- Bureau of Indian Affairs, Office of Justice Services, Anonymous Crime Reporting Service B - Anonymous Crime Reporting Service for the Bureau of Indian Affairs (BIA), Office of Justice Services (OJS). This is a combined synopsis/solicitation for other than commercial items prepared in accordance with the format in FAR 15, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation, Anonymous Crime Reporting Service, is issued as a Request for Proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Regulation (FAR). The North American Industry classification (NAICS) code is ------. This acquisition is being solicited as Full and Open Competition. The resultant contract will be awarded as a firm fixed price contract as defined in FAR 16.202, with a base period plus four option periods. The Base Period of Performance (POP) shall be from October 1, 2012 to September 30, 2013. The Government intends to make a single contract award using the following CLIN structure. CLIN 001: Anonymous Crime Reporting Service, Base Period, Price: __________ CLIN 002: Anonymous Crime Reporting Service, Option One, Price: __________ CLIN 003: Anonymous Crime Reporting Service, Option Two, Price: _________ CLIN 004: Anonymous Crime Reporting Service, Option Three, Price: __________ CLIN 005: Anonymous Crime Reporting Service, Option Four, Price: __________ Note 1: The price for each CLIN shall be inclusive of all personnel and labor costs, materials, taxes, and other costs for the performance and completion of the contract. BUREAU OF INDIAN AFFAIRS, OFFICE OF JUSTICE SERVICES, OPERATIONS DIVISION STATEMENT OF WORK Anonymous Crime Reporting Service C.1 BACKGROUND Based on statistical data, crime in Indian County is increasing and crimes have become more complex. Criminal offenders have become savvy when committing crimes and it is becoming increasingly difficult to solve crimes. Most crimes involve an eyewitness and/or information disclosed to other people who have knowledge about a crime, including criminal information communicated by the offenders themselves. Historically, witnesses in Indian Country or people who obtain information about a crime are reluctant to report crimes to authorities due to the fear of retaliation placing themselves or loved ones in danger, or they feel embarrassed because the offender may be a friend, relative, etc. Witnesses or other people who report information on a crime assist law enforcement agencies in creating additional leads to solve crimes. An anonymous crime reporting tool is a valuable asset to law enforcement organizations in aiding investigations. Indian Country acknowledges the benefits and promotes the use of an anonymous crime reporting tool. C.2 SCOPE OF WORK The Bureau of Indian Affairs, Office of Justice Services, requires a safe, secure, and anonymous telephone reporting system and internet based website service for use by tribal and non-tribal reservation residents, reservation visitors, and others who have information regarding any type of crime or threat, and who wish to report information by anonymous crime reporting services. The anonymous crime reporting service is for all law enforcement programs located within the BIA Office of Justice Services as identified by the BIA Office of Justice Service Law Enforcement Program. C.3 DEFINITIONS BIA: Bureau of Indian Affairs COR: Contracting Officer's Representative, the individual designated and authorized in writing by the Contracting Officer to be responsible for surveillance and monitoring of the Contractor's performance. Contractor - The term herein refers to both the prime Contractor and any subcontractors. The prime Contractor shall ensure that all subcontractors comply with the provisions of this contract. OJS: Office of Justice Services Contracting Officer (CO) - The individual with the authority to enter into, administer, modify, make determinations, and/or terminate the contract, on behalf of the Government. Indian Country: A term as defined in Section 1151 of Title 18, United States Code. "(a) all land within the limits of any Indian reservation under the jurisdiction of the United States Government, notwithstanding the issuance of any patent, and, including rights-of-way running through the reservation, (b) all dependent Indian communities within the borders of the United States whether within the original or subsequently acquired territory thereof, and whether within or without the limits of a state, and (c) all Indian allotments, the Indian titles to which have not been extinguished, including rights-of-way running through the same." C.4 PERFROMANCE TASKS It is in the best interest of the Government, Bureau of Indian Affairs, and the Office of Justice Services to acquire anonymous crime information and provide an absolute anonymous crime reporting resource available to all tribal and non-tribal residents, visitors, businesses, and others throughout Indian Country communities nationwide within the BIA and Tribal jurisdiction to include P.L. 93 638 contracted law enforcement programs who are within the BIA Operations Division. The following are tasks to be completed by the Contractor. C.4.1 The Contractor shall maintain the availability and capacity of a toll-free nation-wide crimes telephone hotline and internet based website reporting service, 24-hours a day, 365 days per year. C.4.1.1 The Contractor shall make no changes to the crime reporting toll-free telephone number(s) and website URL of the anonymous crime reporting service for the duration of the contract. C.4.1.1 The service area shall include the entire United States, including Hawaii and Alaska, Puerto Rico, the U.S. Virgin Islands, portions of Canada and Mexico including all Native American Indian