- Brand Name Justification document Statement of Work and Solicitation Provisions & Clauses This is is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 and as supplemented with additional information included in this notice. In addition to FAR Subpart 12.6 procedures, this synopsis/solicitation utilizes FAR Subpart 13.1 procedures. This announcement constitutes the only solicitation; quotations are being requested and a separate written solicitation will not be issued. (ii) The solicitation number for this requirement is HSHQDC-12-Q-00131 and is being issued as a Request for Quotation (RFQ). (iii) This solicitation document and its incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-58. (iv) This solicitation is issued on an unrestricted basis. The North American Industry Classification System (NAICS) code for this requirement is 541519 with a size standard of $25.5 million. The Department of Homeland Security, Office of Procurement Operations intends to award a single firm-fixed price purchase order as a result of this solicitation. Period of Performance: 06/01/2012 through 05/31/2013. 0005. SAS/Access to ODBC software maintenance for 20 EA a PC user. Period of Performance: 06/01/2012 through 05/31/2013. 1001. Option Period Two - SAS/Access to ODBC software 20 EA maintenance for a PC user. Period of Performance: 06/01/2014 through 05/31/2015. (vi) See Attachment A, Statement of Work/Clauses & Provisions, for the applicable statement of work, clauses, and additional provisions for this solicitation. The Statement of Work and applicable clauses will be incorporated into the awarded purchase order. (vii) The period of performance for this purchase order is Base Period: June 01, 2012 through May 31, 2013 Option Period One: June 01, 2013 through May 31, 2014 Option Period Two: June 01, 2014 through May 31, 2015 Delivery instruction are stipulated in Attachment A. (viii) FAR 52.212-1 Instructions to Offerors - Commercial Items (Sept 2006) is incorporated into this solicitation. Offerors may obtain the full text version of this provision electronically at http://www.arnet.gov/far. The following addendum supplements this provision: FAR 52.212-1 - Instructions to Offerors -- Commercial Items (Jun 2008) (Addendum) SUBMISSION INSTRUCTIONS Please submit your quotation to the attention of the Contract Specialist, Paul Bean, via e-mail at Paul.Bean@hq.dhs.gov with a carbon copy e-mail sent to Contracting Officer, Paula Nusbaum, at Paula.Nusbaum@hq.dhs.gov on or before 1400 ET, on May 16, 2012. FAR clause 52.212-3 Offeror Representations and Certifications-Commercial Items permits Offerors to complete Representations and Certifications through the Online Representation and Certification Application (ORCA) at least annually. The Offeror is hereby required to complete the ORCA via http://orca.bpn.gov prior to the response due date or complete FAR clause 52.212-3 as instructed therein. The Offeror shall complete and submit the following as part of their quotation: (1) Verification of ORCA registration (go to https://orca.bpn.gov/ for more information) or submission of a completed FAR clause 52.212-3 (located in Attachment A); (2) Fill in and submit HSAR 3052.209-70 Prohibition on Contracts with Corporate Expatriates (located in Attachment A); (3) Provide evidence, including an adequate description of the maintenance products offered, that the maintenance offered conforms with the software maintenance requirements solicited in this solicitation, including the brand-name requirements; and (4) Prices for each CLIN in Section V of this solicitation. QUESTIONS All questions or concerns regarding any aspect of this Request for Quotation shall be forwarded to the Contract Specialist, Paul Bean, via e-mail at Paul.Bean@hq.dhs.gov with a carbon copy e-mail sent to Contracting Officer, Paula Nusbaum, at Paula.Nusbaum@hq.dhs.gov by May 08, 2012 at 1600 ET, so that they can be addressed prior to the RFQ deadline for quotations. (end of provision addendum) (ix) FAR provision 52.212-2 does not apply to this solicitation. The following are the evaluation criteria for this solicitation: The basis of award shall be the lowest price, technically acceptable offer after price is determined fair and reasonable; therefore, a firm-fixed price purchase order will be awarded to the firm that offers the lowest price, technically acceptable offer in response to this RFQ. In order for an offer to be determined "technically acceptable", a Quoter's offer must meet the following criteria: the products offered must meet the SOW requirements. The Government will evaluate offers for award purposes by adding the extended price of each CLIN to arrive at a subtotal for all CLINs. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) FAR 52.212-3 Offeror Representations and Certifications - Commercial Items (Nov 2007) is to be submitted with your offer unless verification of the Online Representations and Certifications Application (ORCA), https://orca.bpn.gov/, is provided. (xi) FAR 52.212-4 Contract Terms and Conditions - Commercial Items (Sept 2005) applies to this acquisition. (xii) FAR 52.212-5 Contract Terms and Conditions Required to Implement Statues or Executive Orders - Commercial Items (Jun 2008). See Attachment A - Statement of Work/Clauses for the full incorporation of the clause. The HSAR clause 3052.209-70 Prohibition on Contracts with Corporate Expatriates is incorporated within Attachment A - Statement of Work/Clauses & Provisions. (xiii) There are no additional contract requirements or terms and conditions for this solicitation. (xiv) The Defense Priorities and Allocations System (DPAS) is not applicable for this solicitation. (xv) Please see the addendum to FAR 52.212-1, located in section vii of this solicitation, for the date, time, and place offers are due.
