Draft Statement of Work This Small Business Sources Sought Notice is for informational and planning purposes only and shall not be construed as a solicitation or as an obligation or commitment by the Government. This notice is intended strictly for Market Research. This is a Request for Information only. This is NOT a solicitation for proposals, proposal abstracts, or quotations. The National Institutes of Health (NIH), National Library of Medicine (NLM) is conducting a market survey to help determine the availability and technical capability of qualified small businesses, veteran-owned small businesses, service-disabled veteran-owned small businesses and/or HUBZone small businesses capable of serving the needs identified below. The purpose of this notice is to obtain information regarding: (1) the availability and capability of qualified small business sources; (2) whether they are small businesses; HUBZone small businesses; service-disabled, veteran-owned small businesses; 8(a) small businesses; veteran-owned small businesses; woman-owned small businesses; or small disadvantaged businesses; and (3) their size classification relative to the North American Industry Classification System (NAICS) code for the proposed acquisition. Your responses to the information requested will assist the Government in determining the appropriate acquisition method, including whether a set-aside is possible. PLEASE NOTE THAT THIS NOT A REQUEST FOR PROPOSAL, NO SOLICITATION EXISTS AT THIS TIME. PROJECT REQUIREMENTS: Purpose The purpose of this procurement is to obtain management consulting services for the Office of Administrative Operations (OAO), Office of Extramural Research (OER), Office of the Director (OD), National Institutes of Health (NIH). Background The Office of Administrative Operations (OAO) serves as an organizational liaison by providing information, guidance, administrative support and analytical services to assure that OER obtains and manages the resources to carry out its mission. The OAO has organizational responsibility for the business functions of OER including budget and financial management, human resource management, management policy, property and space management, and general administrative support to extramural offices throughout NIH. Task Independently and not as an agent of the Government, the contractor shall provide management consulting services to the OAO in support of ongoing efforts to enhance OAOs' employee performance and customer service across NIH. NIH is seeking the assistance from an individual with an expert understanding of senior federal management in functional business areas such as: financial and budget management, human resource management, management policy, property and space management, customer service, general administrative support and other similar management related issues. Deliverables The contractor shall: • Facilitate strategic-planning and team-building meetings for OAO staff. • Advise OAO leadership of best practices employed in successful strategic management initiatives in other organizations. • Advise OAO leadership on methods of communicating effectively with OAO customers within OER and across NIH. Travel No travel costs will be reimbursed Anticipated Period of Performance The period of performance shall be for a period of one year from the date of award with one option period of an additional 12 months. Confidentiality of Information In accordance with FAR 52.227-14(b), the contractor shall guarantee strict confidentiality of the information/data that it is provided by the Government during the performance of the contract. The Government has determined that the information/data that the Contractor will be provided during the performance of the contract is of a sensitive nature and cannot be disclosed in any manner. The Contractor, in whole or in part, can only make disclosure of the information/data, after the Contractor receives prior written approval from the Contracting Officer. Whenever the Contractor is uncertain with regard to the proper handling of information/data under the contract, the Contractor shall obtain a written determination from the Contracting Officer. Non-personal Services Clause (1) As stated in the Federal Register, Volume 57, No. 190, page 45096, dated September 30, 1992, Policy Letter on Inherently Governmental Functions, no personal services shall be performed under this contract. All work requirements shall flow only from the Project Officer to the Contractor's Project Manager. No Contractor employee will be directly supervised by the Government. All individual employee assignments, and daily work direction, shall be given by the applicable employee supervisor. If the Contractor believes any Government action or communication has been given that would create a personal services relationship between the Government and any Contractor employee, the Contractor shall promptly notify the Contracting Officer of this communication or action. (2) The contractor shall not perform any inherently governmental actions under this contract. No Contractor employee shall hold him or herself out to be a Government employee, agent, or representative. No Contractor employee shall state orally or in writing at any time that he or she is acting on behalf of the Government. In all communications with third parties in connection with this contract, Contractor employees shall identify themselves as Contractor employees and specify the name of the company for which they work. In all communications with other Government contractors in connection with this contract, the Contractor employee shall state that he/she has no authority to, in any way, change the contract and that if the other contractor believes this communication to be a direction to change their contract, they should notify the Contracting Officer for that contract and not carry out the direction until a clarification has been issued by the Contracting Officer. (3) The Contractor shall insure that all of its employees working on this contract are informed of the substance of this article. Nothing in this article shall limit the Government's rights in any way under the other provisions of the contract, including those related to the Government's right to inspect and accept the services to be performed under this contract. The substance of this article shall be included in all subcontracts at any tier. The period of performance will be for one year from the date of the award plus one option year. All responsible sources may submit a capability statement which will be considered by the National Library of Medicine. This Sources Sought notice is not a Request for Quotes (RFQ), nor is an RFQ available. Interested firms responding to this sources sought notice must adhere to the following: (a) Provide a capability statement demonstrating relevant experience, skills and ability to fulfill the Government's requirements for the above. The capability statement should contain enough sufficient detail for the Government to make an informed decision regarding your capabilities, however, the statement should not exceed 10 pages. (b) The capability statement must identify the responder's small business type and size. (c ) The capability statement must provide company name and address, point of contact, phone/fax/email and NAICS Code(s). (d) All capability statements must be submitted electronically no later than 12:00pm eastern standard time on Friday, December 14, 2012 to Ryan Singletary ryan.singletary@nih.gov. NIH-LM-2013627/RS OAO Management Consulting Services. A draft of the statement of work is attached. THIS NOTICE IS NOT A REQUEST FOR PROPOSALS. This notice does not obligate the Government to award a contract or otherwise pay for the information provided in response. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is complete and sufficiently detailed to allow the Government to determine the organization's qualifications to perform the work. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted. After a review of the responses received, a pre-solicitation synopsis and solicitation may be published in Federal Business Opportunities. However, responses to this notice will not be considered adequate responses to a solicitation. Confidentiality. No proprietary, classified, confidential, or sensitive information should be included in your response. The Government reserves the right to use any non-proprietary technical information in any resultant solicitation(s). A determination by the Government to proceed with the acquisition as a set-aside is within the discretion of the Government. If capability statements are not received from at least two responsible small businesses by the response date or if the Government determines that no small business concerns are capable of performing this requirement based upon an evaluation of the capability statements submitted, the Government may proceed with a full and open competition.