reservations and areas designated as Indian Country. C.4.1.2 The Contractor shall provide and make available an internet based anonymous crime-reporting website throughout the world regarding any major crime including violent crimes, misdemeanor crimes, property crimes, fraudulent crimes, and corporate crimes occurring within Indian Country. C.4.2 The Contractor shall not restrict the crime reporting service by jurisdictional law enforcement lines or perimeters, regardless of city, county, state, federal, tribal, and other jurisdictions and shall relay all crime tip information to any applicable and relevant tribal, local, state, federal, and other allied international law enforcement agency. C.4.3 The Contractor shall have standard operating procedures for immediately reporting the information to the law enforcement organization C.4.4 The Contractor shall provide the maximum amount of information possible to law enforcement agencies to enable them to properly and promptly conduct an investigation based on the anonymous information received. C.4.5 The Contractor shall provide sufficient culturally and socially appropriate customized BIA and tribal, posters, flyers, literature, presentation material, and internet advertising for community use or disbursement for community outreach to solicit public awareness to encourage crime reporting to the most advantageous extent. These materials may include input from the BIA law enforcement and shall be approved by the COR prior to disbursement to each agency/location listed on Attachment No. One (1). C.4.6 The Contractor shall provide appropriate and cost effective technical assistance on the use of the anonymous crime reporting hotline and internet based website. C.4.7 The Contractor shall be a neutral third party business. C.4.8 The Contractor shall guarantee total anonymity for the individual providing information, with no exceptions. C.4.8.1 The Contractor shall guarantee anonymity on all personal identifiers used to identify the reporting party. C.4.9 The Contractor shall provide live operators staffing the phone. C.4.10 The Contractor under no circumstances shall use an answering machine or answering service. C.4.11 The Contractor shall have standard operating procedures for the anonymous monetary reward process. C.4.12 The Contractor shall advertise, offer, and pay appropriate anonymous monetary rewards when information leads to an arrest and conviction or appropriate adjudication. C.4.13 The Contractor shall have a standard operating crime reporting process that urges the caller not to provide their identity in any manner. C.4.14 The Contractor shall use a script which shall include questions that are developed in coordination with the COR to assist law enforcement in obtaining the maximum amount of information possible. C.4.15 The Contractor shall have a crime database where information is submitted and disseminated to law enforcement agencies. C.4.16 The Contractor shall provide bilingual speaking operators, when necessary. C.4.17 The Contractor shall ensure no taping, tracing, or caller ID methods are utilized. C.4.18 The Contractor's quarterly reports shall include service data regarding: the number of contacts with the agencies listed in Attachment A and COR, in which anonymous crime information was provided or other service. The service data shall include information provided such as technical assistance, audio and visual crime prevention materials and quantities, specific printed literature and posters, and any other pertinent services provided within the scope of the contract. C.4.18.1 The Contractor shall maintain detailed accurate reports and submit quarterly reports to the COR on the 15th of each month following each quarter. The quarterly reports shall encompass the following months: First quarter: October to December; Second quarter: January to March; Third quarter: April to June; Fourth Quarter: July to September. Any quarterly report shall be made available to the BIA OJS upon request. C.4.19 The Contractor's quarterly reports shall include call and internet data regarding: Statistics and demographics of the incoming caller(s) and tips, the agency in which the tip was forwarded to, and details of the type/category of criminal activity reported. The Office of Justice Services and the COR will respect the anonymity of the caller and service. C.4.19.1 The Contractor shall maintain detailed accurate reports and submit quarterly reports to the COR on the 15th of each month following each quarter. The quarterly reports shall encompass the following months: First quarter: October to December; Second quarter: January to March; Third quarter: April to June; Fourth Quarter: July to September. Any quarterly report shall be made available to the BIA OJS upon request. C.5 ADDITIONAL REQUIREMENTS When the Contractor is uncertain of where to route information, the BIA, Office of Justice Services, Albuquerque Office shall be contacted to provide routing assistance. The Point of Contact information will be provided upon contract award. C.6 SERVICE AREAS The law enforcement programs which shall receive the anonymous crime reporting services are identified in Attachment No. One (1). In addition to the service areas identified in Attachment No. One (1), the service areas shall include three Indian properties. 