Description
THIS IS A NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. The intent of this Special Notice is for informational purposes only. National Park Service (NPS), Intermountain Region (IMR), Colorado National Monument, intends to solicit a quote and enter into a contract with MESA County for a base year and four (4) 1- year option years, totaling 5 years, for snow plowing. The estimated value of the contract over a 5-year period of performance is not to exceed $65,000.00, if all options are exercised. The anticipated award date is the week of June 18, 2012. The statutory authority for this sole source procurement is FAR 13.106-1 (b). The NAICS code for this action is 561210. This requirement will be procured under the guidelines of FAR Part 13, Simplified Acquisition Procedures. NPS requires that all contractors doing business with the Acquisition Office must be registered with the Central Contractor Registry (CCR), along with Online Representations and Certifications Application (ORCA). No award can be made unless the vendor is registered in CCR along with ORCA. To be eligible to receive an award from this acquisition office, all offerors must have a Dun & Bradstreet Number. This notice of intent is NOT a request for competitive proposals. However, the Government shall consider all responsible sources received within ten days of this posting. Written responses to this synopsis shall contain sufficient documentation to establish a bonafide capability to fulfill the requirement. If no written responses are received at least ten (10) days after the publication of this notice the purchase will be awarded without further notice. Colorado National Monument lies entirely within Mesa County, Colorado. Mesa County serves a citizen population of more than 60,000 people, with land mass with elevations ranging from 5000 feet to 8000 feet. The county roads department provides all road services including plowing and sanding county roads at varying elevations. Colorado National Monuments Facility Manager along with Mesa County will collaborate onsite in the determination of the amount of snow received per month along with direction, guidance, and approval of the work. Snow conditions, depths, and consistency will vary from year to year and the amount of snow able to be removed in some areas will vary based upon these conditions, and the equipment used. Colorado National Monuments Facility Manager will have the final on site determination on snowfall received. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION: 1. AGENCY AND CONTRACTING ACTIVITY: NATIONAL PARK SERVICE Colorado National Monument 2. NATURE AND /OR DESCRIPTION OF THE ACTION BEING APPROVED: Provide plowing and sanding for four miles of East Rim Rock Drive. 3.DESCRIPTION OF THE SERVICES: the National Park Service is responsible for providing year round access 24/7 for four miles of the Colorado National Monument's East Rim Rock Drive from the Monument's East Entrance to the DS Road turn off to Glade Park. The four miles of East Rim Rock Drive are exceptionally steep, narrow, with 12 switchbacks and with grades of 9%, a climb in elevation of 1500 feet -shaded curves, and with high volumes of traffic using the road coming down from and heading up to Glade Park. This section of road is a legal right of way for Glade Park. The road must be plowed before 6:00am on weekdays to provide access for commuters and school buses. 4.AUTHORITY CITED: The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C.Section 2304(c) (1), as implemented by FAR 5.302-1 (a) (1), Only One Responsible source and No Other Supplies or Services will Satisfy Agency Requirements. 5.DEMONSTRATION OF THE CONTRACTOR'S UNIQUE QUALIFICATIONS: Colorado National Monument lies entirely within Mesa County, Colorado. Mesa County serves a citizen population of more than 60,000 people, with land mass with elevations ranging from 5000 feet to 8000 feet. The county roads department provides all road services including plowing and sanding county roads at varying elevations. The county maintains a fleet of heavy equipment including snowplows that are 26,000 GVWR, with 10 foot plow' blades and 2 ton sand bins. These are the only types of plows that are capable of plowing and sanding these four miles. The county also employs year round and seasonal employees who are trained and certified to operate this equipment. 6.EFFORTS TO OBTAIN COMPETITION: There are no contractors in the grand Valley communities that provide or capable of providing this type of plowing service. Most of the Grand Valley sits at approximately 4800 foot elevation. Yet the Monument's east entrance road rises in elevation from 4930 feet to 6300 feet and includes grades in excess of 9% and with 12 steep switchbacks in shaded areas that hold ice. Specialized equipment and trained operators are necessary for this road. Seeking sources that utilize and maintain the type of equipment needed, the city of Fruita, and Grand Junction, were contacted. Fruita, and Grand Junction do not service outside of their city limits. 7.DETERMINATION OF FAIR AND REASONABLE COST: Mesa County has maintained the same pricing as in past years and charge for time and materials only. A determination by the contracting office is that the anticipated cost to the Government will remain fair and reasonable. 8. DESCRIPTION OF MARKET RESEARCH: In the communities of Grand Junction and Fruita which are adjacent to Colorado National Monument, we found five companies that advertise snow removal services. Most are summer landscape companies which add plows to pickup trucks to plow subdivisions' and ranch lands in the winter months. Most plowing services are used to plow at the valley floor level which is approximately 4800 feet in elevation. The equipment utilized for such plowing is significantly smaller and used for limited snow removal compared to the needs of the park. Colorado National Monument and most especially the East Entrance road has challenging topography and is at a higher elevation. 9. OTHER FACTS TO SUPPORT THE USE OF OTHER THAN FULL AND OPEN COMPETITION: Colorado National Monument received funds that able it to contract for snow plowing and sanding for the FY 2012 season. The snowstorms were especially long with heavy snowfall in the FY 2010 season. There is only one entity capable of providing the equipment, operators, and the recurring service in every diverse storm that impacts Mesa County and East Rim Rock Drive of Colorado National Monument. 10. INTERESTED SOURCES: Due to the treacherous nature of the road, the heavy equipment needed and the constant availability, a secondary source to handle these hazardous conditions has not been identified. 11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE BARRIERS TO COMPETITION: It would be irresponsible, potentially unsafe and wholly impractical -to use any other source. (Snow plowing,COLM) (September 01, 2012 - May 31, 2013) PERFORMANCE WORK STATEMENT FOR SNOW PLOWING: Mesa County will provide Colorado National Monument snow plowing and sanding services on four miles of East Rim Rock Drive starting at the East Entrance Station then proceeding to the OS Road turnoff to Glade Park. The road will be plowed and sanded before 6:00 a.m. on weekdays to provide access for commuters and school buses. The period of performance will be from September 1, 2012 through May 31, 2013. Mesa County will submit an original invoice to the Contracting Officer with a copy to Colorado National Monument no more frequently than monthly for payment. Payment will be made in accordance with the terms of the Prompt Payment Act. Mesa County will be required to submit proof of liability insurance to the NPS Contracting Officer.
