Description
This notice provides details from the Limited Source Justification approved in support of a 90-day extension of DE-AT01-07IN30111 with Delta Research Associates Inc. I. IDENTIFICATION OF AGENCY/CONTRACTING ACTIVITY The Department of Energy?s (DOE), Office of Intelligence and Counterintelligence (IN) plans to extend the task order, DE-AT01-07IN30111, awarded to Delta Research Associates, Inc. (DRA) by means of this Limited Sources Justification via the Federal Supply Schedule (FSS), in accordance with the Federal Acquisition Regulation (FAR) 8.405-6. The Office of Headquarters Procurement Services (MA-64) will execute this action. II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED This action is to extend the task order currently being performed by DRA for a period of three months (from January 13, 2013 to April 12, 2013) to provide mission critical support associated with the IN program. An interruption to the services currently being provided would compromise the protection of the United States against threats posed by nuclear proliferation and terrorism. As such, DRA currently provides the mission critical support services to DOE-IN assisting the office with the creation and making available to appropriate Federal departments and agencies an integrated system of information from all sources concerning worldwide nuclear material holdings and their security status. The purpose of this justification is to extend the period of performance to April 12, 2013 and increase the ceiling of the task order as a Limited Sources Justification pursuant to FAR 8.405-6(a)(1) to continue the support without a break in service. The extension of the period of performance of this task order will not require any change to the Statement of Work; however it will require an increase in the level of effort to continue the support. The award of the task order was completed in accordance with Federal Supply Schedule ordering procedures in FAR 8.405-2. III. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY?S NEEDS, INCLUDING ESTIMATED VALUE This requirement is to ensure that there is no break in service or potential mission impact. The services being acquired during this extension period are consistent with the work DRA currently is performing under task order DE-AT01-07IN30111. The scope of this effort supports the continued success of IN?s efforts to provide timely and actionable strategic intelligence analysis; ensure intelligence security throughout the DOE complex; and cultivate and encourage the intelligence capabilities and contributions of DOE's technical, analytical, and research expertise is applied to the nation's most difficult technical intelligence challenges. The task order support includes the following: technical and analytical services in the areas of counterintelligence, foreign risk management, science and technology, collections and proliferation. IV. RATIONAL FOR LIMITED SOURCES AND UNIQUE QUALIFICATIONS OF THE PROPOSED CONTRACTOR FAR 8.405-6 requires an ordering activity to justify its actions when restricting competition of schedule contractors under FAR 8.405-2. The specific circumstance justifying the restriction for this acquisition is FAR 8.405-6(a)(1)(i)(C), which allows for limiting sources when in the interest of economy and efficiency, the new work is a logical follow-on to an original FSS order provided that the original order was placed in accordance with the applicable FSS ordering procedures. This extension is a logical follow-on to the original FSS order, task order DE-AT01-07IN30111, which was awarded in accordance with applicable FSS ordering practices. The original task order was issued in accordance with the applicable FSS ordering procedures and was not issued under sole source or limited source procedures in place under FAR 8.4 at the time of award. This task order extension is a logical follow-on, as it will not change the scope of work being performed by DRA. Moreover, the work to be performed during the extension period is a continuation of the services already being provided by DRA. An interruption to services provided under this task order would create substantial risk to IN?s mission. DRA has provided critical support to IN over the past five years and the extension is necessary in order to not compromise the United States against threats posed by nuclear proliferation, terrorism and cyber operations. This task order extension allows the Government to maintain the current level of expertise and support without a break in service. The nature of this acquisition is such that the current task order will expire on January 12, 2013 and the award of a new competitive task order is not anticipated prior to this expiration date. This extension is necessary to provide the required continuity of services for achievement of IN?s mission objectives without interruption while DOE continues its efforts to award a new task order. It is recommended that the period of the task order be extended to April 12, 2013. V. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ACTION REPRESENTS BEST VALUE TO THE GOVERNMENT IN ACCORDANCE WITH FAR 8.404(d). DRA is in a unique position to continue support of IN without an interruption in service. The initial task order requirement was issued competitively in April 2007. DRA?s performance has been satisfactory in meeting all of their performance requirements. Furthermore, DRA has maintained discounts on their GSA Schedule labor rates throughout the period of performance. Based on DRA?s initial proposal for this task order, their contract performance, the providing of discounted rates, the importance of continuity of services, and the strong qualifications discussed above, this short-term (3 months) extension of this task order represents ?Best Value? to the Government. Based on DRA?s successful performance over the past five years and the measurable contribution to IN?s mission goals that the contractor has achieved; a short term extension to DRA is in the best interest of the Government. VI. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OF THE SURVEY (OR STATEMENT OF REASONS NO SURVEY WAS CONDUCTED) Market research was not conducted for this requirement because this requirement is to ensure that there is continuity of services. VII. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION No other facts supporting use of limited sources have been identified beyond those documented in this Limited Sources Justification. VII. ACTION THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS WHICH LED TO RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACTIONS. There will not be any barriers that will lead to restricted competition as the successor to this task order was based on a competitive process. The circumstances resulting in the need for restricted competition for this 3 month period are temporary and should not be a factor in future competitions.