1. Santa Fe Indian Hospital, Santa Fe, New Mexico 2. Santa Fe Indian School, Santa Fe, New Mexico 3. BIA property located at Indian School and Twelfth Street, Albuquerque, New Mexico, 87104. These are areas legally defined as Indian Country and BIA Law Enforcement Services provides law enforcement services. The properties described will fall under the agencies which have statutory jurisdiction, and not be considered as separate agencies for contractual purposes. C.7 GOVERNMENT-FURNISHED PROPERTY No Government Furnished Property will be provided in the performance of the contract. C.8PLACE AND PERIOD OF PERFORMANCE C.8.1 The Contractor shall provide services in 50 states, on or near American Indian reservations throughout the United States, Indian Country, and other areas identified in Section C.4 and C.6. Contractor telephone line(s), internet services, and report generation shall take place at the Contractor's facility. C.8.2 The Period of Performance shall be: Base Period: October 1, 2012 to September 30, 2013 Option Period One: October 1, 2013 to September 30, 2014 Option Period Two: October 1, 2014 to September 30, 2015 Option Period Three: October 1, 2015 to September 30, 2016 Option Period Four: October 1, 2016 to September 30, 2017 C. 9 KEY PERSONNEL A requirement of this contract is to maintain stability of personnel proposed in order to provide high quality service and deliverables. The Contractor agrees to assign only those key personnel with experience and expert knowledge required in the performance of this contract. The contract shall not make any substitution or additions to the key personnel without a written justification, resume, and request to the COR. Upon the COR's approval, the request will be submitted to the Contracting Officer for final consideration of the Government's best interest and approval. C.10 RECORDS/DATA SAFEGUARDS For complete text see SF 33 C.11 PACKAGING AND MARKING All correspondence including emails, invoices, and contract deliverables shall identify the contract number. Attachment 1: For complete list see SF 33 INSTRUCTION TO OFFERORS Questions Offerors shall submit questions (if any) related to the RFP via email no later than 2:00 pm, September 17, 2012. Questions not received within a reasonable time prior to the closing date may not be considered. Submission of Proposals 1. The proposal due date is September 20, 2012, 2:00 PM Mountain Daylight Savings Time. 2. The proposal shall be packaged for delivery so as to permit safe and timely arrival at destination. Faxed proposals will not be accepted. The proposal package should be sent or hand delivered to the following address: BIA, Albuquerque Acquisition Office, Attn: Yvette Washington, Contracting Officer 1001 Indian School Road, Ste 347 Albuquerque, NM 87104 3. Proposals submitted by email will be accepted. Email to: Yvette.Washington@bia.gov Email submissions shall be limited to attachments compatible with Microsoft Office Word 2007 and/or files with a.pfd file extension. Email submissions shall not exceed 5MB total in size. 4. Proposals submitted by the express mail method shall be sent with sufficient time to allow for a timely delivery. The Offeror is solely responsible for ensuring its quote arrives in a timely manner. An offeror that fails to meet the due date will be considered "late" in accordance with FAR 52.212-1(f). 5. The proposal acceptance period is 60 days after the date set for receipt of the proposal. The Offeror shall make a clear statement in the proposal that the proposal is valid until this period has ended. 6. Proposal Preparation Costs: The Government is not obligated to pay any costs incurred by an offeror for the preparation and submission of a proposal in response to this RFP. 7. Contents of Proposals. The contractor shall submit a written proposal to include the following: The Proposal Cover Letter is limited to 1 page. Factor 1: Past Performance - Past Performance is limited to 5 pages. A list of references is limited to 2 pages. Factor 2: Knowledge and Experience - Knowledge and Experience narrative is limited to 3 pages. The following required documents will not be counted in the Knowledge and Experience page limitation: (a) Key Personnel Resume(s) are limited to 2 pages for each person. Factor 3: Technical Capability - Technical Approach is limited to 5 pages. Price: Complete CLIN structure on the Standard Form 1449. 8. The proposal shall include a completed copy of the provision; FAR 52.212-3 Offeror Representations and Certifications-Commercial Items. EVALUATION OF PROPOSALS PART A. Evaluation of Proposals 1.The source selection will be conducted in accordance with FAR Sub-Part 15.3 with the intention to award a single fixed-price contract with option periods. 2.Evaluation Scoring: The Government will evaluate all offerors according to the following color system. Blue: The response is very comprehensive, in-depth, and clear. The Proposal consistently meets the solicitation requirements with no omissions. Consistently high quality performance can be expected. Green: Extensive, detailed response to all requirements, similar to outstanding in quality but with minor areas of unevenness or spottiness. High quality performance is likely but not assured due to minor omissions or areas where less than excellent performance might be expected. Yellow: The response generally meets requirements, but there is no expectation of better than acceptable performance. Deficiencies are confined to areas with minor impact on performance and can be corrected during negotiation without minor revision to the proposal. Orange: The response fails to meet one or more requirements. Deficiencies exist in significant areas, but can be corrected during negotiations without major revision to the proposal, or serious deficiencies exist in areas with minor impact. Red: Serious deficiencies exist in significant areas. The proposal cannot be expected to meet the stated requirements without major revisions. The proposal only indicates a willingness to perform in accordance with the requirements document without specifying how or demonstrating the