GOVERNMENT INVOICE ADDRESS: All invoices from the contractor shall be mailed to the following address: FACILITY INDICATED ON DELIVERY ORDER ACKNOWLEDGMENT OF AMENDMENTS: The offeror acknowledges receipt of amendments to the Solicitation numbered and dated as follows: AMENDMENT NO DATE ______________________________ _____________ ______________________________ _____________ ______________________________ _____________ INTRODUCTION: 1.1 Background. The Veterans Health Administration's (VHA) Prosthetic Clinical Management Program (PCMP) has identified Disposable, Non-Disposable Nebulizers Sets (medicine cup, tubing & appropriate mouth piece), accessories and Compressors as a candidate for continued standardization set forth in VHA's PCMP Charter signed by the Under Secretary for Health on February 9, 2001. The purpose of consolidated contracting is to obtain user uniformity and quality products at competitive prices at lower than current contract or open market prices; therefore providing VA with a mandatory national contract source for the selected items. VA's objective is to ensure that all veterans are receiving comparable product across the nation and to consolidate VA's requirement to achieve better pricing. The type required are Disposable, Non-Disposable Nebulizers Sets (medicine cup, tubing & appropriate mouth piece), accessories and Compressors and the requirement of this solicitation are being procured is used for Veteran Home Health Care. Nebulizers is a device releasing medicinal spray with a face mask attached, for administering a medicinal liquid in the form of a fine spray that is breathed in through the mouth or nose. Nebulizers are commonly used for treatment of respiratory diseases. Nebulizers use oxygen, compressed air or ultrasonic power to break up medical solutions/suspension into small droplets that can be directly inhaled from the mouthpiece of the devices. Nebulizer compressors are electric powered devices that compress room air to supply a flow of air to aerosolize medications, such as bronchodilators, steroids, mucolytics, and antibiotics, and deliver these medications into the patient's airway. They are used in conjunction with a disposable/non-disposable hand held medication nebulizer to supply the proper particle size for disposition in the patient's airway. 1.2 Purpose and Objective. The purpose of this solicitation is to provide the contracted items for the Veterans Health Administration's (VHA) Prosthetic Clinical Management Program (PCMP) at the VA Medical Centers (VAMCS) as a mandatory source of supplies. PCMP has determined that there is still a need for standardization for this product. The purpose of consolidated contracting is to obtain user uniformity and quality product at competitive prices. The objectives are to insure availability and consistency of product for nationwide usage and to obtain volume-based, committed use pricing. VA is currently purchasing these products from the Federal Supply Schedule (FSS) or Open Market. This solicitation is open only to Small Businesses utilizing Federal Acquisition Regulation (FAR) for small business set-asides Part 19. The awarded contract will be a firm-fixed price supply requirements contract under the FAR part 15, and 12, including agency specific clauses and provisions herein. 1.3 Contract Duration. The base contract is for one year, with four one-year option periods that may be exercised by the government. 1.4 Contract Effective Date.. The effective date of the contract shall be 45 days (or sooner upon mutual agreement) after award. 1.5 Award One award will be made resulting from this procurement. Award will be based on best value considering the factors disclosed in Part IV, Evaluation of Offers. If award is not made on an initial offer, Final Proposal Revisions (FPR) may be requested by written correspondence. 1.6 This solicitation requires that all offerors must include product samples. Product samples for all offered items must be submitted by the offer due date. For additional information regarding submitting product samples see addendum to FAR 52-212-1 "Instructions To Offerors - Commercial Items" and in FAR 52-212-2 "Evaluation - Commercial Items, which are included elsewhere in this solicitation. Samples must be delivered to the loading dock per the instructions To Offerors. Extent of Obligation: 2.1 Government participants. The contractor shall provide the products specified in the schedule directly to VAMSs throughout the United States and Puerto Rico at the prices awarded herin and under the terms and conditions set forth in the contract upon receipt of a delivery order/purchase order signed by a person with purchasing authority on behalf of a VAMC. Individual VAMSs shall issue delivery/ purchase orders to the contractor which shall indicate the specific items ordered, item quantities, and all necessary delivery and payment procedures. 