- This is a combined synopsis/solicitation notice of intent for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested and a written solicitation will not be issued for the solicitation number NIAID-NOI12120 issued as a Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-58 dated April 18, 2012. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside. All responsible sources may submit an offer that will be considered by this agency. The associated North American Industry Classification System (NAICS) Code is 334516, which has a business size standard of 500. The National Institutes of Health, National Institute Of Allergy and Infectious Diseases (NIH/NIAID) intends to award a sole source procurement to Molecular Devices, 13121 Orleans Drive, Sunnyvale, CA 94089. The purpose of this requirement is to provide service and maintenance to a SpectraMax Plus 384, serial number MN02631. Service plan will include all travel, parts, and labor necessary to keep the equipment operational. The manufacturer qualifies all technicians with extensive training programs that cover all aspects of the equipment's operation, performance and repair. The technicians must maintain certification through update training courses. Place of delivery 8200 Research Plaza rm 1A121 Frederick MD 21702. The government will award a fixed price purchase order to the responsible contractor. The FOB point shall be Destination. Payment Net 30 days. The following Federal Acquisition Regulations provisions and clauses apply to the acquisition: FAR 52.212-1, Instructions to Offerors - Commercial Items; FAR 52.212-2, Evaluation - Commercial Items; Far 52.212-3, Offeror Representation and Certifications - Commercial Items; Far 52.212-4, Contract Terms and Conditions -Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items; and FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003). In order to be considered for an award, an offeror must have completed the electronic Online Representations and Certifications Application (ORCA) at https://orca.bpn.gov in accordance with FAR 4.1201(a). By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR at www.ccr.gov prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. [Note: Lack of registration in the Central Contractor Registration will make an offeror ineligible for award].
