LIMITED SOURCES JUSTIFICATION ORDER >$3,000 FAR PART 8.405-6 2237 Transaction # or Vista Equipment Transaction #: VA777-12-2-1022-0226 This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 - Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: Provide original manufacturer's name for material or contractor's name for service. (If a sole source manufacturer distributes via dealers, ALSO provide dealer information.) (1) AGENCY AND CONTRACTING ACTIVITY:Department of Veterans Affairs SAO/PCO East St. Louis______________ 11152South Towne Square_____________ St. Louis, MO 63123 VISN: (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: HP VistA Imaging (Class III Medical Device) training is a 4.5 day class with lab to be held at the HP Training Center in Herndon, VA.Includes lodging, breakfast and lunches, and ground transportation to and from meeting site. This classes offered to the VA approximately 2 times per year. The EES contracts for the class and attendees for this Session come from the VHA and the Indian Health Service. There are 14 students for this class session. Class is to be held April 16 -20, 2012. (3)(a)A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEED: This task-oriented course developed by HP specifically to meet the needs of the VA, prepares the student To configure, process flow and basic troubleshooting and support for the HP AlphaServer ES40, ES45, ES47, ES80 systems in the Open VMA cluster environment running the VistA application - which includes other Federal Health Services, including Indian Health Service. Course topics include: VistA-Open VMS hardware Components, Hardware and software maintenance; managing and maintaining storage; managing the VMS Cluster environment; troubleshooting the system, storage or VMAcluster problems. This training is provided to insure the safe administration and maintenance of the VistA Imaging System. (b)ESTIMATED DOLLAR VALUE: $34,350.00 (c)REQUIRED DELIVERY DATE: April 16, 2012 (4)IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. (CHECK ALL THAT APPLY AND COMPLETE) 1Specific characteristics of the material or service that limit the availability to a sole source (unique features, function of the item, etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources. HP has worked with the VA over the past 10 years to modify the Open VMS operating systems to meet VA Unique needs. HP has also customized training in the administration and operation of VMA systems with The incorporation of VA changes and the use of VA-specific examples. HP has been providing this training for over 5 years with outstanding results and feedback. HP continues to modify and update classes to meet VA needs. Purpose of the course is to prepare the student to modify, reconfigure, upgrade, maintain and support HP manufactured equipment (AlphaServer ES40,ES45, ES47, ES80 systems in the Open VMS cluster environment running the VistA application) This course also introduces HP Open SA configurations. HP has customized this training to specific VA needs based upon the HP equipment VA and other Federal Health Agencies use. HP provides hands-on labs utilizing GFE equipment furnished under the VMEC contract, running the same configuration of a production VistA VA Medical Center. HP continues to develop customized classes that incorporate modifications to the VA hardware, VA software and operating systems. It is the most current and accurate training available for VA VistA operating systems and related hardware/software. Comparable courses are offered by Sun Systems, BEA, and SGI - But are NOT customized to the VA requirements and run considerably higher in pricing (average $4,000 per student vs. HP's current $2,454 per student, including lodging and 2 meals). 0A patent, copyright or proprietary data limits competition. The proprietary data is: (If FAR 8.405-6(a)(2)iii before posting. Do not include specific proprietary data. Only mention the type of equipment, procedure, etc. to show that proprietary supplies or services are being procured.) 0These are "direct replacements" parts/components for existing equipment. ____________________________________________________________________________ ____________________________________________________________________________ 0The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system. 0The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. 0An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: This specific VistA Imaging Training course was previously awarded to Hewlett Packard on 7/13/2011 under VA PO# 777-C-17243 for a total cost of $34,350.00. HP has not changed the pricing for this 2012 class. Cost averages $2,454.00 per student, and includes the cost of lodging and two meals per day, and local transporation. It is also customized in both training coursework, and hands-on lab work to fit the Production VistA VA Medical Center scenario. It is noted that the lodging rate in the Herndon, VA/DC metro area currently ranges from $108 -$224 per night which equates to $7,560 - $15,680 additional per class (of 14 students). In addition, non-customized VistA courses from other providers average $4,000 per student (per FY 2011 research) The training offered by Hewlett Packard is customized and continually updated to address VA-specific requirements, and the pricing is considerably lower than the current non-VA-Specific alternatives. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: No market research was conducted for this specific course buy - market research for previous year's requirement is less than 1 year old and also determined that there are currently no other sources who are offering a VA-specific VistA Imaging Training Class. (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: VA VistA Imaging configuration and production environment is constantly changing, updating, etc. in the VA Medical Centers and other Federal Health Agencies that utilize this system. The need to train on the most current hardware/software/system configuration for these systems is paramount to ensuring the smooth Functioning of the systems in the Open VMS cluster environment. At the present time, Hewlett Packard equipment is in operation for these systems throughout the VA. Hewlett Packard has ensured that training and support services are developed specifically for those VA employees who must configure, operate and maintain the system at their sites. No other vendor has yet to produce a VA-specific program that can address the needs of the VistA Imaging Systems in the Open VMS cluster environment. (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: The Contracting Office may consider publishing a Sources Sought on the GSA FSS, and/or the Federal Business Opportunities websites to determine if there are any additional sources who can provide a VA-Specific, HP VistA Imaging Training program at a fair and reasonable price. ?
