VA intends to award this contract under the authority of 41 U.S.C. 253(c) (1), as implemented by Federal Acquisition Regulation (FAR), Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." VA's Office of Security and Law Enforcement has an annual requirement for uninterrupted access to the International Justice and Public Safety Network, formerly known as the National Law Enforcement Telecommunications System, Inc. (Nlets). Nlets is primarily a message switch that electronically links state, territory, local, Federal and international entities involved in law enforcement, criminal justice, and public safety. Its purpose is to provide the capability to access and exchange the information transmitted through its message switch. The information accessible through the Nlets switch includes a vast array of state and local information found in state private and commercial driver information, driver's licenses, criminal histories, wants and warrants, missing persons, unidentified persons, stolen or missing property, and a multitude of other relevant state, Federal and international databases. Nlets is the only known source that satisfies this essential security and law enforcement requirement. The Government intends to award this requirement in accordance with FAR 13.106(b)(1). Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within fifteen days after the date this notice is published will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
