Description
NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 United States Code (U.S.C.) 2304(c) (1), as implemented by Federal Acquisition Regulation(FAR 8.405-6(a)(1)(i)(B)), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Mission and Instillation Contracting Command (MICC) Fort Jackson intends to make a sole source award to Kforce Government Solutions (KGS) to provide warranties for Patient Trauma FX Medical Simulators for the Medical Simulation Training Facility at Fort Jackson. This procurement is being conducted under Simplified Acquisition Procedures (SAP) Soliciting from a single source authorized by FAR Subpart 13.106-1(b) (1). For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The justification for the sole source requirements as follows: The Patient Trauma FX Medical Simulators that are being used by the Medical Simulation Training Facility were purchased from Kforce Government Solutions (KGS). Kforce Government Solutions own the patent and copy rights. There are no distributors or resellers that will be able to provide the warranties needed for this requirement, as such, they are the only company capable of providing warranty service for this equipment. The anticipated period of performance of the warranties is expected to be twelve months from the date of award. The North American Industry Classification System (NAICS) code for this requirement is 326199 and the size standard is 500 employees. Response to this notice must be received via email to the identified POC providing clear and convincing evidence of capabilities, qualifications and compatibility with the existing Patient Trauma FX Medical Simulators as well as convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities, pricing, and other information that demonstrates their ability to meet the Governments needs. Such qualifications and/or capabilities will be used solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. Requests should be marked with Referencing "Patient Trauma FX Medical Simulator Warranties". A determination by the Government not to conduct this effort as a full-and-open competitive procurement, based upon responses to this notice, is solely within the Government's discretion. This notice of intent to award is not a request for competitive proposals. However all proposals received by the appointed due date will be considered by the Government. A determination by the Government not to compete with this proposal based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A solicitation will not be issued. In the absence of qualified sources, a firm fixed price contract will be awarded under the Other than Full and Open Competition procedures, pursuant to 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The anticipated award date is August 27, 2012. Interested parties may identify their interest and capability to respond to the requirement or submit proposals. All inquiries must be submitted in writing to the contract specialist, Deon Wallace at deon.l.wallace@us.army.mil. Response to this notice must be received by 23 August 2012, no later than 12:00 PM Eastern Standard Time. Responses received after the aforementioned response time or without the required information will be considered non-responsive to this synopsis and will not be considered.
