Description
BACKGROUND The Federal Bureau of Prisons (FBOP), Federal Correctional Institution (FCI) Tallahassee, located in Tallahassee, Florida, intends to award a firm, fixed, price requirements type contract to a qualified entity for the provision of professional, temporary services in the form of a Temporary Pharmacist. The services will be contracted witha Private Sector Temporary Help Services Provider and not with an individual. The Temporary Pharmacist will provide services for the inmates incarcerated at the Federal Correctional Institution and Federal Detention Center. LOCATION OF PERFORMANCE The medical services will be performed in the Health Services Department at the Federal Correctional Institution and Federal Detention Center, Tallahassee, Florida. The contractor will be required to sign the contractor log indicating the date of visit to the institution along with the time of arrival and departure for security reasons. PERIOD OF PERFORMANCE Contract performance shall commence from the first day of assignment up to 120 workdays in a 24-month period. A workday will consist at least one (1) session and not exceed eight (8) sessions. The total duration of services will be consistent with the needs of the government, the availability of funds, and contractor performance. The Government reserves the right to extend the purchase order an additional 120 workdays, if required. SCHEDULE OF PERFORMANCE The contractor will provide pharmacist services during the absence of the institution's pharmacist, i.e. during periods of annual leave, sick leave, and training, as well as reassignment. The contractor will normally work, Monday through Friday (except for Federal holidays), normally between the hours of 7:30 a.m. and 4:00 p.m., with thirty (30) minutes unpaid lunch period, (if applicable). A session will equal one (1) hour. Each contractor visit will normally consist of eight (8) sessions. The Contracting Officer's Technical Representative (COTR) will be responsible for defining the weekly schedule. These schedules are subject to change based on the variable needs of the institution and the unpredictable nature of the correctional environment. Upon agreement, any changes to the schedules must be coordinated with the Contracting Officer's Technical Representative (COTR) assigned under the contract. Due to the nature of the correctional setting, delays in performance of work may be experienced. Such delays may include but are not limited to inclement weather, electrical or mechanical problems, or other security matters. When contract employees report to the institution but are unable to perform services due to such delays, the contractor will be paid for one (1) session. Normally, any remaining sessions for that day will be suspended and the contractor will be free to leave and will not be paid for remaining unperformed sessions. However, if the institution requests that the contractor remain at the institution for eventual performance, the contractor shall be paid for such sessions. In the event of any absence, the contractor shall provide replacement coverage. If the contractor fails to provide coverage, the Government may seek contractual remedy. At the beginning and end of each visit, the scheduled pharmacist will sign his/her name in a log book located in the FCI/FDCfront lobby/entrance. Payment for services will be based on actual scheduled sessions worked in accordance with the terms and pricing of the contract. Two weeks advanced notice will normally be provided to the company for coverage during periods of scheduled annual leave, except in the event of unforeseen sick leave. The company will be notified as soon as possible concerning coverage for sick leave. ACADEMIC AND EDUCATION REQUIREMENTS The contractor is required to have a graduate from an accredited school of higher education as a pharmacist and must have a current and valid state license. The contractor performing the services must provide verification of credentials and proof of insurance. The contractor's candidate must pass the security clearances listed in the Contract Security/Investigative requirements prior to performance of work. DESCRIPTION OF SERVICES All duties will be performed in accordance withstandards and methods generally accepted within the field of Pharmacy. The contractor will adhere to all standards and regulations associated with the Federal Bureau of Prisons Healthcare Services and the American Correctional Association Standards/Core Standards for Adult Correctional Institutions, as well as Federal and State policies and regulations. Temporary Pharmacist Services provided by the company will include the following: a. Interpreting medical/dental staff prescription orders. These orders may be the traditional physical prescription or orders taken from entries of the patient's electronic medical file. b. Entering prescriptions into the pharmacy's prescription computer system and printing prescription labels; c. Selecting the correct medication and filling the prescriptions; d. Inventorying medications and supplies, recording items that are low in stocking levels, and advising the Health Services Administrator and/or Assistant Health Services Administrator of medications that need ordering; e. Interacting with inmates regarding their medications and providing patient education about the medication and; ** The company will adhere to all Federal, State, and Local regulations during the performance of the above duties. EQUIPMENT/SUPPLIES All supplies and equipment the contractor may routinely need to provide the services to the inmate population at FCI/FDC Tallahassee will be provided by the Health Services