Description
JUSTIFICATION AND APPROVAL FOR EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: The proposed action is for a one year, firm-fixed- price delivery order with four one-year option periods issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV, Government Wide Acquisition Contract (GWAC) for Network Appliance (NetApp) Support Edge Premium Maintenance and Support Services to include Non-return Disk Service. NetApp hardware maintenance and support is to support the engineering efforts and maintain the current environment already in place at testing facilities managed by Enterprise Systems Engineering (ESE). 3. Description of Supplies or Services: Office of Information and Technology (OI&T), has a requirement for NetApp Support Edge Premium Maintenance and Support Services to include Non-return Disk Service for the below associated quantities of existing hardware. The proposed action is to provide NetApp expert on-site and remote support for the Veterans Affairs (VA) enterprise and data center during the period of performance. Coverage shall include appliances with serial numbers: 700000491671, 700000491669 and 5001353533. The contract has a one year base period with four one-year options periods. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: This NetApp hardware maintenance and support will be used to support the engineering efforts and maintain the current environment already in place at testing facilities managed by ESE. The aforementioned hardware continues to provide testing solutions of various software and configuration changes without disruption of the currently fielded network. Procuring an alternative product versus using brand name will introduce the opportunity for errors to go undetected during testing. Using equipment other than what is currently deployed may mask the error or not precisely replicate the conditions that caused it to occur. This could cause errors to go undetected during testing and subsequently produce application failures after deployment and/or create patient safety incidents within the supported applications. The latter situation, a patient safety incident, refers to a situation where an information technology (IT) product or system produces erroneous results that go undetected and have a direct, negative impact on the life-safety of patients; this poses an unacceptable risk. Furthermore, utilizing another brand name item would increase training costs and the usage of data center space due to the need to maintain multiple infrastructures. This would result in a substantial duplication of costs that would not be recovered. The continued support and maintenance of NetApp hardware is needed to ensure that ESE is able to effectively and efficiently provide support to their internal and external customers. By using NetApp support and maintenance, the aforementioned risks to patient safety are mitigated. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition is anticipated for the aforementioned brand name NetApp maintenance and support. Furthermore, in accordance with FAR 5.3, and 16.505(b)(2) this action will be synopsized on the Federal Business Opportunities (FBO) website at https://www.fbo.gov. In addition, this Justification and Approval (J&A) will be made publicly available on the FBO Page. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying brand name items, there are authorized resellers of these products and services on the NASA SEWP IV GWAC. In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are any products available that will enable future requirements to be competed. 8. Market Research: On May 10, 2012, a Request for Information (RFI) was submitted via NASA SEWP IV GWAC, with a deadline of May 15, 2012 at 3 P.M., only one response was received. While only one contract holder provided a response, it is possible for other contract holders to add the product solution in time to also provide a quote. Additional market research was conducted on June 11, 2012 utilizing NASA SEWP IV Manufacturer Lookup tool. It was determined that there are a total of 32 vendors offering NetApp products. Authorized Resellers are as follows: Five from Group A- Value Added Reseller (VAR) & Computer Systems Original Equipment Manufacturer (OEM), six from Group B- Service Disabled Veteran Owned Small Business (SDVOSB), 12 from Group C- Small Business Set Asides- VARs and nine from Group D- VARs. Per the terms of the NASA SEWP IV contract, requirements for brand name specific products should be solicited to all four (4) contract groups (A, B, C, D) in order to fully notify all interested parties. However, since there is adequate competition among small businesses, quotes will only be accepted from Groups B (SDVOSB) and C (small busineses). 9. Other Facts: None
