- The United States Environmental Protection Agency (US EPA) intends to award a sole source fixed price purchase order under the authority of FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, Thermo Electron North America LLC for one year maintenance on the following equipment: one (1) TSQ Quantum Less GC (serial number TQU01566), one (1) Trace GC 2000 (serial number 32008111), and one (1) TriPlus Base Unit (serial number 20080069). These services will be rendered at the Chicago Region Laboratory. The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106 (b)(1). Efforts to acquire similar supplies, and/or develop alternate sources for this requirement would result in significant additional costs to the Government that are not expected to be recovered through competition. Past requirements for similar services has not resulted in the identification of any additional sources. Additionally, Thermo Electron North America LLC is the manufacturer of most components in this equipment and has direct access to replacements parts and software needed for this service. However, interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals, however all proposals received within five days after the date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