Department. All medications will be provided by FCI/FDC Tallahassee. All record keeping and prescription supplies needed will be supplied by FCI/FDC Tallahassee. All records maintained by the contractor under this contract will remain the property of FCI/FDC Tallahassee. METHOD OF PERFORMANCE The contractor has sole responsibility and discretion for choosing and implementing the manner and method of performing tasks outlined in this Statement of Work as long as the requirements are met in accordance with the policies described above. The services provided, being professional in nature, will be provided in the method considered as normal in the local community. Although not directly supervised, these services shall be reviewed by a Pharmacist, Health Service Administrator, Acting Health Services Administrator, or by a clinician on staff at FCI Tallahassee to ensure contract compliance. The performance of these services will also be monitored by the designated COTR. The contract monitoring reports will be prepared by the COTR and maintained in the contract file. PATIENT MANAGEMENT The contractor will not be responsible for patient management. INMATE MANAGEMENT The provision of services under this proposed contract will require frequent and unsupervised contact with inmates. The contractor will not be responsible for the management of inmates except to ensure that those inmates involved in activities with the contractor's scope of work shall abide by all rules, in effect, to ensure the safety and well-being of all participants. The contractor will report any infractions of rules and regulations by any inmate to the Health Services Administrator, Contracting Officer's Technical Representative (COTR), or other appointed Government employee for prompt and proper action. The contractor is to be constantly aware of security and maintain a professional relationship with the inmates at all times. INSTITUTION SECURITY The contractor and it employee(s) agrees to adhere to all regulations prescribed by the institution in regards to the safety, custody, and conduct of inmates. The contractor and it employee(s) will be required to submit to a background investigation and drug testing and attend an one-time orientation program, consisting of approximately four (4) hours, prior to performing any services under this contract. The date and time for this orientation or other periodic security related training will be mutually agreed upon by both parties, and reimbursement for attendance will be at base year's hourly contract rate. The contractor providing services within the confines of the designated institution shall have a complete background investigation conducted in accordance with the BOP Program Statement 3000.02, as designated in the Personnel Manual. The following investigative procedures will be applied and appropriate forms completed before an individual is permitted inside the institution: National Crime Information Center (NCIC) Check DOJ-99 (Name Check) FC-258 Fingerprint Check Law Enforcement Agency Checks Vouchering of employers over the past five years Resume/Personal Qualifications OPM-329 A(Authority for Release of Information) Completed Contractor Pre-Employment Form National Agency Check and Inquiries (NACI) check (if applicable); and Urinalysis (if the test is positive the contractor shall be disqualified from being awarded the contract). By submitting a quotation, the contractor agrees to complete the required documents and undergo the above listed procedures. A contractor who does not pass the security clearances will be unable to perform services under this contract. The final determination and completion of the security investigation procedures will be made at the sole discretion of the FCI. All persons are advised that a urinalysis test for the detection of illegal drugs usage shall be performed. Any contractor testing positive shall be disqualified from performing under the resulting contract. Any contractor deemed not suitable by the BOP requirements will not be granted access to perform services under the contract; this is a condition of the contract. Miscellaneous Information This is a contractual agreement and not a Civil Service appointment. As specified in FAR 37.101 "Nonpersonal Service Contracts" means a contract under which the personnel rendering the services are not subject, either by the contract'sterms or by a manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. All duties outlined in this Statement of Work shall be performed in accordance with standards and methods generally accepted within the Contractor's own field of expertise. Payment shall be based on the accomplishment of specific results, and the results to be obtained shall be entirely within the Contractor's own unsupervised determination. The COTR will periodically evaluate the contractor's performance of the contract. In this evaluation, the performance of individual pharmacist will evaluated by the COTR and/or HSA. If the performance of the pharmacist is deemed unacceptable based on the COTR and/or HSA, that pharmacist will no longer perform those duties. In this event, the contractor will be responsible for replacing that contract pharmacist. Quality Standards The Government reserves the right to inspect and evaluate all services provided during the performance of this contract. The Government may conduct surveillance of any task at any time during the performance of this contract. All surveillance observations will be documented by the COTR. When an observation indicated defective performance, the Contracting Officer may issue a Discrepancy Report to the contractor. The contractor shall address any Discrepancy