- JUSTIFICATION AND APPROVAL FOR A LIMITED SOURCE AWARD UNDER A FEDERAL SUPPLY SCHEDULE 1.Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2.Description of Action: The proposed action is for a twelve (12) month firm-fixed-price (FFP) Task Order (TO), with one twelve (12) month option period, for the procurement of AT&T data connectivity for 100 third generation Apple iPad (hereinafter referred to as iPad 3) devices. This TO is proposed to be awarded under the General Services Administration (GSA) Federal Supply Schedule (FSS), Schedule 70, Special Item Number (SIN) 132-53, Wireless Services, Contract Number GS-35F-0297K. 3.Description of Supplies or Services: VA owns 100 Apple iPad 3 devices that contain hardware locked into the AT&T data plan. These Apple iPad 3 devices require the data connectivity service to be activated by AT&T for the required number of devices. Consequently, AT&T shall provide fourth generation (4G) data connectivity for the Apple iPad 3 devices, with fallback to third generation (3G) connectivity when 4G is unavailable. The data plan shall include no less than two (2) gigabytes of data per month, with a mechanism to prevent excessive usage charges. This mechanism can be through provision of an automated data cap. In addition, AT&T shall supply the required Subscriber Identity Module (SIM) chips for service activation. 4.Statutory Authority: The statutory authority permitting this limited sources justification is 41 U.S.C. 251 as implemented by Federal Acquisition Regulation (FAR) Subpart 8.405-6(a)(1)(i)(B) entitled, "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." 5.Rationale Supporting Use of Authority Cited Above: The proposed source for this action is AT&T Mobility LLC, 1025 Lenox Park Blvd NE, Atlanta, Georgia 30319-5309. The AT&T 4G Data Connect for Apple iPad 3 devices is required to support the mobility of both the Veteran and caregiver as part of a current pilot program to test "Clinic-in-Hand" (CiH) applications. The CiH is intended to establish VA's first patient-facing mobile health application that is integrated with Veterans Integrated System Technology Architecture (VistA) systems including the VA Electronic Health Record (EHR), MyHealtheVet, and the Computerized Patient Record System (CPRS). The goal of the pilot is to place Veterans and caregivers of Veterans at the center of their health care through the use of mobile technology such as the Apple iPad 3. This program allows VA to create mobile health applications designed for the patient and caregiver. Also, these applications allow the patient to more effectively manage and interact with the health care services delivered by VA. At the time of purchase, Apple iPad 3 devices have built in data connectivity specific to a data plan vendor; currently, only two vendors can provide the required data plan services, Verizon and AT&T. VA currently owns 1,074 Apple iPad 3 devices of which 100 have built in AT&T data connectivity and 974 have built in Verizon data connectivity. Once purchased, these devices are locked into a specific data plan vendor whose chipset is permanently embedded into the device. Only the AT&T 4G Data Connect plan can provide the 100 currently owned AT&T specific Apple iPad 3 devices with the required 4G connectivity. Though the same or a similar connectivity is offered by Verizon, these services cannot be supported on the 100 AT&T carrier specific Apple iPad 3 devices. The 1,074 Apple iPad 3 devices will require the data service to be activated to provide connectivity for the Veteran without the limitations of a Wi-Fi network. 6.Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.202(a)(13)(i), this effort is exempt from synopsizing since the proposed action is for an amount not expected to exceed the simplified acquisition threshold. 7.Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. Additionally, a separate contract action will be issued for the aforementioned 974 Verizon iPad 3 devices. It is anticipated that this contract action will not be competed because of the permanently embedded Verizon chipset. 8.Other Facts: This requirement has been reported in the Forecast of Contracting Opportunities database.
