DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition HDI 12-66 LWW Total Access Collection Subscription 1.Contracting Activity: Program Contracting Activity Central (PCAC) 6150 Oak Tree Blvd. Ste. 300 Independence, OH 44131 2.Nature and/or Description of the Action Being Processed This procurement action is for the purchase of a VA enterprise wide license for electronic access to the name brand product Lippincott Williams & Wilkins ® (LWW) Total Access Collection Subscription. No substitutions for alternate titles are acceptable. 3.Description of Supplies/Services Required to Meet the Agency's Needs: a.Veterans Health Administration (VHA) medical center libraries, Central Office staff, and the staff at the all VA Medical Centers (VAMCs), Community Based Outpatient Clinics (CBOCs), and other affiliated programs and offices continue to require continued access to the web-based version of the LWW Total Access Collection Subscription 24 hours a day, 7 days a week. b.The LWW titles, often cited as several of the world's premier medical journals by newspapers such as the Washington Post, are used heavily by VA librarians, clinicians, researchers, and educators. 4.Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): It is essential for VA to obtain access to vetted, peer reviewed, and authoritative sources of information for its clinicians for use in direct patient care, obtaining additional knowledge necessary to maintain accreditation, and to conduct research. The LWW Total Access Collection meets all of the aforementioned requirements, and is widely recognized as an essential resource for healthcare professionals. LWW is rated as one of the top five publishers in the health sciences field, is highly ranked by the Doody's Review Service, and is also well rated by the 2011 Medical Library Association's Master Guide to Authoritative Information Resources in the Health Sciences. The medical research functionality offered by LWW is comparable to the legal information research tools LexisNexis and Westlaw. All of the publications offered by LWW are proprietary, and LWW offers unique functionality by providing: "Unlimited enterprise-wide access with no geographic or concurrent user limitations "Content in both HTML and PDF formats "Access to online-only supplements and images "Detailed usage reports There are other resources on the commercial market similar in scope to LWW, such as ProQuest or Elsevier's Clinical Key, but the VA Library is also looking to procure those products, and others, in order to provide a well rounded library of medical information resources for VA Clinicians. LWW has been determined to be an essential part of the VA's medical information resource offerings, and is why the name brand requirement is justified under the authority of FAR 6.302-1. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Sources Sought Notices were published from 08/28/2012 to 09/04/2012 to both FedBizOpps (FBO) and eBuy, and revealed that (3) total vendors are interested in submitting offers for the potential procurement of a LWW Total Access Subscription. Two (2) of the respondents hold BOA's through the VACO VALNET Program, and one (1) offeror holds an Indefinite Delivery/Indefinite Quantity (IDIQ) contract through the FedLink Program. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Sources sought notices were posted to both FBO and eBuy to locate sources for the required subscription to the LWW Total Access Collection, and past procurement history was analyzed. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: 1)Ovid Technologies, Inc. 2)EBSCO Industries, Inc. 3)W.T. Cox Subscriptions, Inc. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to perform additional market research in a timely manner so that other solutions can be considered.
