- Contracting Activity: 36 th Contracting Squadron Project/Program Name: Mobile Office Rental Estimated Contract Cost (including options): $484,184.53 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. Contracting Activity 36 th Contracting Squadron, Andersen AFB, GU Justification for Other Than Full and Open Competition. PR# F1C3472251A003. II. Nature and/or Description of the Action being processed A firm fixed price single award contract for the rental of mobile office containers. III. Description of the Supplies/Services required to meet the agency's needs Under the contemplated contract, KwikSPACE Guam will rent to the US government 5 double wide and 2 single wide mobile offices for the period of September 21, 2012 through 21 December, 2012. Additionally, the contract will include 2 single-wide and 6 double-wide mobile offices for the period of September 22, 2012 through December 21, 2012. The contract will also include two 1-month option periods. Estimated value including options is $484,184.53. IV. Statutory Authority permitting other than full and open competition FAR 6.302-5(b)(5) - Authorized or Required by Statute - Sole source awards under the HUBZone Act of 1997. V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (Applicability of Authority) KwikSPACE Guam is a HUBZone SDVOSB. Based on market research, there is no reasonable expectation that offers would be received from two or more HUBZone small business concerns due to the time constraints of this requirement. VI. Description of Efforts made to ensure that offers are solicited from as many potential sources as deemed practicable Several local companies on Guam, Saipan and Tinian were contacted. Of those contacted, only one company stated that they rented mobile offices; however, they do not have any available at this time. During previous market research, four local companies were contacted; all of whom responded that they do not provide this type of rental service. In addition, off-island market research was conducted and found that several companies, if given the opportunity and advance notice, could provide the required services. However, due to the time constraints of this requirement, these companies would not be able to provide a quote. Unfortunately, due to the nature of the exercises occurring on Andersen AFB, the specific requirements are not identified in time to allow most vendors to compete. A plan is currently in place to solicit for an indefinite-delivery requirements contract to allow stateside vendors to compete. VII. Determination by the Contracting Officer that the Anticipated Cost to the government will be fair and reasonable In addition to using KwikSPACE's GSA contract pricing which has already been determined fair and reasonable, the prices will be compared to prices from other companies that rent the same or similar items. VIII. Description of the Market Research conducted and the results, or a statement of the reasons market research was not conducted Several companies from Guam, Tinian and Saipan were contacted to find other providers of mobile offices. Three companies on Guam stated that they purchased their mobile offices from KwikSPACE. One company in Saipan has rented mobile offices in the past; they could not provide the price that was previously charged. One company on Guam, Smithbridge, currently rents mobile offices; however, they have none available and will not have any for the next year as they are all being utilized. Additionally, previous market research conducted for recent acquisitions included an examination of the US SBA Small Business Dynamic Search master database and issuing a sources sought notice on the Federal Business Opportunities website. Several national companies confirmed that if given sufficient lead-time, they would be able to provide the required items/services. IX. Any Other Facts supporting the use of other than full and open competition None. X. List of Sources, if any, that expressed interest in the acquisition Three companies located in CONUS expressed interest to a previously posted Sources Sought for a similar project. One local construction company expressed some interest for future acquisitions. XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to Competition before making subsequent acquisitions for the supplies or services required Prior to the last acquisition for rental of mobile offices, a team was established to conduct extensive targeted market research and hopefully establish an indefinite-delivery requirements contract. However, this requirement was received prior to the team completing this research. The team has canvassed construction companies on Guam and surrounding islands to determine the demand for mobile offices. Local schools and other government agencies will also be contacted to see if they have a need for this service as well. A meeting is scheduled with the customer to help better define the requirement and estimate future needs in order to provide the industry the lead-time needed to prepare and respond to a solicitation. Several stateside companies have shown interest in the Guam market. This market research will be targeted to 'lessors of temporary office space to include converted containers' instead of the previous language of 'office trailer rental' in order to better target the desired industry. Our goal is to establish a competitive market on Guam for these requirements.
