- This contract action was accomplished using other than competitive procedures because there is an unusual and compelling urgency and a delay in award would result in serious injury, financial or other, to the Government (FAR 6.302-2). See posted J&A for further information. Justification and Approval For Other than Full and Open Competition 1. Contracting Activity: Western Regional Contracting Office (WRCO), 9902 Lincoln St., Tacoma, WA, 98431. 2. Description of Action: This document sets forth the justification and approval as required by Federal Acquisition Regulation (FAR) part 13.106-1(b), Soliciting from a Single Source. Approval is being sought for a modification to Purchase Order No. W91YU0-11-P-0328, awarded as a Small Business Set Aside for Personal Services with XXXXXXXX. Types of funds to be used are OMA dollars. 3. Description of Services: Services are for 12 additional hours a day, Monday through Friday (8:01am through 7:59pm) minus training and Federal holidays, for Emergency Ambulance Services at White Sands Missile Range, NM. The modification will add costs to meet 24/7 coverage. The estimated cost to add the service is $37,296.59 (Mar - May) and $146,591.88 (Jun - Nov), for a total estimated cost of $183,861.47. If the services are added the total cost of the purchase order will be approximately $491,516.51. 4. Authority Cited: The proposed modification is authorized under 10 U.S.C. 2304(c)(2) and FAR 6.302-2, Unusual and Compelling Urgency. 5. Reason for Authority Cited: Increase to the purchase order is considered urgent and compelling based on the fact that currently there are no daytime ambulance services at the White Sands Missile Range. The services are needed immediately. At the time the current Ambulance Service purchase order for White Sands Missile Range was awarded, McAfee AHC had a longstanding informal agreement that the WSMR IMCOM Fire Department would provide Paramedic services as ride along if the patient situation required enroute ALS evacuation to a higher medical facility during daytime hours. Accordingly, the Government did not contract for daytime services. IMCOM conducted a review of this practice and abruptly cut off support to McAfee, creating an emergent situation. 6. Efforts to Obtain Competition: Due to the urgency of these services no effort has been made to obtain competition. It is the Government's intent to add minimal requirements (8.68/mns) to the current order to provide sufficient time to process a competitive procurement for daytime services. 7. Actions to Increase Competition: Due to the urgency, it is in the Government's best interest to stay with the incumbent contractor until a new contract vehicle can be placed. The requirement for daytime services will be solicited in the near future as a SB Set-Aside. The replacement contract is expected to be worth approximately $506,262.00, which includes 3% inflation. The synopsis will be published in FedBizOps. It is anticipated that there will be at least three offers submitted based on the number of offers received for the current order in May 2011. 8. Market Research: Market Research is not applicable. Pricing will based on the current purchase order pricing. 9. Interested Sources: The notices required by FAR 5.201 shall not be published in FedBizOps prior to adding the daytime services. The proposed action is made under the conditions described in FAR 6.302-2 and therefore, notice will not be published until the requirements are incorporated in to the purchase order. 10. Other Facts: Adding the daytime services is considered urgent and compelling due to the fact that currently there are no daytime ambulance services being provided. The current purchase order includes twelve hour night service, and 24 hours Federal and training holiday coverage. There would be no competitive advantage to the Government by awarding a new contract because the current purchase order is still in its base year, and there have been no market changes. If the daytime services are not immediately added to the purchase order MEDCOM will be in the position of not meeting their mission to provide Emergency Services to their Soldiers and Beneficiaries. 11. Technical/Requirements Certification: Based on the above, I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief. 12. Contracting Officer Determination: 12.1. I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Fair and reasonable will be based on the pricing in the current firm-fixed-price purchase order. No certified cost or pricing data will be required. 12.2. I hereby certify that this justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this sole-source justification provided that the services and supplies herein described have otherwise been authorized for acquisition. 12.3. This J&A cites FAR 6.302-2, which provides the procedures for sole source acquisitions justification in lieu of full and open competition. Because this is a commercial item and because the acquisition does not exceed the simplified acquisition threshold (SAT) use of FAR Part 13.106-1(b) is required per FAR part 13.0003(a). FAR part 13.106-1(b) requires only that the contracting officer "determines that the circumstances of the contract action deem only one source reasonably available, e.g., urgency." The J&A sufficiently satisfies this requirement.
