- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 8, West Palm Beach VA Medical Center (VAMC) 2.Description of Action: This is a request for other than full and open competition for the procurement an ArcCheck Standard Package for additional equipment for the Radiation Oncology Center from Sun Nuclear Corporation. 3.Description of Supplies or Services: The West Palm Beach VA Medical Center is requesting additional equipment to perform accurate IMRT QA in Rapid Arc IMRT and Static Beam IMRT in order to properly represent the treatment of each IMRT patient. This additional equipment will provide accurate measurements for dosimetrists diagnosing tumors. 4.Statutory Authority: (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Validity of Use of Statutory Authority: This piece of equipment attaches to existing Radiation Oncology equipment that performs diagnostic functions for patient care and is compatible with DHCT/VISTA systems. The ArcCheck system allows the dosimetrists to perform accurate 3-D measurements in order to pinpoint the size and dimensions of tumors before receiving radiation treatments. Sun Nuclear Corporation is the only manufacturer for this piece of equipment; therefore it's unique in its production. Sun Nuclear owns, develops and sells the equipment, which gives them proprietary rights over their equipment. 6.Actions to Promote Competition: A market survey was conducted to determine if any sources other than Sun Nuclear Corp. can provide the required services and do so as quickly as Sun Nuclear. No other sources were identified. 7.Determination of Fair and Reasonable Price: In my market research I Google and used GSA Advantage not finding any vendors who could provide the sources needed by our VA. In addition to my market research, I contacted 3 companies Agilent, Waters, and Beckman Coulter of which none were able to supply me with a quote for the items I was seeking. All 3 vendor's prices could not be included due to insufficient sources of products making SUN NUCLEAR CORPORATION to be the only source capable of providing the U.S. Government the sources it requires with a Fair and Reasonable Price. The anticipated price to the Government is $73,691.33. 8.Market Survey (FAR 10): Market research was conducted to identify alternative service providers as well as complete alternatives to the ArcCheck Standard Package. It was determined that no alternatives currently exist. 9.Other Considerations: This procurement is in high demand for veteran patients requiring radiation treatment. Due to an increase of veteran patients with cancer, the demand for radiation treatment has increased significantly and without proper equipment, treatment for patients will slow down and some patients may not survive long enough to receive the necessary treatment depending on their diagnosis. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: Since this order is a sole source and there are no other companies that can provide this type of treatment and no other companies were found in my market research. 11.Statement of Actions to Overcome Barriers to Competition: Future procurements will be posted to FBO. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. __________________________________________________ Olivia A.