Report in writing to the Contracting Officer within ten calendar days of notification, indicating any corrective action taken to rectify the deficiency. RESTRICTIONS ON CONTRACT WORKERS The contractor shall not supervise inmates, supervise Bureau of Prisons staff, participate in inmate accountability, requisitions, sign for or pick up supplies, formulate policy or procedures, or attend meetings, staff recalls or staff functions; nor be a member of the Employees Club. Contractors are expected to wear appropriate professional attire at all times. Jeans (of any color), T-shirts, sandals, tank tops, and sweat pants/shirts are not considered appropriate professional attire. MEDICAL RECORDS The contractor will participate in maintaining appropriate records of services performed on the inmate patients. It is understood that, upon request, the contractor will have access to the FBOPmedical records of inmates for whom the contractor has provided service. In accordance with FAR 52.224-1 and 52.224-2, the contractor will occasionally use, disseminate, and/or handle inmates'records that contain confidential medical history. All medical records will be handled in accordance with the Bureau of Prisons Health Information Management (6090.02) Program Statement. Information concerning the medical or criminal history of an inmate may only be released by the Public Information Officer (PIO) of the Federal Correctional Institution in accordance with Privacy Act of 1974. Work Management The successful contractor will be required to follow any and all applicable guidelines for the services to be provided. He/she will also maintain accountability of all Government furnished materials, supplies, and equipment. The contractor will sign the provided log or sign-in sheet as documentation for sessions worked and for security purposes. The contractor will be responsible for submitting written reports, evaluations, and/or plans of treatment for all patients evaluated. These reports may be hand-written or typed, and must be verified by the contractor's signature. PAYMENT TERMS Contractor must provide a means for electronic payment to include bank routing and account number. Payment terms as specified in FAR 52.212-4(g), the due date for making an invoice payment by the designated payment office shall be the 30th day after the designated billing office has received a proper invoice. The contractor can however offer discount payment terms for prompt payments as specified in block 12 on the SF-1449 form of this solicitation. Half sessions will not be authorized for payment. The contractor, if an individual other than a corporation, upon contract award must complete several Human Resources Management forms. The forms are referenced as follows: Direct Deposit (SF-1199A) Federal/State/City/County tax forms (as applicable) Employee Locator Form (DOJ-233) Race and National Origin Identification (SF-181 Self-Identification of Handicap (SF-256) Employment Eligibility Verification (I-9) Payment is based on the provision of an end service or the accomplishment of a specific result (i.e. completion of a given amount of hours). In the event that full coverage cannot be provided by the contractor on any given shift, the Federal Correctional Institution will only reimburse the contractor for actual hours worked. The government cannot anticipate the precise quantity of services required. PRICING METHODOLOGY The contractor shall provide non-personal services, upon request by the institution as detailed in this Statement of Work. The Government reserves the right to award without discussion. Therefore, each initial quote should contain the quote's best terms from a cost or price standpoint. Services are required to be provided in accordance with this Statement of Work (SOW). Quoters are required to submit, as part of their quote, a completed copy of the Schedule of Items/pricing Schedule. The contract rate for these services shall be on a per session basis. Session lengths are defined as one (1) hour in length. The contract rate shall include all charges for providing the services of a pharmacist. Contract pricing shall include all charges to the Government for performing the services required by this solicitation/contract (i.e., bonding, overhead, profit, supervision, minimum wages and fringe benefits). The quantity of services to be provided by the contractor is estimated in the Schedule of Item. These estimates are not a representation to a quoter or contractor that the estimate quantities will be required or ordered, or that conditions effecting requirements will remain stable or normal. FAR 52.232-99, Providing Accelarated Payment to Small Business Subcontractors clause: 52.232-99 Providing Accelerated Payment to Small Business Subcontractors This clause implements the temporary policy provided by OMB Policy Memorandum M-12-16, Providing Prompt Payment to Small Business Subcontractors, dated July 11, 2012. (a) Upon receipt of accelerated payments from the Government, the contractor is required to make accelerated payments to small business subcontractors to the maximum extent practicable after receipt of a proper invoice and all proper documentation from the small business subcontractor. (b) Include the substance of this clause, including this paragraph (b), in all subcontracts with small business concerns. (c) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act. Note: IAW FAR 52.232-18, Funds Available - FY 2013 Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds, from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until FY 2013 funds are made available (in writing) to the Contracting Officer. Email all proposals to a1green@bop.gov
