Request for Information The Library of Congress ("Library") seeks public comments on the attached draft request for proposals as well as the attached principles for third-party digitization contracts. This is a Request for Information ("RFI") pursuant to 48 C.F.R. section 15.201(c)(7). This notice shall not be construed as a commitment by the Government or the Library to award a contract, grant, or cooperative agreement on the basis of responses to this RFI. The Library will not pay for the preparation of any information submitted in response to the RFI or for the Library's use of such information. This notice does not restrict the Government or Library to a particular procurement approach. This RFI should not be construed as a means to pre-qualify contractors. Based on the responses to this RFI, the Library may issue a Request for Proposals ("RFP") at an undetermined time in the future. PURPOSE The Library is interested in increasing the amount of its collections materials to be digitized and ensuring that such materials are made available as widely as possible. To that end, the Library seeks to institute a consistent process by which third parties could propose and enter into no-cost contracts with the Library to digitize Library collection materials. The purpose of this RFI is to solicit input from commercial and non-commercial entities in the digital content community, such as digital content publishers or distributors; educational institutions, libraries, archives, and others involved in the development of digital collections and dissemination of digital materials; and researchers and the public. This RFI focuses on topics such as the terms under which either commercial or noncommercial entities would enter into such digitization arrangement; the types of Library collections that might be most attractive to third-party digitizers and researchers; and the overall principles that might apply to solicitation and assessment of third-party digitization proposals. BACKGROUND Since the early 1990's the Library has relied primarily on its own resources to digitize materials in its collections, supplemented by occasional third party arrangements for the digitization of particular collections. In the interest of expanding the amount of material that eventually can be made available to the public, the Library is seeking to establish an open and transparent process whereby third parties can enter into no-cost digitization contracts with the Library. This request for comments includes draft third-party digitization principles formulated by the Library that have shaped the requirements in the draft RFP. The Library seeks comments on the principles as well as the draft RFP itself, and requests input regarding how best to address any potential barriers to or issues with the Library's proposed approach. RESPONSE INSTRUCTIONS Responses are not limited to specific page totals; however, brevity and structured format (such as bulleted items) are encouraged whenever applicable to aid in processing. Include a brief, no more than one (1) page, summary of the organization's background and digitization experience with your response. Respondents may submit comments or questions about the entirety, a portion of, or individual points relating to the draft RFP, the principles, or the sample projects list. Specific comments or questions in the response should cite to: (1) the relevant document (i.e., draft RFP, principles, or sample projects list) and (2) the relevant section number and/or page number and paragraph number. A copy of your organization's standard digitization agreement can be included as an attachment to your response, with key terms and conditions highlighted as appropriate. PLEASE DO NOT SUBMIT A DIGITIZATION PROPOSAL AT THIS TIME. The Library requires that responses be submitted electronically and prefers that responses be submitted in MS Word or pdf format. All information provided will be processed and analyzed confidentially. Respondents will not be notified of the results of this RFI.
