United States Department of the Interior NATIONAL PARK SERVICE Northern Rockies Major Acquisition Buying Office (MABO) Yellowstone National Park PO Box 168 Yellowstone National Park, WY 82190 APPENDIX F: Justification for Brand Name Products Date:May 21, 2012 Project:Hammer Drill 1.Identifications a.Agency: National Park Service b.Contracting Office:Denver MABO 2.Description of the action being approved: The National Park Service (NPS) shall be soliciting for a hammer drill which will drill through rock to use while working in the backcountry for remote trail work. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. This written justification provides approval for limiting competition to the listed brand name products as authorized by the Federal Acquisition Regulations (FAR). 3.Description of supplies and services: Product: Vessel GT-5000HD Estimated price: $4158.00 4.Authority: a.41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. b.FAR Part 11.105: The Brand Name products are essential to the Government's requirements, and market research indicates other companies' similar products do not meet and cannot be modified to meet the agency's needs. c.FAR 6.302-1: The use of the name brand products are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 5.The description of the product's unique qualifications or the unique nature of the acquisition: Trail crews have been using Pionjar gas powered rock drills/jackhammers for decades. These drills flush drill cuttings from the hole using compressed exhaust gas from drill, creating a large plume of rock dust around drill site. A recent report from NIOSH has documented that the rock dust created by Piojnar rock drills poses a risk to employee health and requires mitigation. Trail crews still need to drill holes and excavate rock, and we are trying to find a machine that can do this without the dust and health risks of the Pionjar. The Vessel GT-5000HD has been field tested extensively by trail crews in Kings Canyon N.P. and Zion N.P. This drill meets the specifications outlined below. -Non dust producing drill requiring no respirator -Under 40 pounds -Must be able to drill up to a 2 inch hole -A shell or frame preferably metal around engine to protect it -safety line attachment for hooking a safety line for fall protection when drilling at height. -Type 2 stroke, forced air cooled, single cylinder -Uses standard SDS drill bits -hp 2.3 at 7500 rpm 6.Efforts to obtain competition: a.Efforts to ensure offers are solicited from as many potential sources as is practicable: For acquisitions over $25,000 the solicitation will be issued on the Government's Point of Entry, FedBizOpps.gov. b.Presolicitation notice per FAR 5.2: For acquisitions over $25,000 a presolicitation notice shall be posted on the Government's Point of Entry, FedBizOpps.gov unless the exception noted at FAR Part 5.202(a)(13) applies. 7.Determination that costs will be fair & reasonable: The Pionjar rock drill/jackhammer that this is meant to replace costs about $5000 (until recently, when manufacture of this machine was discontinued) The Vessel GT 5000HD costs $4158.00 8.Description of the market research conducted: There are two general options for rock drilling without creating a dust plum; a portable generator powering a corded rotary hammer requiring oversized generators with less power output, or gasoline powered rotary hammers. Extensive internet research, vendor phone calls, and calls to other maintenance operations turned up only this one gas-powered rotary hammer that could drive the 2" diameter drill bits needed for trail work and meet the required specifications. 9.Other facts supporting other than full & open competition: a.Reason why documents suitable for full & open competition have not been developed: Refer to item 5 above. b.Data, estimated costs or other rationale as to the extent or harm to the Government: Refer to item 5 above. 10.Interested Sources: VESSEL DRILL JDV Products Inc. 22-01 Raphael Street Fair Lawn NJ 07410 phone:201-796-1720 11.Actions, if any, to remove barriers to competition in the future for similar acquisitions: 12.Certifications: a.Technical / Requirements Certification: I do hereby recommend the use of the Brand Name products noted above for the procurement noted above.
