Description
Notice of Intent to Negotiate on a Sole Source Basis The Centers for Disease Control and Prevention (CDC) intends to negotiate on a sole source basis, under authority of FAR 6.302-1 with Logistics Health Incorporated (LHI) to provide the National Institute of Occupational Safety and Health (NIOSH), World Trade Center Health Program (WTCHP) with revised and additional support services under the current contract, 200-2010-37383, which expires 29 September 2012; and outlying Option periods 2, 3 and 4 which extend through 29 September 2015. The contractor shall provide revised and additional support services related to new requirements implemented by the Zadroga Act, which was signed into law on January 2, 2011. The revised and new requirements include: - Providing health evaluations and treatment services to qualified survivors in the WTCHP who live outside of the New York City area. These healthcare services are in addition to the healthcare services currently being provided to the responders in the WTCHP who live outside of the New York City area. - Developing and implementing a process to ensure that payment is made only for health conditions that have been certified as being WTC related by the WTC Program Administrator. -Developing and implementing a process by which all healthcare services are paid for through a healthcare claims system. The cost of healthcare will no longer be paid through the contract. - Developing and implementing a process to bill a survivor's private insurance before the WTCHP is billed (Coordination of Benefits). - Developing and implementing a process to ensure that the maximum allowable fee schedule will be the same as those published by the Office of Workers' Compensation Programs (OWCP), U.S. Department of Labor, which are in compliance with the Federal Employees Compensation Act (FECA) and/or payment rates designated by the WTC Program Administrator. CDC believes that LHI, with its experience in working the current contract, is uniquely qualified to meet these new requirements mandated by the Zadroga Act and is the only responsible source because it possesses the resources and personnel to provide continued support of the World Trade Center Health Program and implement support for the new requirements without delay or risk to performance. Unacceptable delays in fulfilling the current and new requirements would occur as a result of re-competing this procurement, and there would be substantial duplication of cost that could not be recovered through competition. This duplication of cost would include a transition period of approximately six months during which the current contractor would continue to provide healthcare services, administrative services, and member services as required by the current contract. During this transition period a new contractor would need to establish and implement a nationwide network of health care providers to provide: 1. Initial medical monitoring exams for responders 2. Initial health evaluation exams for screening-eligible survivors 3. Certification of health conditions to enable reimbursement for treatment services (medical, psychiatric and pharmaceutical) 4. Follow-up monitoring exams and treatment of certified health conditions for responders and certified-eligible survivors A new contractor would also have to establish and implement an administrative component to manage the contract (including claims processing and bill payment), a member services component, and a pharmacy benefit program with a nationwide distribution system. THIS NOTICE IS NOT A REQUEST FOR PROPOSALS. No solicitation document exists for this requirement. However, any firm that believes it is capable of meeting this requirement must submit technical and pricing documentation sufficient to determine capability in providing the same or similar support. This documentation must be submitted to the POC within 15 days of the electronic posting of this notice. Telephone requests will not be honored. A determination not to compete the proposed requirement based on responses to this notice is solely within the discretion of the CDC. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed on a sole source basis. The anticipated award date is June 22, 2012.
