S. Embassy in Panama City, Panama, and the price reasonableness of the government's estimates for the value of the potential future contract. THIS IS A REQUEST FOR INFORMATION IAW FAR 15.201(e). This RFI is being issued solely for market research and planning purposes and does not constitute an Invitation for Bids (IFB), a Request for Proposals (RFP), a Request for Quotations (RFQ) or an indication that the Government will contract for any of the items and/or services contained in this notice. The government will not pay for any information received in response to this request nor will the Government compensate any respondent for any costs incurred in developing the information provided to the Government. This RFI does not commit the Government to award a contract. Any solicitation for these guard services will be announced separately. Not responding to this RFI does not preclude participation in any future RFP. If a solicitation is released, it will be synopsized on the Federal Business Opportunities (FedBizOpps) website. It is the responsibility of the potential offerors to monitor FedBizOps for additional information pertaining to this requirement. 2.0 Description The Government currently utilizes local guard services at its embassy in Panama City, Panama. It requires that any vendor providing local guard services to the Government fully comply with the laws and regulations of the host country, Panama. In May 2011 Panama announced the issuance of Ley 56 concerning ownership and administration of security companies, and Ley 57 concerning ownership and registration of firearms. Each of these laws calls for significant changes to the previous basis for providing guard services in Panama. The date for issuance of the implementing regulations has been announced as February 2013. The National Assembly of Panama has stated that it will rewrite Ley 56 before the implementing regulations are issued. During this period of transition the Department of State may issue a solicitation for local guard services at the U. S. Embassy in Panama. Given the uncertainty surrounding the local guard business sector in Panama, and the legal requirements which may be imposed on guard service vendors, the Government invites industry comments on the structure of its potential solicitation and the reasonableness of its price estimate for the value of a five year (base and four option years) contract. The Government estimates that if Ley 56 is not implemented at all the price of the contract for the five year period would be USD $5,671,191.00. However, if Ley 56 is implemented as written, the Government estimates that the cost for the same five year period would be USD $8,717,202.00. A draft solicitation for industry comment is attached to this Special Notice. The government invites comments on any topic concerning the structure of this draft. However, it is particularly interested in suggestions concerning better ways to structure this potential solicitation so that the government receives the services it needs but does not impose unnecessary burdens on the vendor. The Government requests that interested vendors submit their comments and suggestions in a brief white paper that addresses both the structure and the price. Vendors may also discuss any other topic related to this situation. 3.0 Response Submission Instructions and Due Date The Government requests that responses to this RFI be submitted no later than 4 PM Eastern Standard Time (EST) July 30, 2012. Respondents should identify their organization's name, address, telephone number, and point of contact on packaging and title pages. The company's name should appear clearly on every page of the white paper and proprietary information must also be clearly marked. In addition, responses should be unclassified and marked appropriately on every page. Responses to the RFI will not be returned. Please limit responses to ten (10) single sided pages or less, single spaced. The responses should be in Adobe Acrobat Portable Document Format (PDF) or formats otherwise compatible with the Microsoft Office 2007 program. Phone calls pertaining to this RFI WILL NOT BE ACCEPTED All RFI responses shall be emailed to Winkle W. Nemeth, nemethww@state.gov no later than 4 PM Eastern Standard Time (EST) July 30, 2012. RFI responses will not be accepted by fax. In accordance with FAR 52.215-3 - Requests for Information or Solicitation for Planning Purposes (Oct 1997), the Government will not pay for any information/items submitted in response to this RFI. All data submitted shall be retained as government property and shall not be returned.
