This RFP does not commit ResCare to pay any costs incurred in the preparation of a proposal, nor does it commit ResCare to award a contract for products, supplies or services. ResCare will be the sole judge as to which bid offers the best overall value and will serve the best interest of ResCare. ResCare reserves the right to reject any and all bids without recourse from bidders. In compliance with the Bid Provision, Scope of Work, Terms and Conditions, and other specifications contained in this RFP, the undersigned hereby proposes to provide Dental Services for the center listed above. Bid Rate (Hourly Rate) The hourly rates herein are no higher than would be quoted to any other customer, either commercial and/or agencies of the United States Government, for similar services. Dentist Services Base Term August 31, 2012 through July 31, 2013 1 st Option Year August 1, 2013 through July 31, 2014 2 nd Option Year August 1, 2014 through July 31, 2015 3 rd Option Year August 1, 2015 through July 31, 2016 Hourly Rate Above rates include necessary labor, transportation and supervision required to accomplish scope of work. Bidders must include proposed rate for base and option years, as applicable. •· Valid licenses to practice in the state or commonwealth •· Valid DEA license (see DEA License section under Terms and Conditions) •· Certificate of insurance (see Insurance section under Terms and Conditions) •· Resume or Curriculum Vitae •· Statement of Experience dealing with adolescents •· Proposed schedule (days/hours) •· Individual Hourly Rate Breakdown form, if applicable SELECTION OF CONTRACTOR In addition to the hourly rate of service, selection of the contractor will be based on the following criteria: •· Experience in providing dental care services for adolescents and young adults (minimum of five years experience) •· Provision of dental care to young adults who are socially and economically disadvantaged •· Previous practice in settings such as schools, colleges, institutions, military or correctional institutions •· Willingness and ability to carry out required duties and responsibilities •· Admission and attending privileges at local hospitals or specialty clinics •· Academic affiliation with nearby professional schools or colleges •· Approval of the contractor by the ResCare corporate office •· Approval of the contractor by the Regional Office of Job Corps, U.S. Department of Labor The most suitable candidate(s) may be interviewed prior to award. BID PROVISIONS The following bid provisions will apply. Failure to carefully read and follow all instructions and specifications will be at the bidder's risk. 1. All prices and notations must be in ink or typewritten. No erasures are permitted. Errors may be crossed out and corrections printed in ink or typed adjacent and must be initialed in ink by person signing bid. 2. Price Warranty: The hourly rates quoted herein are no higher than would be quoted to any other customer, commercial and/or agencies of the United State Government for similar services. 3. The bidder will list on a separate sheet of paper any exceptions to the conditions of this bid. This sheet will be labeled "Exceptions to Bid Conditions" and will be attached to the Bid Sheet. If no exceptions are stated, it will be understood that all general and specific conditions will be complied with without exception. 4. ResCare reserves the right to accept and/or reject any or all bids or waive any formality connected with the bids. Lowest rate or overall bid does not constitute bid award. ResCare will be the sole judge of which bid is selected for approval (see "Selection of Contractor" above) and contract award. 5. Items will be quoted F.O.B. destination. No additional charge for delivery, drayage, express, parcel post, packing, cartage, insurance, license fees, permits, cost of bonds, or for any other purpose will be paid by ResCare unless specifically included in the bid and accepted by ResCare. 6. In the event that a contract is awarded in response to this RFP, the below statement of work, provisions and set forth terms and conditions will be incorporated in their entirety into the contract and become an integral part of the contract when the contract is accepted by the contractor, either by acknowledgment or commencement of performance. GENERAL PROVISIONS The undersigned Center Dentist agrees that the following provisions are applicable to this agreement: The center dentist agrees to perform its services in accordance with professional standards and policies, procedures, and guidelines as may be established from time to time by the Department of Labor and/or ResCare. The center dentist further agrees and acknowledges that the Department of Labor and/or ResCare reserve the right to change, modify, alter and revoke the said policies, procedures and guidelines. That no services under this agreement shall be delegated or subcontracted without the express written permission of Department of Labor and/or ResCare. That ResCare may at any time, by written order, make reasonable requests for amendments and additions, within the general scope of this agreement, in the definition of services and tasks to be performed, the time, and the place of performance thereof. That the center dentist shall maintain confidential health records on each student. These records shall be maintained in accordance with all Department of Labor and Job Corps standards and shall be the property of the Department of Labor. That the center dentist shall make no public statements with respect to this agreement or its work thereunder and shall issue no public statements or advertising or conduct research related thereto without the prior written approval of the Center Director and the Department of Labor. That the subcontractor shall provide the center operator with current copies of professional licenses and insurance certificates. That it is understood and agreed that the services provided by subcontractor are subject to monitoring and review by ResCare and/or Department of Labor. The agreement shall be construed and enforced in accordance with the laws of the state of Florida. If any term of provision of this agreement is held to be illegal, invalid, void, and/or unenforceable, for any reason, such term or provision shall be fully severable; this agreement shall be construed and enforced as if such illegal, invalid, void, and/or unenforceable term or provision had never comprised a part of this agreement; and the remaining terms and provisions