capability to do so. Only vague indications of the required capability are present. PART B. Evaluation Criteria FACTOR 1: PAST PERFORMANCE. The Past Performance narrative shall be in as much detail as the offeror considers necessary to fully explain the offeror's past performance. The offeror's past performance must be recent, having been performed in the last five (5) years. The offeror must describe how its past performance is on a scale similar in size to this requirement. The strength of the offeror's response will be based on the planning and implementation stages of anonymous crime reporting services. Specifically, the offeror shall demonstrate their ability to effectively plan and implement services. Provide reference information including: Contract number, duration of contract performance, award amount, phone number for Contracting Officer's Representative/points-of-contact. When evaluating past performance, the Government will focus on the areas of Quality of Service, Timeliness of Performance, Price/Cost Control Mechanisms, and Customer Satisfaction. FACTOR 2: KNOWLEDGE AND EXPERIENCE The offeror shall demonstrate that current and proposed staff have the appropriate range of relevant applied experience to help law enforcement by providing a crime reporting tool. The offeror shall also demonstrate knowledge and experience by submitting resume(s) for key personnel. Key personnel are defined as those individuals the offeror views as essential to successfully performing the technical approach in compliance with the SOW. FACTOR 3: TECHNICAL CAPABILITY Technical Approach. (1) The Technical Approach shall be in as much detail as the offeror considers necessary to fully explain the technical approach. (2) The technical approach shall clearly and concisely demonstrate the offeror has an understanding of the nature of work to be performed successfully as required by the Statement of Work (SOW), and an understanding of the Bureau of Indian Affairs, Office of Justice Services, goals and objectives. The technical approach shall include, but is not be limited to the following: (a) Description of the processes the offeror proposes to use to provide anonymous services to address the conditions and challenges in Indian Country which may affect completing the contract and task requirements in the SOW; (b) Description of the conditions and challenges which can affect achieving the Bureau of Indian Affair, Office of Justice Service's goals and objectives; (c) The offerors proposed method of accomplishing Task C.4.5; and The offerors proposed method of accomplishing Task C.4.12. PRICE FACTOR: The Government will evaluate each offeror's price for fairness and reasonableness. The Government expects adequate price competition to establish fair and reasonable pricing. The price detail shall include sufficient descriptions to enable the Contracting Officer to determine the reasonableness of the price submitted. Unrealistically high (or low) pricing in the initial or revised proposal may be grounds for eliminating a proposal from competition - either on the basis that the offeror does not understand the requirement or has made an unrealistic proposal. The Government will review: (1) proposed prices to determine whether they are materially balanced; and (2) any unbalanced offer to assess the associated risks to the Government in awarding to such an offeror, and (3) whether an award will result in unreasonably high or low price for contract performance. An offer may be rejected if the contracting officer determines the lack of balance poses an unacceptable risk to the Government. The Government will determine each offer's total evaluated price by summing the base year and all option periods in accordance with the prices using the following CLIN's (form 1449): CLIN 1: Base Period, October 1, 2012 to September 30, 2013 $_______________ CLIN 2: Option Period One, October 1, 2013 to September 30, 2014 $___________ CLIN 3: Option Period Two, October 1, 2014 to September 30, 2015 $___________ CLIN 4: Option Period Three, October 1, 2015 to September 30, 2016 $___________ CLIN 5: Option Period Four, October 1, 2016 to September 30, 2017 $____________ Total Price: $___________________ Price proposals shall include cost buildup details to identify: 1.The price per agency/service unit 2.Direct cost elements, (e.g. labor, materials, etc); 3.Indirect cost elements, (e.g. labor overhead, general and administrative expense, etc), and profit. 4.Inclusive of any Federal, State, and Local taxes, in accordance with FAR 52.212-4, and FAR 52.229-04, FAR 52.222-41 Service Contract Act of 1965, place unknown, DOL wage rates. BASIS OF AWARD: The Government will make an award based upon best value. Evaluation factors other than cost or price, when combined are equally important to cost or price. The evaluation factors other than price are as follows in equal order of importance: (a) Past Performance; (b) Knowledge and Experience; and (c) Technical Capability. Best overall value to the Government will be determined by comparing differences in technical merit with differences in price. In making this comparison, the Government is more concerned with obtaining superior quality. However, the Government will not make an award at a significantly higher cost to the Government to achieve only slightly superior technical merit. The Government reserves the right to make an award based on initial offers and without discussions. All requirements must be addressed in the proposal. Omissions of response may be considered non-responsive and may not be evaluated. If exchanges are necessary, the Government will conduct exchanges consistent with FAR 15.306, Exchanges with offerors after receipt of proposals.
