Description
NATIONAL LABOR RELATIONS BOARD JUSTIFICATION FOR OTHER AND FULL AND OPEN COMPETITION (JOFOC) 1. Identification of Agency and the contracting activity National Labor Relation Board (NLRB), Office ofthe ChiefInformation Officer (OCIO), is to award a contract to EMC Document Sciences (DocSci) for Professional Support Services. 2. Nature and/or description of action being approved It is recommended that the National Labor Relations Board use other than full and open competition for the acquisition of the supplies or services identified below. 3. Description of supplies or services The scope of work for this contract is to provide installation support for the EMC DocSci xPression software suite. 4. Statutory Authority 41 U.S.C. 253(c)(2). FAR Subpart 6.302-1 Only one responsible source and no other supplies or services will satisfy agencv reauirements. (a) Authority. (1) Citations: 10 U.S.c. 2304(c)(l) or 41 U.S.c. 253(c)(l), and is a follow-on to the purchase of xPression software involving setup. 5. Contractor's Unique Qualifications or Rationale for the Nature of the Acquisition Requiring Use of Authority Cited. The EMC DocSci xPression software suite is supported only by EMC DocSci. This is a follow-on contract to install the purchased software solution. 6. Description of the Efforts Made to Ensure That Offers are solicited from as Many Potential Sources As Is Practicable. The proposed contract action is to award EMC DocSci a sole-source contract with a period of performance for 40 hours from time of award. A quote will be requested from EMC DocSci. 7. Determination of Fair and Reasonable Pricing Pricing for the professional support services and travel is approximately $11,500 for the period of performance and is determined to be fair and reasonable based on past experience and GSA pricing schedules. 8. Market Research An EMC representative verified that they are uniquely qulified to provide professional support services for xPression installation support. 9. Supporting Facts EMC DocSci products are used to support the Agency's enterprise case management system, Next Generation Case Management (NxGen). The xPression software suite is currently used in production to support template generation of approximately 120 document types and is a critical component of the system. 10. Sources Expressing Interest in this Requirement No other sources contacted have expressed an interest in this requirement. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required None
