- JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY: 30th Contracting Squadron (AFSPC), 30 CONS/LGCB REQUIRING ACTIVITY: 30 FSS/FSV PROGRAM NAME: Provide Basewide Laundry and Dry Cleaning Service for Vandenberg AFB, CA ESTIMATED CONTRACT COST: (1 - 3 months) Purchase Request: F4D3FK2156AK01 TYPE J&A: Individual II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED a. The proposed action is for a one (1) month not to exceed three (3) months extension to contact FA4610-08-D-0002, Basewide Laundry and Dry Cleaning service based on the necessity to continue services and avoid mission impact to the 30th Force Support Squadron (30 FSS) until the new contract is awarded. Award will be made by contract modification to the existing Firm-Fixed Price (FFP) type contract (FA4610-08-D-0002) for a period of one (1) month not to exceed three (3) months (exercisable in increments of one (1) month), beginning 01 October 2012 and ending 31 December 2012, pursuant to FAR 52.217-8, Option to Extend Services. b. This J&A is necessitated by the fact that the option under FAR 52.217-8 was not previously evaluated as part of the contract award. This option exercise will be at the current rate specified in the current contract, as allowed by FAR 52.217-8. This option exercise will further allow for solicitation, evaluation, and award of a competitive follow-on procurement. The incumbent contractor is the only responsible offeror for the exercise of this option as the Government would experience unacceptable delays in fulfilling agency requirement if this option were not exercised before the expiration of the current option period. If accepted, a unilateral modification will be completed to extend services on the contract for one (1) month not to exceed three (3) months. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY NEEDS The Basewide Laundry and Dry Cleaning service contract provides pick-up and delivery service for the Base Linen Exchange and the Child Development Center in accordance with industry standard and as required in the Performance Work Statement (PWS). IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1(a)(2)(iii), Only one responsible source and no other supplies or services will satisfy agency requirements cited in 10 U.S.C 2304(c)(1) or 41 U.S.C. 253(c)(1). The incumbent contractor is the only practical and cost-efficient source for procurement of this service until the new Basewide Laundry and Dry Cleaning contract is awarded. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) a. The current Basewide Laundry and Dry Cleaning contract (FA4610-08-D-0002) was awarded using full and open competition on 13 November 2007 and is scheduled to expire 30 September 2012. b. A follow-on contract extension for continued services is essential to maintain continuity of service, prevent unacceptable delays and duplication of cost to the Government in fulfilling agency requirement for one (1) month. It will also allow 30 FSS the opportunity to inspect the facility of the apparent awardee to ensure health and safety measures are met and allow 30 CONS to align services and move contracts off of the fiscal year cycle to necessitate ease of fiscal operations. c. The incumbent contractor, Kleanerette Dry Cleaning and Laundry, is performing the required services at Vandenberg AFB, CA and will continue to provide the services for the extension period until transition to a potential contractor. VI. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE A Notice of Intent to issue an extension in accordance with FAR 6.302-1 for a performance period of one (1) month not to exceed three (3) months was publicized in FedBizOpps on 3 July 2012. The notice of intent states that interested persons could respond to the notice by communicating their interest and capability to fulfill the subject requirement. This notice also stated that a determination by the Government to exercise the option clause and not compete this proposed contract action based upon responses to the notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether or not to exercise the option. Only one company responded. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The contracting officer has determined the current price to be fair and reasonable based on past competition and is considered the best value to the government. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market research for the follow-on acquisition began in April 2012 and is on-going. A sources sought was posted on 3 April 2012 in FedBizOpps and there are sources capable of satisfying the agency's requirements. Commercial services are available to satisfy the Government's needs for this procurement. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION The proposed extension would ensure continuation of support to 30 FSS without interruption and ensure their ability to continue providing pick-up and delivery service for the Base Linen Exchange, Bldg. 7420 and the Child Development Center, Bldg. 16177 at Vandenberg AFB, CA. Kleanerette Dry Cleaning and Laundry, the incumbent, holds all required certifications and clearances, is familiar with the facilities and materials, and is fully capable of continuing performance for the additional one (1) month. X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION A Notice of Intent to issue an extension in accordance with FAR 52.217-8 and FAR 6.302-1 for a performance period of one (1) month not to exceed three (3) months was publicized in FedBizOpps on 3 July 2012. One interested vendor response was received from XXXX no other documentation was submitted but raised no objection to the Government's proposed extension of the current contract. No other sources expressed an interest or willingness to provide the requested services. A synopsis of the J&A will be published in FedBizOpps in accordance with FAR 6.305. Given the critical nature of the required services and the time constraints for performance, the incumbent contractor appears to be the only viable and cost effective source for fulfillment of these requirements. XI. A STATEMENT OF THE ACTIONS IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO THE COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED The prior contract award was conducted as a competitive acquisition after the exclusion of sources. Advanced planning for the follow-on contract began in March 2012. Contract award is anticipated to be made on 1 Oct 2012 and will be a competitive award. Additional time is required for the mobilization period of new contractor. XII. CONTRACTING OFFICER'S CERTIFICATION The Contracting Officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge. XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by the signature on the Coordination and Approval Document, the 30 FSS Program Manager, has certified that any supporting data contained herein, which is his responsibility, is both accurate and complete.