2.2 Estimated Quantities. See Schedule of Supplies for estimates by line item. It is estimated that the combined annual usage of Disposable, Non-Disposable Nebulizers Sets (medicine cup, tubing & appropriate mouth piece), accessories and Compressors is approximately as follows; Disposable/Non-Disposable Nebulizer Sets - (medicine cup, tubing & appropriate mouth piece (A7003) 87,642 Stand compressor with Non-disposable Nebulizer (E0571) 1,000 Standard compressor with Disposable Nebulizer (E0570) 33,985 DC Compressor with Non-Disposable Nebulizer (E0571) 500 DC Compressor with Disposable Nebulizer (E0571) 33,983 Aerosol Mask (A7015) 26,609 Trach Mask (A7525) 2,858 Disposable filters (A7013) 30,324 Non-disposable filters (A7014) 4,617 The Totals are estimated quantities and this amount includes VA estimated quantities for all Line items and does not include replacement items annual usage. This quantity is the usage for the listed types, including any up graded model Nebulizer that become available after award in accordance with paragraph 4.0 Technology Refresh, (i.e. if a new Nebulizer is added, the total estimated quantity of Nebulizers would not change but there may by a shift in usage from existing Nebulizer to the new Nebulizers). The estimates for all line items will be submitted by the offer using the schedule format below and verified by the government by commercial product literature, or other acceptable methods of printed material submitted in the proposal. There is no expressed or implied guarantee that the estimated quantities of any line item will be purchased under contract. 2.3 Exclusion. Contract resulting from this solicitation will not preclude VA from purchasing items from non-contract sources when participating in clinical research, and are for Veteran home health care patients only. 3.0 Delivery Requirements. Delivery Orders issued by individual VA facilities (VACs): Deliveries to individual VA facility shall be FOB Destination. Delivery to individual facilities shall be in accordance with the following time frames: Regular delivery shall be made within seven (7) days after receipt of a delivery order, expedited delivery within 3 days, and emergency delivery within 24 hours. The government agrees to pay the difference between normal and expedited freight for expedited and emergency deliver. Any additional delivery requirements shall be specified on the individual deliver order. Acceptance of all delivery orders shall take place at the delivery point. There are over 189 potential delivery points associated with individual orders from VA facilities. 4.0 Technology Refresh. All Nebulizer Sets and Accessories offered shall be state-of-the-are technology. "State-of the-are" is defined as the most recently designed components, which are announced for marketing purposes, available, maintained and supported in accordance with requirements specified in the solicitation. Components and products with a manufacturer's planned obsolescence within the first year of contract award are not acceptable. If upgrades of Nebulizers Sets and accessories become available after award of this contract; the contractor will substitute them for the awarded item(s). The contractor will provide to the contracting officer the following information; A list of specification awarded item which shall be updated. Products literature for the new items and a detailed description of the differences between the awarded items and the new item, and a specific analysis of the comparative advantages/disadvantages of the items involved. The Contracting Officer will provide the information to the VA Prosthetics Clinical Management Program representative for approval. Upon approval, the contract will be modified to acknowledge the updated items. All new products release to the market during the term of the contract will be made available to the government at a discount price which is similar to the most comparable currently released products. If pricing for the new products is unacceptable, facilities will continue to use current products on contract and contractor will be required to continue to supply the contracted item. Pricing on new technologies will be negotiated separately. 5.0 Technical Requirements - The following minimum technical requirements are required. Failure of the product literature to show that the offered product conform to required minimum technical requirements shall cause rejection of the offer and offered product will receive no further evaluation. Nebulizers The small volume nebulizer shall match the compressor source that meets the criteria for its intended design i.e. flow rate at specific psi level. Each nebulizer set shall include the manufacturer cleaning instruction and the language small be written to be understood at a sixth (6) grade level (Offeror to submit electronically - to be tested through Flesch-Kincaid Grade Level Readability formula). The cleaning materials also should be easily obtainable for home use e.g. bleach, vinegar etc. The language shall be written in English and Spanish Particle size shall not exceed five (5) microns. Tubing length shall be a minimum of six (6) feet. Sets shall include manufacturer's minimum technical requirements for frequency of cleaning, number of uses and/or length of time before disposal. Compressors The compressor minimum technical requirement i.e. Air flow & Operating Pressure shall match the manufacturer's requirement of nebulizer submitted to produce correct particle size - less than five (5) microns. Noise level NTE 60 dBA Weight - 4lbs or less Electrical - 115 volts 12 volts DC Disposable filters D/C Adaptor to convert A/C devices to run on D/C power (replacement purposes only) Warranty - Minimum three (3) years (excludes damage caused by veteran) Compressor Replacement - Shipment within 5 days ALL ITEMS MUST BE MANUFACTURED BY A SMALL BUSINESS WITHIN THE UNITED STATES.
