AMENDMENT NOTICE:This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is RFQP02181200008 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-60. The associated North American Industrial Classification System (NAICS) code for this procurement is 333120 with a small business size standard of 750.00 employees.This requirement is unrestricted and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2012-09-14 14:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be Multiple shipping information. The Federal Bureau of Prisons requires the following items, Brand Name or Equal, to the following: LI 001, TEAMCO M8000 MD SNOWBLAST SNOWBLOWER, OR EQUIVALENT, MUST BE ABLE TO ATTACH TO A CASE M721F WHEEL LOADER, PRICE MUST INCLUDE SHIPPING AND INSTALLATION. PRODUCT MUST BE UNDER WARRANTY. MUST BE ABLE TO CLEAR A THREE ACRE FIELD IN ONE HOUR., 1, EA; LI 002, CRAIG WING AND PLOW, OR EQUIVALENT, MUST BE ABLE TO ATTACH TO A CASE M721F WHEEL LOADER, PRICE MUST INCLUDE SHIPPING AND INSTALLATION. MUST BE ABLE TO CLEAR A THREE ACRE FIELD IN ONE HOUR., 1, EA; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, Federal Bureau of Prisons intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. Federal Bureau of Prisons is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. All items must be covered by the manufacturer's warranty. Bid MUST be good for 30 calendar days after close of Buy. Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. Offeror must be registered in the System for Award Management (SAM)before an award can be made to them. This requirement is not needed or any offeror who was previously regisistered in the CCR database, those offerors only need to ensure their SAM information is still current and active. If the offeror is not registered in SAM, it may do so through the SAM website at https://www.sam.gov/portal/public/SAM The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1 (FEB 2012), Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4 (FEB 2012), Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. (a) If an item in this solicitation is identified as ?brand name or equal,? the purchase description reflects the characteristics and level of quality that will satisfy the Government?s needs. The salient physical, functional, or performance characteristics that ?equal? products must meet are specified in the solicitation. (b) To be considered for award, offers of ?equal? products, including ?equal? products of the brand name manufacturer, must? (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by? (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications. (c) The Contracting Officer will evaluate ?equal? products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an ?equal? product, the offeror shall provide the brand name product referenced in the solicitation. Faith based and community based organizations can submit offers/bids/quotes equally with other organizations for contracts which they are eligible [end of clause] a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests taht are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer by obtaining written and dated acknowledgment of receipt from: Procurement Executive, Federal Bureau of Prisons, 320 First Street, NW, Washington, DC 20534 (b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO (end of provision) Each quoter shall complete the attached form and submit a copy with their quote, 52.212-3 Offeror Representations and Certifications - Commercial Items (Apr 2013) (Required only if the companies REPS and CERTS section has not been completed in SAM). Failure to do so may cause your quote to be considered unacceptable. ?Offers and Bidders? here are interchangeable with ?quoters?. For three of the five years immediately prior to submission of an offer/bid/quote, or prior to performance under the contract or commitment, individuals or contractor employees providing services must have: 1. Legally resided in the United States (U.S.) ;2. Worked for the U.S. overseas in a Federal or military capacity;3. Been a dependent of a Federal or military employee serving overseas. By signing this agreement/commitment document, or by commencing performance, the contractor agrees to this restriction Pursuant to FAR 42.202 and 42.302, upon award, the undersigned Contracting Officer hereby assigns as the Contract Administration Office (CAO), FCI Berlin, Business Office, 1 Success Loop Road, Berlin, NH 03570, Attn: Contracting Office. This assignment carries with it the authority to perform all of the normal contract administration functions listed in FAR 42.302 (a), Item 1 through 70, to the extent that those functions apply to this contract. This assignment also includes delegation of authority to perform those negotiation functions as specified in FAR 42.302 (b), items 1 through 11. The employees of the contractor entering the institution may be required to meet certain security requirements prior to entering the institution. Primary concerns are the amount of contact that may occur between the contractor and his/her employees with the inmate population during the performance of the contract. Contractor employees are allowed access to the institution at the sole discretion of the Warden of the institution. The program manager at FCI Berlin is responsible for conducting the appropriate law enforcement check on all contractor staff that may need access inside the prison facility. The following investigative procedure will be performed: 1). National Crime Information Center (NCIC) check; 2). DOJ 99 (Name Check); 3). FD 258 (fingerprint check); 4). Law Enforcement Agency checks; 5). Vouchering of Employers; 6). Resume/Personal Qualifications; 7). OPM 329 A (Authority for Release of Information); 8). National Agency Check and Inquiries (NACI) check (if applicable); and 9). Urinalysis Test (for the detection of marijuana and other drug usage) By submitting a quote, the contractor and its employees agree to complete the required documents and undergo the listed procedure. An individual who does not pass the security clearance will be unable to enter the BOP facility. Any individual employed by the contractor who is deemed not suitable by the BOP requirements will not be granted access to perform services under the contract. This is a condition of the contract. Finally, the contractor shall be in compliance with 8 CFR 274a regarding employment of aliens. Quoters should submit a completed copy of the Schedule of Items inclusive of all charges (i.e., shipping, installation, wages, insurance, overhead, profit, etc.). This acquisition will be procured in accordance with FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. The Government intends to evaluate quotes and award to a quoter, pursuant to an affirmative determination of responsibility, whose quote, conforms to the solicitation, and is determined to be the best value to the Government. Items will be shipped to the warehouse at FCI Berlin, Business Office, 1 Success Loop Road, Berlin, NH 03570 during normal business hours (800 am to 300 pm EST).