of this agreement shall remain in full force and effect. CENTER DENTIST SCOPE OF SERVICES The undersigned Center Dentist agrees to provide students of the Pinellas County Job Corps Center with the services stated here. Such services will be provided as authorized by the Center Director or his/her representative. Remuneration for services rendered will be at the rates set forth in the Center Dentist's fee schedule. The period of performance for this subcontract is from October 1, 2010 through July 31, 2011 with 3 additional option years ending July 31, 2014. The services to be provided will include, but will not be limited to, those oral health and wellness services specified in the Job Corps Federal Regulations (Title 20, Code of Federal Regulations 638.510; the Job Corps Policy and Requirements Handbook, Chapter 6, Section 6.10, R2; and applicable Technical Assistance Guides). The Center Dentist shall oversee the development, implementation and monitoring of the total Center oral health and wellness program, which is subject to the approval of the Center Director. Center Dentist shall provide adequate licensed personnel to perform dental and dental hygienic services for students, including but not limited to: Providing a mandated oral examination, to include 4 bite wings, and the development of an oral health and wellness plan between the 45 th and 75 th day after the student's arrival at the Center. Providing a written diagnosis and treatment plan as part of an oral health and wellness plan for each student and obtaining approval from the Center Director or Wellness Services Manager, or obtaining agreement for voluntary care, before proceeding with treatment. Establishing treatment according to priority classification and within programmatic and budget constraints. Providing basic dental care, as defined by the Job Corps Policy Requirements Handbook (PRH). Providing oral health education. Establishing an appropriate referral system to ensure the receipt of specialty care as defined in the PRH and within budgetary constraints. Providing or arranging for 24-hour emergency coverage. Participating in the coordination and integration of the oral health program with the wellness components, Center activities and Center-community activities. Maintaining the accuracy and confidentiality of all required oral health and wellness records when they are in the Center Dentist's presence. Providing support to the students in acquiring and practicing the oral health-related skills, knowledge and attitudes that will increase their employability. Developing and complying with Job Corps infection control policies and procedures. Reviewing and signing health Care Guidelines annually for dental care in accordance with the Technical Assistance Guide on Health Care Guidelines. Enforcing appropriate student workplace behavior when students are in the dental office or waiting area. Center Dentist and Dental Hygienist is required to comply with the Center's sign-in procedures, a log book containing sign-in sheet is kept in the health and wellness department and is updated and filed on weekly basis. Arranging appropriate medical separations in conformity with the PRH. Collecting data and preparing reports as required by the Center Director and/or the Department of Labor. Advising / consulting as requested with the Center Director and Center staff on oral health and dental programmatic issues. Cooperating with corporate and Regional Office Center assessments. Ensuring that regular preventive maintenance is provided to the dental equipment. The Center Dentist will adhere to the policies, procedures and guidelines established by Job Corps. It is understood that the services provided by the Center Dentist and Dental Hygienist are subject to monitoring and review by the Department of Labor. In the performance of the above duties and responsibilities, the Center Dentist: Shall maintain malpractice insurance to cover the professional services to students, with limits consistent with the medical service industry, but in no case less than $1 million per occurrence. Shall make no public statements regarding its activities or to disclose any information regarding Job Corps students or Job Corps activities without prior written approval of the Center Director or his/her designated representative. Unauthorized release of student records is a federal crime punishable by fine and/or imprisonment. Shall be responsible for finding and arranging for a professionally qualified replacement/substitute during temporary periods of absence of more than one calendar week. Shall be personally and financially liable for the cost of any patient referral without prior written approval of the Center Director. Certifies its intent to comply with all equal employment opportunity practices and affirmative action policies as required by law and agrees not to discriminate against any student, employee and/or contractor because of race, religion, color gender, age or national origin. Shall provide current copies of all professional licenses, certifications and professional liability insurance documents required by the Center. Agrees that all research projects and/or publications relating to Job Corps health activities will first be cleared through the National Office of Job Corps, Washington, D.C. To support the Center Dentist in the performance of its duties, the Center shall: Schedule students for dental exams and procedures, as required by Job Corps guidelines. Provide all U.S. Department of Labor, Office of Job Corps guidelines, handbooks, etc., required to operate the Job Corps Wellness Services Program. In consideration of the services to be rendered by the Center Dentist and, Center shall pay as follows: As the sole and entire compensation, the Center shall pay the Center Dentist at the rates set forth in the fee schedule. During the term, payment adjustments will not be considered without review of the work performed or unless the scope of effort required is significantly changed. All such changes in either the rate or the scope of work shall be authorized only by written amendment signed by all parties. The Center Dentist will submit an invoice at the end of each completed month for which services have been provided, approved by the Wellness Services Manager. The invoice must include the itemization of services provided and fees. The Center agrees to remit payment to the Center Dentist within 30 days of receipt of an approved, accurate invoice with applicable attachments
