- The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the NIST Center for Nanoscience and Technology (CNST), intends to negotiate with Coventor, Inc.; Cary, NC, on a sole source basis under the authority of FAR Subpart 13.106-1 (b), Soliciting from a Single Source, to purchase/renew software on existing CoventorWare software licenses for 1 year. NIST has been using CoventorWare Analyzer for several years and has generated a significant amount of modeling data with it. This software is used for finite element numerical analysis of complex MEMS and NEMS devices in 3 dimensions. Market research has shown that no other software package is compatible with this data. By not renewing the license and purchasing different software, NIST would lose access to results obtained over the last several years. Additionally, NIST collaborates with a group at Argonne National Labs, which also uses this software. NIST would not be able to share models and results with them if it used a different software package that is not compatible with CoventorWare. NIST intends to procure annual maintenance for CoventorWare Analyzer, to include all upgrades, technical support, and electronic documentation. Recent market research conducted by NIST shows that Coventor, Inc. is the only authorized provider of this software in the United States. Coventor, Inc. has the sole proprietary and patent rights to this software. The NAICS Code is 511210 with a Size Standard of $25.0 million. NIST anticipates negotiating and awarding a firm-fixed-price purchase order to Coventor, Inc. for this requirement. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition. Any questions regarding this notice must be submitted in writing via email to Eric Bubar at eric.bubar@nist.gov. All responses to this notice of intent must be submitted so that they are received at eric.bubar@nist.gov no later than May 7, 2012 at 5:00 pm.
