Description
The U.S. Army Contracting Command-New Jersey, ACC-NJ, Picatinny Arsenal, New Jersey 07806-5000, on behalf of the Program Manager-Close Combat Systems (PM-CCS) intends to issue a Letter of Contemplation for the production of the XM50 Shock Tube Initiator (STI) NSN 1375-01-583-6388 and the Remote Activation Munition System (RAMS) MK152 NSN 1375-01-482-8372. The RAMS is a remote demolition-firing device capable of initiating explosive charges. The XM50 Shock Tube Initiator is an adapter to the M152 and MK152 RAMS which allows for the actuation of the in-line shock tube from the M16 or MK16 Receivers, respectively. The aforementioned items will be procured using the following ranges: STI: 1-250, 251-499, 500-999, 1000-1699, 1700-2500; MK152: 30-90, 91-215, 216-275, 276-400. The manufacture, inspection, testing and delivery of the above items shall be in accordance with the Technical Data Package (TDP); a portion of which is contractor owned/proprietary. The Government intends to fulfill this requirement via a Sole Source, Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contract modification to the existing IDIQ contract, W15QKN-07-D-0031, with Raytheon Technical Services Company LLC. The authority being utilized is in accordance with 10 U.S.C. 2304 (d)(1)(B) as implemented by FAR 6.302-1(a)(2)(ii) Only One Responsible Source and No Other Supplies or Services will satisfy Agency requirements. The use of FAR 6.302-1(a)(2)(ii) is deemed applicable to the RAMS and STI as award to any other source would result in substantial duplication cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency's requirement. The period of performance for this requirement will be twelve (12) months from date of award. It is anticipated that a Letter of Contemplation will be issued to Raytheon Technical Services Company LLC on or about 10 August 2012. The deadline for Contractor response will be 30 days after issuance of the Letter of Contemplation. A Government Owned Technical Data Package (TDP) will be provided as an attachment to this upcoming Letter of Contemplation. The highest Distribution Level for the TDP is Distribution D. Distribution is authorized to the Department of Defense (DoD) and US DoD contractors only to protect critical technical or operation data or information from automatic dissemination under the International Exchange Program or by other means as determined on 1 April 2008. This TDP contains data whose export is restricted by the Arms Export Control Act (Title 22, USC Sec 2751, et Seq) or the Export Administrative Act of 1979, as amended, Title 50, USC, App 2401 et. Seq. Violations of these export laws are subject to severe criminal penalties. Disseminate in accordance with provisions of DoD Directive 5230.25. This also applies to subcontractors at every level. All interested parties must submit an AMSTA- AR form 1350, Technical Data Request Questionnaire and a DD Form 2345, Military Critical Technical Data Agreement. These forms will be reviewed and evaluated prior to release of the TDP. Interested parties should request a copy of the forms and submit their request for the TDP for processing to the points of contact listed below. All responsible sources may submit a capability statement, proposal or quotation which shall be considered by the Government. THIS NOTICE DOES NOT CONSTITUTE A REQUEST FOR PROPOSAL (RFP) and is not to be construed as a commitment by the U.S. Government. Responses to this announcement are not proposals and cannot be accepted by the Government to form a binding contract.
