- 1. Contracting Activity: Defense Microelectronics Activity (DMEA), ATTN: MEE, McClellan, CA 95652-2100. 2. Description of Action: Approval is being requested for the purchase of test equipment and software from Agilent Technologies Inc. under GSA contract schedule, using RDTE funds. A detailed list of the test equipment and software to be purchased is attached. 3. Description of Supplies/Services: The contractor will supply equipment and software manufactured by Agilent Technologies and delivered to DMEA, 4234 54th Street, McClellan, CA 95652-2100. Estimated total cost of this material is $220,260. 4. Authority Cited: 10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. 5. Reason for Authority Cited: Agilent Technologies is the only contractor who can supply test equipment and software that will mirror the Mogul Program test set up used at a classified government facility. Mirroring of equipment and software ensures compatibility of test programs used by both facilities when comparing test results on identical weapon system hardware. 6. Efforts to Obtain Competition: At this time, no other sources have been identified who can mirror the test set up established at the other government test facility. 7.a. Contracting Officer's Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable and this justification is accurate and complete to the best of my knowledge. 7.b. Procurement Analyst Concurrence: Based on the above information, I hereby concur with this J&A and proceeding with other than full and open competition. 8. Market Research: The market research that was conducted during April 2012 used the following elements to make our determination: a. Contacting knowledgeable individuals in Government and Industry regarding market capabilities to meet requirements. b. Reviewing catalogs and other generally available product literature published by manufacturers, distributors, and dealers or available on-line. It was found that no other vendor possessed the ability to provide an identical test environment to mirror the equipment established at another government facility. 9. Other Facts: The test equipment and software used in assembled test environment are proprietary and are only available through Agilent Technologies. No one, other than Agilent Technologies, can supply identical hardware and software for the test environment. No second source exists for both the hardware and software components of these systems. Other vendors may provide equivalent measurement results but cannot operate with the test environment software programs. 10. Listing of Sources: 11. Actions to Increase Competition: None 12.
