Description
THIS IS A COMBINED SYNOPSIS/SOLICITATION for commercial supplies prepared in accordance with the format in FAR Part 12 and FAR Part 13. This announcement constitutes the only solicitation. Solicitation number M00263-12-T-1014 is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-57 effective 18 May 2012, and DFARS Publication 20120529. This solicitation is being conducted on an unrestricted basis, which allows for full and open competition. Note: The items being acquired under this procurement action are for a specific brand name, with the justification included in the solicitation. Quotes will be accepted by firms other than the original manufacturer, but the software licenses being quoted must be what is supplied by the manufacturer, Riverbed Technology. Sole Source Justification is included as Attachment One to solicitation M00263-12-T-1014. In order to minimize the risk of the government purchasing counterfeit products or unauthorized secondary market equipment, which would not be supported by the Original Equipment Manufacturer (OEM), and in order to ensure that the Government purchases only equipment that is genuine (i.e., not counterfeit), authorized (e.g., including appropriate licenses), and supported (e.g., warranty and support services) by the OEM, the Vendor shall certify that it is an authorized dealer of the manufacturer supplying the software and/or hardware related to this procurement action as of the date of the submission of their offer, and that it has the certification/specialization level required by the Manufacturer to support both the product sale and product pricing, in accordance with the applicable Manufacturer certification/specialization requirements. Unless otherwise specified, Vendor shall warrant that the products are new, and in their original box. The Vendor confirms to have sourced all Manufacturer products submitted in this offer from Manufacturer or through Manufacturer Authorized Channels only, in accordance with Manufacturer's applicable policies in effect at the time of purchase. Once awarded, the Vendor shall provide the Buyer with a copy of the End User license agreement, and shall warrant that all Manufacturer software is licensed originally to the Buyer as the original licensee authorized to use the Manufacturer software. This procurement is being conducted under the provisions of Federal Acquisition Regulations (FAR) Part 12 Commercial Items and FAR Part 13 Simplified Acquisition Procedures . The Government intends to award a firm fixed price contract for two types of software license upgrades, with a quantity of 48 for the first type, and 6 of the other type. The contract requirements for this procurement are outlined in the RFQ of solicitation M00263-12-T-1014. Applicable contract requirements, provisions, and clauses are referenced in the solicitation. Award will be made on the lowest priced technically acceptable offer. Offerors responding to this announcement shall submit their quotations in accordance with FAR 52.212-1. Submission of quotes shall include all information required in the RFQ provided in solicitation M00263-12-T-1014. All responsible sources may submit a response which, if timely received, will be considered by the agency. It is the intent of the Government to issue one award, but reserves the right to make multiple awards if it is in the best interest of the Government. Quote Submission Requirements All intended parties shall submit the following as part of their quote: 1.Certification as an authorized dealer of the manufacturer. (Contractor can use own format, as long as it is easy to understand.) 2.Completed FAR provision 52.212-3 3.Prices of proposed items. 4.Delivery Schedule for the License Upgrades 5.Past performance reference. The contractor shall provide 2 relevant references that are no older than 3 years. 6.Completed and signed the DD 1449 (Blocks 30a, 30b, 30c)
