Description
Sole Source Synopsis: USPFO of Colorado intends to award a contract to Microsoft. The award will be made to develop a LMS software application for deployment to SharePoint, therefore making SharePoint the operating platform. Consequently, the solution assets shall be considered a "work made for hire" and that those solution assets become the sole exclusive property of the Client (Colorado National Guard). Solution assets include, but are not limited to, source code files and scripts for custom code work, including deployment, test and production, along with any technical documentation, program specifications, and any other documentation necessary to enable a reasonably skilled computer programmer to modify, customize, and create derivative works based on the Software Deliverables. This procurement is being made pursuant to 10 U.S.C. 2304(c) 1 and FAR Part 6.302-1, for other than full and open competition; only one responsible source and no other supplies or services will satisfy agency requirements. Microsoft consulting services has the unique ability to work directly with Microsoft staff that developed these technical solutions for the US Army and provide solutions to overcome the technical issues that they will be faced with in the application development of the LMS project tailored to our specific SharePoint Environment so we can maintain it going forward. No other company has this niche capability to look at the source code of the software products that we are utilizing and develop software solutions that will work within the confines of our environment. Any company that would attempt to deliver a similar solution would have to consult Microsoft to be able to provide such a software development solution. All interested sources must respond not later than 15 August 2012, 1200 hours MST. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
