Description
The Department of Veterans Affairs, VA Boston Healthcare System, has a requirement for a Lecroy Oscilloscope Data Acquisition System. A firm-fixed price purchase order is anticipated and shall be awarded. Delivery is within 30 days of receipt of order. It is the Government's belief that only Lecroy Corporation possesses the required capabilities to successfully meet this requirement since the system purchased must be compatible with an existing piece of equipment. It is the Government's intention to solicit and negotiate only with this source. Please refer to the Sole Source Justification. This is not a solicitation; it is notice of intent to sole source a requirement. Inquiries/information received after the established deadline shall not be considered. The submission of any data for review shall not impede award of this contract as planned. The Government does not intend to pay for information solicited. This synopsis is issued pursuant to FAR 6.302-5. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Contracting Activity: Department of Veterans Affairs, VISN 1, VA Boston Healthcare System. Transaction number 523-12-3-9184-0509. 2.Nature and/or Description of the Action Being Processed: This request is for sole source procurement of a high-resolution oscilloscope data acquisition package to replace an integrated long-term loaner system that is now no longer available for our use. The requested instrument and allied accessories are essential for all experimental operations at the Blast Neurotrauma Laboratory at Boston University School of Medicine to support collaborative research with investigators at VA Boston Healthcare System. The required integrated oscilloscope package is required to monitor and acquire data of blast shockwaves during experimental traumatic brain injury (TBI) involving laboratory mice. The data acquisition accessory package is required to monitor and control experimental variables. Research on these BU-VA collaborative projects will remain at a standstill without the requested instrumentation. Estimated value of required purchase is $35,000. 3. Description of Supplies/Services Required to Meet the Agency's Needs: We request the purchase of the following items: customized high-resolution, high-speed oscilloscope data acquisition package (see attached quote, SQU048556-Rev2-BU). We work with the Rehab R and D Center of Excellence at VA Boston: The Translational Research Center for Traumatic Brain Injury and Stress Disorders (or TRACTS) to develop animal models of blast exposure needed to understand the effects of battlefield explosions on our veterans brains. The requested oscilloscope and related accessories described in this quote is a scientific instrument that is used to measure our experimental "blasts" on our laboratory animals. It is necessary for us to understand the physical forces involved and how these physical forces affect the bodies of our mice. This information can then be used to design preventative measures for the battlefield as well as testing new treatments for traumatic brain injury in veterans. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(c)(1), as implemented by FAR 6.302-1. ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 4. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This is a request for sole source procurement for a high resolution oscilloscope data acquisition package for Boston University's custom designed Shock Tube used in a murine model of Traumatic Brain Injury. We are carrying out a multi-institutional collaboration between the Boston VA, and Boston University. Our Boston University collaborators have a custom designed Shock Tube and require the addition of a sophisticated oscilloscope based data acquisition package to monitor the progression of the shock wave through a murine model of traumatic brain injury (TBI). We need this high resolution oscilloscope data acquisition package to monitor and control as many experimental variables as possible and ensure the overall integrity of this complex experiment while continuing to develop and test novel therapeutics in a murine model of TBI. Their product specifications and performance match our special high resolution measurement requirements for the BU's custom designed Shock Tube. 5.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: We must exactly match the shock tube pressure monitoring requirements by our BU collaborators to ensure the integrity of data generated for this project. Other manufacturers (Agilent and Tektronix) were examined but none could exactly replicate the product and performance specifications of the Lecroy's high-resolution oscilloscope data acquisition package. Moreover, the requested sole source procurement will be used to replace an integrated long-term loaner system that is now no longer available for our use, and therefore, must be technically compatible with and meet analytical of the replaced instrumentation and allied accessories. As such, the requested instrumentation package must be met by sole-source procurement from the requested vendor as per quote. No other companies have been contacted for bidding as no other company produces a compatible product that meets our technical requirements. 6.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Price Analysis will be conducted in accordance with FAR 13.106-3 to determine if the price is fair and reasonable. 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The product selection is based on our external collaborators and their unique high speed and resolution oscilloscope data acquisition specification requirements. The need to maintain the integrity of the data generated is critical and we were not able to carry out market research for alternative vendors. Market research showed that the manufacturer, Lecroy, has authorized resellers throughout the country. Three on the east coast were contacted but do not carry the WaveRunner system that is specified to be compatible with the existing custom made equipment at Boston University. One vendor stated that Lecroy does not let the resellers carry the more complex systems. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: The required oscilloscope data acquisition package must be compatible with the existing custom made equipment at Boston University. Use of another system is impossible since use of another vendor's system would not produce the needed and consistent data the requested package would accomplish. 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Agilent and Tektronix are two other vendors that manufacture oscilloscope systems but they are not compatible with the existing custom made equipment at Boston University. 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Research requirements are unique and often require unique sources. In this case the purchased system must be compatible with existing custom made equipment at Boston University. Competition is sought whenever possible.
