AMENDMENT NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is PR1883882 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-60. The associated North American Industrial Classification System (NAICS) code for this procurement is 334119 with a small business size standard of 1,000.00 employees.This requirement is unrestricted and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2012-08-28 16:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be Multiple shipping information. The Department of State requires the following items, Brand Name or Equal, to the following: LI 001, Servers, network equipment, IT security appliances, distributions systems and support services. All or nothing: Offers must be per complete requirement, i.e. all items and services. Incomplete offers will not be considered., 1, Lot; LI 002, Delivery charges (FOB) to U.S. Embassy Tbilisi, Georgia., 1, Lot; LI 003, Installation Services., 1, Lot; LI 004, Onsite Support Services., 1, Lot; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Department of State intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Department of State is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Offerors that require special considerations or assistance may contact the FedBid Helpdesk at 877-9FEDBID (877-933-3243) or via email at clientservices@fedbid.com. Offerors may not artificially manipulate the price of a transaction on www.FedBid.com by any means. It is unacceptable to place bad faith bids, to use decoys in the www.FedBid.com process or to collude with the intent or effect of hampering the competitive www.FedBid.com process.Should offerors require additional clarification, notify the point of contact or FedBid at 877-9FEDBID (877-933-3243) or clientservices@fedbid.com.Use of FedBid: Buyers and Sellers agree to conduct this transaction through FedBid in compliance with the FedBid Terms of Use. Failure to comply with the below terms and conditions may result in offer being determined as non-responsive. New Equipment ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. The buyer is allowing Sellers to submit bids for alternate products as long as the bid specification technically ?meets or exceeds? the needs to be fulfilled by the requested specification which shall be used in an on-going effort to upgrade an existing network. Sellers MUST enter exactly what they are bidding (model and description) on a separate page in order for the bid to be considered. The offeror should include ?descriptive literature? and drawings of the alternate products offered, illustrating that the offered item meets or exceeds the specifications of the requested items. It is the Seller?s responsibility to prove that the offered item meets the requested specifications. DESCRIPTIVE LITERATURE (a) "Descriptive literature" means information (e.g., cuts, illustrations, drawings and original manufacturers' brochures) that is submitted as part of an offer. Descriptive literature is required to establish, for the purpose of evaluation and award, details of the product offered that are specified elsewhere in the solicitation and pertain to significant elements such as (1) design; (2) materials; (3) components; (4) performance characteristics; and (5) methods of manufacture, assembly, construction, or operation. The term includes only information required to determine the technical acceptability of the offered product. It does not include other information such as that used in determining the responsibility of a prospective contractor or for operating or maintaining equipment. (b) Descriptive literature must be (1) identified to show the item(s) of the offer to which it applies and (2) received by the time specified in this solicitation for receipt of offers. (c) Data displaying more than one model or size shall be clearly marked so as to indicate the specific item being offered. (d) Offers which do not present sufficient information to permit complete technical evaluation by the Government may be rejected. Bid MUST be good for 30 calendar days after close of Buy. The seller must deliver the goods at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. Offeror must be registered in the Central Contractor Registration (CCR) database before an award can be made to them. If the offeror is not registered in the CCR, it may do so through the CCR website at http://www.ccr.gov. Delivery must be made within 60 days (preferred) or less after receipt of order (ARO). The Offeror must provide within its offer the number of days required to make delivery after it receives a purchase order from the buyer. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. The full text of the referenced FAR clauses may be accessed electronically at http://www.acqnet.gov/far. The selected Offeror must comply with the following DOSAR clauses not prescribed in FAR Part 12, which are incorporated herein by reference:DOSAR 652.225-71 SECTION 8(A) of the Export Administration Act of 1979, as amended (AUG 1999); DOSAR 652.242-73 Authorization and Performance(AUG 1999). In addition to providing pricing at www.FedBid.com for this solicitation, each Offeror must provide any required, NON-PRICING responses (e.g. technical proposal, representations and certifications, etc) so that they are received no later than the closing date and time of this solicitation. The Contracting Officer reserves the right to reject any and all incomplete proposals and to waive any information or minor irregularities in proposals received. The Contracting Officer reserves the right to reject any and all proposals that are unreasonably low or high in price. In determining price reasonableness, the Contracting Officer may use such sources as, but not limited to, the Independent Government Estimate (IGE), current labor rates and market prices. The following factors shall be used to evaluate offers: 1) Past Performance ? this shall include performance information on at least three project of similar nature and magnitude in the past 5 years. If the party actually performing the work is a subcontractor, include past performance information from the same. In addition to the past performance provided by the Offeror, the Government may evaluate any other past performance information on similar projects if known to the Government. 2) The Government will evaluate Offeror's Delivery Schedule. When the Government has accepted the delivery schedule and so awards a contract the shedule shall be binding upon the Contractor. 3) The Government will evaluate Offeror's Price proposal. Offeror shall propose a firm-fixed price for providing all items and required services. No additional sums will be payable on account of any escalations in the cost of materials, equipment or labor, or because of the Contractor?s failure to properly estimate or accurately predict the cost or difficulty of achieving the results required by the contract. Nor will the contract price be adjusted on account of fluctuations in currency exchange rates. 4) The Government will evaluate Offeror's Technical Merit ? that is, Contractor's technical capability, acceptability of the offered equipment and Onsite Support. Offeror MUST submit with its offer the following details: 1) Technical Support Plan, 2) Full Name and Address of Georgia-based representative that will provide installation services and onsite support in Tbilisi. Contract award will be made to the responsible Offeror whose offer, in conforming to the solicitation, provides an overall best value, considering Technical Merit, Past Performance, Delivery, and Price. The Government?s objective is to obtain the highest quality of technical solution considered necessary to achieve the program's objective with a minimum cost at a realistic and reasonable price and within a reasonable period. Technical Merit, Delivery and Contractor?s Past Performance, when combined, are more important than Price. However, between proposals that are evaluated as substantially equal in terms of Technical Merit, Delivery and Past Performance, Price will become a major consideration in selecting the successful Offeror. To be considered for award, all Sellers must be manufacturer authorized distributors of the equipment/services they are offering with a demonstrated capability of delivering the entire order within the timeframes specified by the Buyer on the award. Sellers will be required to provide documentation as proof of authorization to be considered for award. Please send this documentation to FedBid's client services team (clientservices@fedbid.com) prior to the close of this Buy. The Contractor and its employees shall exercise the utmost discretion in regard to all matters relating to their duties and functions. They shall not communicate to any person any information known to them by reason of their performance of services under this contract which has not been made public, except in the necessary performance of their duties or upon written authorization of the Contracting Officer. All documents and records (including photographs) generated during the performance of work under this contract shall be for the sole use and become the exclusive property of the U.S Government. Furthermore, no article, book, pamphlet, email, recording, broadcast, speech television appearance, film or photograph concerning any aspect of work performed under this contract shall be published or disseminated through any media without the prior written authorization of the Contracting Officer. These obligations do not cease upon the expiration or termination of this contract. The Contractor shall include the substance of this provision in all contracts of employment and in all subcontracts hereunder. Offerors shall submit questions as soon as possible but no later than 1600 hrs Central European Time on Tuesday, August 14, 2012.
