- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Agency: The responsible contracting agency is the U.S. Army Corps of Engineers, Savannah District, and P.O. Box 889, Savannah, Georgia 31401-3640. 2. Description of Action: This request is for approval of a sole source procurement for sonic drilling to install monitoring wells for the Savannah Harbor Expansion Project. Award of this contract to Miller Drilling Company, Inc. 107 Helton Drive, Lawrenceburg TN 38464, will provide sonic drilling services and materials to install saltwater intrusion monitoring wells for pre- and post-project groundwater data collection In order to comply with the Federal Water Pollution Control Act and Georgia Department of Natural Resources regulations. 32 CFR 652 and AR 200-1 both mandate that documentation of these evaluations be prepared and records kept. The estimated price is approximately $108,005.00. 3. Description of Services: The contractor shall provide all labor, management, supervision, engineering, tools, equipment, materials, supplies, services, and transportation for the Savannah monitoring well Installations in accordance with the attached Scope of Work. 4. Authority Cited: 10 U.S.C. 2304(d) (1) (B) and FAR 6.302-1(a) (2) (iii). Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Reason for Authority Cited: Previous contract W912HN-P-0123 was issued to Miller Drilling Company (MDC) for this work. One of five required monitoring wells was 90-percent completed under this contract. The new contract will be a continuation of the original work. MDC has not de-mobilized from the site and will not charge for de-mob other than at the completion of all work, which will save the Government additional costs. In the original solicitation for the previous contract, MDC was the only bidder that could do the work for a fair and reasonable cost to the Government. If this work is awarded to another Contractor, they will not likely take responsibility for completion of the partially installed well. 6. Awarding a new follow-on contract to MDC, whose equipment is already on site and has site experience, will result in substantial cost savings to the government, continuity of services, and timely acquisition of data critical to the start-up schedule of the Savannah Harbor Expansion Project. The time involved to wait for a new contract to be executed would adversely affect the overall project schedule. 7. Actions to Increase Competition: It is incumbent upon the Government to ensure project delays and additional costs do not occur. There is no other source equally qualified to provide the necessary requirements under the circumstances. The requirement of these services cannot reasonably be met by another source because of the need to minimize cost and impact to project schedule. 8. Other Factors: Follow-on Contracts: This is a follow-on contract with additional requirements based on finding from the initial contract. In accordance with FAR 6.301-1(a)(2)(iii)(A), "For DOD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition or (B) Unacceptable delays in fulfilling the agency's requirements." 9.
