needs to reschedule delivery. The NPS will provide snow removal over the filling port for the first drop only; the hauler/supplier shall remove snow over filling port for the rest of the season. (8) Period of performance: June 1 - September 30, 2012. Deliveries to be made within this period of performance as listed above. (9) Provision FAR 52.212.-1, Instructions to Offerors - Commercial Items (Feb 2012) applies to this acquisition. Please include DUNS numbers with quote. Quotes shall be mailed to Kris O'Neil, Contract Specialist, Rocky Mountain National Park, 1000 Hwy 36, Estes Park, CO 80517; or e-mailed to: Kris_ONeil@nps.gov. Quotes must be received by 4 pm MST on April 27, 2012, to be considered. FAR clauses may be found at the following website: www.acquisition.gov/far. Quotes shall be submitted as a price/gallon, with all costs inclusive in the firm fixed price. In case of error in extension of prices, the unit price governs. In case of error in summation, the total of the corrected amounts govern. 8 scheduled deliveries of 900 gallons Price/gallon_______________ x 7,200 gallons = __________________ Payment will be made for actual gallons delivered. Prospective quoters shall identify the manufacturer of the product and a specification sheet to document product meets 2% bio requirement. (10) FAR 52.212-2, Evaluation - Commercial items (Jan 1999) does not apply to this acquisition. Award will be made to the lowest quote received from a responsible small business that meets the specifications included in this announcement. (11) Provision FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (Mar 2012) applies to this acquisition. All offerors shall complete and submit the provision to the Contracting Officer with their offer if they do not have an active listing in ORCA (Online Representations and Certifications.) (12) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial items (Feb 2012) applies to this acquisition. (13) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders - Commercial Items (Mar 2012) applies to this acquisition. Additional Clauses hereby incorporated: DIAPR 2010-18 (May 2010), Authorities and Delegations Notice to Contractors (a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work. (b) The Contracting officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment. (c) The COR is not authorized to perform, formally or informally, any of the following actions: (1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;(2) Waive or agree to modification of the delivery schedule;(3) Make any final decision on any contract matter subject to the Disputes Clause;(4) Terminate, for any reason, the Contractor's right to proceed;(5) Obligate in any way, the payment of money by the Government. (d) The Contractor shall comply with the written or oral direction of the Contracting officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause. (e) The Contracting officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provision of the Disputes clause of this contract. (f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR. (g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk. (14) The Government intends to award a firm fixed-price order resulting from this solicitation.
